In addition to the standard permit conditions, the following shall apply:
1. Pursuant to Section 14.16.320 of the I a Quinta Municipal Code (Ordinance 10 § 1 (part), 1982), all
work shall be performed in accordance with the latest edition of the Standard Specifications For
Public Works Construction (SSPWC) and as directed by and to the satisfaction of the City Engineer.
2. Start to Finish (Lynda Habash), hereinafter referred to as "Permittee", shall be responsible for
providing continuous dust and erosion control. All areas shall be kept watered down daily including
weekends. '
3. Streets shall be kept clean. They shall be completely cleaned at the end of each working day and
more frequently if required.
4. Pursuant to Section 6.08.050.of the La Quinta Municipal Code (Ordinance 18 §.1, 1982), throughout
the work site, the Permittee shall comply with City regulated work hours. Operation and
maintenance of equipment within one-half mile of human occupancy shall be performed only during
the following time periods:
October 1 st to April 30: Monday -Friday 7:00 a.m. to 5:36 p.m.
Saturday 8:00 a.m..to 5:00 p.m.
May 1 st to September 30: Monday -Friday 6:00 a.m to 7:00 p.m.
Saturday 8:00 a.m. to 5:00 p.m.
Work'shall be prohibited on legal holidays and Sundays. (Exception: Clean=up & sign removals)
Work performed within 500 feet of a signalized intersection is restricted between the hours of 9 a.m.
- 3 p.m. Traffic control shall be set up after 9 a.m. and removed before 3 p.m. The Permittee shall
contact the Riverside Country Traffic Signal Maintenance Department at (909) 275-6894 if signal
operation at the intersection is to be altered in any way.
6. Pursuant to Section 14.16.110 of the La Quinta Municipal Code (Ordinance 10 § 1 (part), 1982),
Permittee shall assume responsibility for repair .of any pavement damage to any public or private
street and for any damage to other City streets or facilities as a result of work performed .under this
permit.
7. Pursuant to Section 14.16.250 of the La Quinta Municipal Code (Ordinance 10 § 1 (part), 1982),
advance warning signs and traffic control shall be installed and maintained in accordance with Cal
Trans Standards or the Work Area Traffic Control Handbook (WATCH Manual). A traffic control
plan, if required, shall be prepared in accordance with the WATCH Manual_ and submitted to the City
for review and approval one (1) week prior to starting any construction. It shall be the Permittee's
responsibility to appropriately detour and barricade all construction sites.

8. Pursuant to Section 14.16.290 of the La Quinta Municipal Code (Ordinance 10 § 1 (part), 1982),
street closures shall not be permitted. A minimum of one travel. lane of paved surface shall be
maintained with flagmen at all times.
9. Prior to excavating, if required, the Permittee shall contact Underground Service Alert at 1-800-422-
4133. It -shall be the Permittee's responsibility to notify the Public Works Department of anticipated
excavation which impact City facilities, including but not limited to traffic signal conduits and loops,
irrigation lines, electrical conduits, and storm drain facilities.
10. Should additional work, materials, or modifications of the work be required in order to meet City
standards, safety requirements, signage requirements, or to fit actual field conditions, the work shall
be performed by the Permittee as directed by and to the satisfaction of the City Engineer at no cost
to the City of La Quinta.
11. All, landscaping, irrigation, decorative .rock, decorative concrete, lighting, etc., shall be
replaced to its original condition.
12. Access and egress to all local properties shall be maintained at all times.
13. This permit allows for installation of temporary directional signs on Jefferson Street, Ave 48 and
Ave 50.
14. The City of La Quinta reserves the right to revoke, suspend or void this permit at any time.

Enclosed is the application for purposes to accommodate the vehicular
traffic anticipated to arrive at the concert scheduled for Saturday, 9/2/00
on the grounds of the Empire Polo Field in Indio, California. The
event will be promoted and produced by Goldenvoice, a leader in
Southern California concerts promotions.
Start To Finish, Event Management & Services will implement the traffic
plan by using "2" changeable message boards and extensive signage along
the arterial leading to the event site, we will divide vehicular traffic to use
one of the two exits off the Interstate 10 freeway: Indio Blvd./Jackson St
and Monroe. The event tickets will also have the off -ramps printed on the
actual tickets. Additionally, event parking will be free, which will reduce,
if not eliminate, parking in unauthorized areas.

IPD contacted four of the five entities that have had recent experience with all-night concerts
(see Attachment "A"). As you can see from these reference checks, there were no reports of
extraordinary law enforcement problems (see Attachment "B"). On the other hand, the
importance of insuring adequate security and a substantial law enforcement presence was made
very clear.
While there are always risks associated with these kinds of assembly, an appropriate level of
law enforcement involvement would be expected to minimize problems. Accordingly, we
would not find any law enforcement reason to recommend denying the promoter's application.
Noise nuisance is another potential concern. An outdoor concert that entertains until midnight
is one thing; one that drones on until five or six AM is quite another. Staff sees three arguably
mitigating considerations here: (1) The concert will be held at a time when residents commonly
are using air conditioning, and therefore would not be likely to have their windows open; (2)
The open air stage will be relocated, oriented to the west, away from the concentration of
residences; (3) We are informed that the sound systems anticipated to be used will be
substantially smaller than those installed during "The Coachella" concert. Notwithstanding,
there is the risk that an all-night concert such as the event proposed will adversely impact
someone's peaceful enjoyment. -
Recommendation:
While the economic benefit of an all-night concert is questionable, such an event, if successful,
would create another potentially positive diversification to Indio as an entertainment venue.
While certainly an important consideration, whether these kinds of things are smashing
economic successes should not. be a litmus test governing their approval, in the Manager's
opinion.
Approval is recommended, subject to the conditions discussed above.

Clarence - Speer, stated he does not oppose the -holding of the concerts, however, he
requests the traffic be re-routed. He stated he has a right to enjoy entertainment of his
choice within the boundaries of his own home without it being surpassed by the p.a.
systems from the horse shows and the concerts at the polo club which is more than one
mile away. He requested the City take measures- to see that the music and
announcements are.not too loud and that they do not impose upon his privacy.
John Gentry, spoke in favor of the concert. He stated the previous concert was done in
good taste. He commented there were no problems in his neighborhood and he and
his neighbors enjoyed it. Also, he stated the Police Department.did a very good job.
Councilmember Wilson commented he was skeptical at first about these concerts but
open-minded. He stated there have not been any problems with their.concerts in any of
the. communities they have held these types of concerts. He stated he cannot find any
reason not to support the request at this time.
'After discussion, it was moved by Councilmember Bethel, seconded by Councilmember
Wilson. and unanimously carried to AUTHORIZE issuing a permit for the September,
2000 concert, subject to Staffs recommendations.
13. CHILDREN HAVE ALL RIGHTS; 'LEGAL, EDUCATIONAL, EMOTIONAL
(CHARLEE) HOMES IN NEIGHBORHOODS OF THE CITY OF INDIO
Councilmember Wilson indicated he was. looking into CHARLEE homes coming into
Indio's neighborhoods. He has contacted the League of California Cities Staff to set a
meeting to discuss. the matter.. He wants it to be known the City Council and Staff are
not taking a position that this is a NIMBY(not in. my back yard)approach. He stated the
point on this issue is trying to say to other communities to stand up -a I nd take some
accountability for their own residents.
Diane Mann, 44-798 Merlin Drive, stated her and her husband support the CHARLEE _
homes. She has talked to some of her neighbors and they want to pull together as a
neighborhood to be supportive in this area to do anything they can to make this a.
successful home in their neighborhood.
Lana Hall, stated she has been following this matter. She spoke with the director of the
CHARLEE program. She stated the people in these .homes are local and they are in
touch with their families everyday.
Councilmember Wilson thanked the public for coming out and voicing their opinion on
this matter. He applauded them for standing up and working in their neighborhoods for
a positive contribution.
There was no action taken on this matter.

The City of Indio does not have to perpetuate that unfortunate error. She stated if a
review and revision of the General Plan is where it needs to begin, then it should get
started. Mayor Pro-Tem Fesmire asked Mrs. Lawrence if she had met with
representatives of Century Homes? Mrs. Lawrence replied, no she had not.
Councilmember Wilson "stated this matter puts the City between a rock and a hard spot.
He stated Century Crowell has the right to do what they are doing. However, he stated
he looks at this matter and feels the City needs to take stand for its residents also. He
believes CEQA will tell us what is being said here tonight. He stated the proper process
is to deny the petition and ask the residents of the community to pursue the planning
process.
City Attorney stated the Council could deny the petition without prejudice and request a
review of the general plan circulation element and begin the process to determine
whether these streets should be closed. It is perfectly proper to follow that procedure
and there will be costs involved.
Louie Lopez., Senior Planner, stated there would be a process of street vacation request
and perhaps a lot line. adjustment to adjacent and abutting corners. He commented it
would cost $250 to process the application and about three months to get through the
planning commission and schedule it for the City Council to review.
City Attorney indicated if the .Council denies this petition, there is no prejudice for the
homeowners association to proceed in that process.
After discussion, it was moved by Councilmember Wilson, seconded by Mayor Pro -Tern
Fesmire and unanimously carried to DENY the petition, with no prejudice, and that the
residents/homeowners association of the Sundance community proceed with any
further process of this matter.
12. REQUEST BY ALEX HAAGEN, III, FOR SEPTEMBERIOCTOBER 2000
CONCERTS TO BE HELD AT THE EMPIRE POLO CLUB
Harold Schilling, City Manager, reported the Indio Police Department contacted the
entities that have had recent experience with all-night concerts. From these reference
checks, there were no reports of extraordinary law enforcement problems. While the
economic benefit of an all-night concert is questionable, such an event, if successful
would create another potentially positive diversification to Indio as an entertainment
:venue. There is no law enforcement issue for denying this request to hold the concert
and Staff ask's the Council's favorable consideration.
Rick Trinchero, operator of the Royal Plaza, stated basically, he supports and
encourages what the City Manager is'proposing. He suggests the City continue to allow
these types of events to progress in this community. It adds sales tax and transient
occupancy tax to the City's coffers. The event is done by Mr. Alex Haagen and his staff
and there is no reason to believe they wouldn't be equally successful.

The purpose of this plan is to outline the best scenario to accommodate the
vehicular traffic that will be coming to the Empire Polo Club -Concert. To
create the maximum number of vehicles using the parking lots at the. best
possible pace, Goldenvoice has secured lots to accommodate the vehicles
anticipated to.attend this event at no cost to event attendees.
We anticipate approximately 85% of the traffic to come via the 10 Freeway
eastbound. This plan will define the off -ramps, streets, signs and procedures
that will be put in place to move vehicular traffic at the optimum pace. We
estimate the majority of the vehicular traffic arriving between 3:00 p.m. and
9:00 P.M.
This scenario is based upon dividing up the vehicular traffic into using two
off -ramps from the 10 Freeway: Indio Blvd.,/Jefferson St. exit and Monroe St.
Event tickets will have one of the two off -ramps printed on the actual ticket.
Additionally; phone operators at Ticketmaster, as well as the Ticketmaster
website and the event website, will describe in detail the two off -ramps and
street routes to get to Empire Polo Club venue.
Freeway Procedures
A Department of Transportation — Cal Trans encroachment permit is required for
placement of CMS and other fixed signs on the shoulder of the freeway.
Two electronic message signs will.be placed approximately 1000'
on the southbound curbside of the eastbound 10 Freeway.

Directional Sign Procedures
A City of Indio and City of La Quinta Encroachment Permit is required for placement
of Type III Barricades w/ 3'x4' directional signage on the streets listed on the
detailed Traffic signage list.

Parking Plan
The Traffic Plan specifies the exact route, signage and for event attendees to enter the
designated parking lots for the Goldenvoice concert on Avenue 51/Empire Polo Club.
There are two lots that have been identified to accommodate the anticipated vehicular
traffic:
Eldorado. Polo Field — Lot #1 ( entrance on Monroe to.51 Avenue )
Located on the north side of 51 Avenue between Monroe and Madison.
Eldorado Polo Field — Lot #2 ( entrance on Madison to 51 Avenue)
Located on the south side of 51 Avenue west of Madison.
Each parking lot will be staffed at the entrance by private security trained to move the
vehicles. onto the lot as fast.and as safely possible. Additional security staff will direct
vehicles to double park. in rows and ensuring 20 foot fire lanes between rows. Each
lot will be equipped with the following equipment:
Light Towers to assist in vehicular egress and clean up after the event.
Clean up crew and trash containers to police the area during and after the event. .
Security staff throughout the event to monitor the lot during the event.
Water trucks to minimize dust on 51 Avenue.and dirt parking lots.

The City of Indio will posted No Parking on Madison between Avenue 51 and Avenue
52, on Avenue 50 between Madison and Monroe. Local access only to residents in the
area will also be posted.
