Is P File: 0710.1811.05 Ted Polich, President Colich and Sons, LP 547 West 140`h Street Gardena, California 90248 Dear Mr. Polich: Subject: Madison Street/Avenue 50 Sewer, Specification No. 2000-33 As you are aware, it has come to the district's attention that your construction site activities have encroached upon private property located at the southeast corner of Avenue 54 and Madison Street. You were notified by the district to remove an elevated water storage tank,. construction debris and related items from the private property at this location. Your forces have relocated the water storage tank and most of the debris. However, it is apparent that the property has been affected by the presence of your construction activities. GC-29, PROTECTION OF PROPERTY, requires, in part, that the contractor preserve and protect property adjacent to the site. Further, the contractor is responsible for damage to any such areas and all costs in connection with repairs and restoration required as a result of such damage. The purpose of this letter is to request that you make arrangements with the property owner to correct the existing condition to the property owner's satisfaction and secure from that property owner a damage release pursuant to the provisions of SC-3, section 3.3, of the specification which in summary permits the district to request damage releases from the contractor as a condition of receiving final payment. The damage release form will be provided by the district. A request for a damage release form for this specific private property is not to be construed to limit the district's request for other such damage releases in addition to those already identified under SC-3, section 3.4, of the specification. If you have any questions please call Thomas Gee, project engineer, extension 365. Yours very. may, Lay Tom Levy General Manager -Chief Engineer cc: City of La Quinta, La Quinta Robert H. Pritchard, Jr., Esq. January 25, 2002 k FEB 12 2002 4 Colich & Sons. 547 West Wth Street Gardena, CA 90248 Re: Madison Street Sewer Installation Ladies and Gentlemen: I am writing to you on behalf of Mr. Mery Griffin, whose holdings in La Quinta include 80 acres of land bordered by Madison Street, running from 54th Avenue to the Greg Norman golf course. Mr. Griffin and his property have suffered immeasurable damage as a result of your misconduct, and immediate action must be taken to cease further harms, to remedy this situation in its entirety, and to compensate Mr. Griffin for the aggravation and injury that he continues to endure daily. In carrying out your work on the La Quinta sewer line project, your trespass onto Mr. Griffin's property, both by driving vehicles across the land and by storing vehicles, machinery and equipment on the property both day and night, has caused an unsightly condition and has resulted in the creation of two dirt roads that lie well within Mr. Griffin's property line. To further exacerbate this blatant violation of Mr. Griffin's property rights, you appear to have undertaken a course of extensive defoliation of the area, and as a result a number of trees on Mr. Griffin's property have been severely cut back and much vegetation has been removed. In addition to the physical damage directly caused to Mr. Griffin's property as a result of your company's illegal trespass, your clearing of vegetation has resulted in a tremendous dust problem that affects both Mr. Griffin's residence and lands as well as surrounding properties. Mr. Griffin has taken care to maintain the vegetation on his property, in part to prevent the infiltration of dust that he is now suffering due to your actions. We have taken photographs of the vast amounts of dust that now migrate throughout the area on even mildly windy days, and the pictures show clearly the extent of the dust that is being stirred up from the edge of Mr. Griffin's land. In addition to the inconvenience and damage that is daily being wrought on Mr. Griffin's property as a result of this permeation of dust, we have been informed that your actions may expose Mr. Griffin to liability as a result of the dust that now spreads from his property to the surrounding community. The conditions that you have caused violate applicable dust control regulations (La Quinta's Fugitive Dust Control Ordinance and the South Coast Air Quality Management District Rules), and fines to the property owner 3000 31ST STREET, SANTA MONICA, CALIFORNIA 90405 • (310) 664-3000 • FAX (310) 664-3001 Colich & Sons January 25, 2002 , Page 2 may ensue. We intend to seek indemnification from you for any damages that may be assessed upon Mr. Griffin as a result of these conditions. Your company's closure and/or blockage of 54t' Avenue without notice has also caused significant inconvenience to Mr. Griffin and his guests. This thoroughfare serves as a main route to Mr. GrifFin's residence, and the manner in which your company has blocked access to the property has made this situation even more unbearable. Mr. Griffin and his guests have been treated with unnecessary rudeness by your staff, and in one case a crane was directed to physically place a pipeline onto the roadway in response to an inquiry. from a family member seeking access to Mr. Griffin's land. We certainly expect that these types of actions are not condoned by your company, and that treatment of pedestrians and vehicles will improve significantly in the very near future. Please contact my office immediately to discuss these issues and the manner in which you intend to rectify the damages that Mr. Griffin has suffered. In the meantime, we demand that any encroachments onto Mr. Griffin's land, by person or property, cease at once. It is our understanding that your contract with the Coachella Water District prevents you from receiving funding until Mr. Griffin has delivered a release relating to the impact of your work on his property. I trust that you understand that we are in no position to deliver any such documentation on the basis of your company's actions to date or the conditions as they currently exist. Please be advised that we are investigating all legal recourse available as a result of your actions, and that we are in contact with both the Coachella Valley Water District and the City of LaQuinta to secure their assistance in this matter. in r ly, cc: Mr. Mery Griffin L. Permit Number: 3500 Contractor: Colich & Sons Date: August 15, 2002 Introduction This is the Official Preliminary Punchlist for Encroachment Permit #3500 issued on behalf of Coachella Valley Water District to Colich & Sons. It should be noted, however, it is preliminary in the sense that new items can be added as needed if city staff becomes aware of additional deficiencies after its issuance. Having noted that exception, however, this punchlist does represent a complete review of the project by city engineering staff as of the date the punchlist was issued; it is good for sixty (60) days. If the deficiencies noted on this punchlist are not completed within 60-days city engineering staff will make a complete review of the project again. 2. The Construction Division of the Public Works/Engineering Department, and its administrative staff, are the City's representative in the field. Completion of improvements to the satisfaction of the Senior Engineer and its administrative staff does not mean the improvements are accepted; it means the Senior Engineer is willing to make a recommendation to the City Engineer that the improvements are satisfactorily completed. The City Engineer has the ultimate decision authority with respect to deciding whether the improvements associated with this encroachment permit are satisfactorily completed and worthy of acceptance. 3. Typically, new deficiency items are added to the punchlist because a member of the general public has pointed out a deficiency and city staff concurs that correcting the deficiency is 'a valid responsibility of the contractor. Whenever new deficiency items are added to the Official Preliminary Purchlist, it is done so by amending the punchlist. Pursuant to the direction you provided in that letter; please be advised that the City is. satisfied with the grading and placement of the dirt berm. The berm is placed on private property and does not interfere with any public purpose. The balance of the restoration work on Mr. Griffin's property being performed by Colich is a civil matter, therefore the City will not comment on that effort. This is the Official Preliminary Punchlist for Encroachment Permit #3500 issued on behalf of Coachella Valley Water District to Colich & Sons. It should be noted, however; it is preliminary in the sense that new items can be added as needed if city staff becomes aware of additional deficiencies after its issuance. Having noted that exception, however, this punchlist does represent a complete review of the project by city engineering staff as of the date the punchlist was issued; it is good for sixty (60) days. If the deficiencies noted on this punchlist are not completed within .60-days city engineering staff will make a complete review of the project again. The City Engineer has the ultimate -decision authority with respect to deciding whether the improvements associated with this encroachment permit are satisfactorily completed and worthy of acceptance. 3. Typically, new deficiency items are added to the punchlist because a member of the general public has pointed out a deficiency and city staff concurs that correcting the deficiency is a valid responsibility of the contractor. Whenever new deficiency items are added to the Official Preliminary Punchlist, it is done so by amending the punchlist.
