I.Tentative Approval of Cancellation. Pursuant to City of La Quinta Resolution No. 2003-
126, adopted by the City Council of the City of La Quinta at a public hearing held on
December 16, 2003, the City Council tentatively approved, subject to the findings,
conditions and contingenc_ies in such Resolution, cancellation of the Land Conservatjon
Contract for Coachella Valley Agricultural Preserve No. 58, recorded on February 28,
1974, as Instrument No. 23559 in the Riverside County Official Records (the ,;Contract").
Such tentative approval was documented in that certain Certificate of Tentative '
Cancellation of Land Conservation Contract for Coachella Valley Agricultural Preserve
No. 58 ("Tentative Certificate") dated July 14, 2004, and recorded on July 22, 2004, as
Instrument No. 2004-0568863 in the Official Records of Riverside County, California.
2.Certificate of Amount of Pee Cancellation. The amount of One Million One Hundred
SLxty-Eight Thousand One· Hundred Twenty-Five Dollars ($1,168,125), determined and
certified by the City Council, pursuant to Section 51283 of the Government Code, was
received by the Office of the Treasurer -Riverside County on September 21, 2004,
(Business Unit: TT ARC; Deposit ID: 4115). The receipt of this payment satisfies the
remaining �pproval as documented in recc;irded Instrument No. 2004-0568863.
3.Name of Landowner Reguestin!! Cancellation and Legal Description of Property. The
name ofthe landowner requesting.cancellation of the Contract is Coral Option I, LLC, a
California limited liability company ("Landowner"). The property subject to tliis
Tentative Ce1tificate is legally described as Riverside County Assessor Parcel Numbers
764-200-007-8, 764-210-004-6, 764-210-005-7 (the "property").
4.Conditions Precedent to Recordation of Certificate of Cancellation. Pursuant to California
Gov.ernment Code Section 51283.4(b), the City of La Quinta acknowledges and agrees
that the Landowner has satisfied all conditions and contingencie:;.

NOTICE IS HEREBY GIVEN that pursuant to Government Code Sections 51282 and 51284, the
City of La Quinta City Council did hold a PUBLIC HEARING on December 16, 2003, at 7:00 p.m.
in the La Quinta City Hall Council Chambers, 78-495 Calle Tampico, La Quinta, California on the
following item:

The City of La Quinta City Council held a public hearing to consider the tentative cancellation of
the Contract for ± 195 acres for Coachella Valley Preserve No. 58, (as depicted above), and
adopted Resolution No. 2003-126, to allow the future development of residential and golf
course uses on the subject property, subject to the satisfaction of conditions.
The City of La Quinta City Council made the following findings at its December 16, 2003
meeting pursuant to Government Code Section 51 282, to approve the tentative cancellation of
the contract on the basis that the cancellation is consistent with the Williamson Act:
1.A Notice of Non-Renewal has been served: A Notice of Non-Renewal was served on the
County on or about February 26, 1999, and recorded on July 7, 1999 as Instrument
No. 1999-320309 in the office of the County Recorder of Riverside County.
2.Cancellation is not likely to result in removing adjacent lands from agricultural use: There
are no adjacent lands which are not currently zoned residential or commercial.
3.Cancellation is for an alternative use which is consistent with the City's General Plan: The
subject property is designated as LDR (Low Density Residential), Golf Course (GC) and,
Neighborhood Commercial (NC) under the City of La Quinta General Plan. The proposed
alternative use for the subject property will be developed as a resort community with
residential, golf courses and commercial uses.
4.Cancellation will not result in discontiguous patterns of urban development.
5.There is no proximate non-contracted land which is both available and suitable for the
proposed use of the contracted land and development of the contracted land would
provide more contiguous patterns of urban development than development of proximate
non-contracted land.
6.The amount of cancellation fee pursuant to Section 51283 of the Government Code has
been determined and certified by the City Council to be $1,168,125.
