SUBJECT: TEMPORARY USE PERMIT 2018-0014 – LA QUINTA CHEVROLET
TEMPORARY PARKING
Dear Ms. Kehoe:
The Design and Development Department hereby approves your application request to
temporarily park La Quinta Chevrolet vehicles on the former Sam’s Club Gas Station site
located south of Highway 111 and west of Dune Palms Road. This decision may be
appealed or called up to the Planning Commission within 15 calendar days of the issuance
of this letter. The temporary parking lot shall be installed in conformance with the
application and attached exhibits and subject to the following conditions:
1. The temporary parking lot (lot) can remain operational for a twelve-month
period, from the date of this approval letter (December 17, 2019). Use of the
subject parcel for purposes of temporary parking shall cease upon expiration of
Temporary Use Permit 2018-0014, unless a new Temporary Use Permit has been
approved.
2. Access to the lot shall only occur during regular business hours for La Quinta
Chevrolet.
3. No temporary signs are permitted unless separately approved by this Department.
4. Applicant shall comply with the requirements for Fugitive Dust Control per Chapter
6.16.040 of the La Quinta Municipal Code.
5. Surrounding drive aisles and lot shall be cleaned at the end of each working day
and more frequently, if required.
6. Should additional work, materials, or modifications of the work be required in order
to meet City standards, safety requirements, signage requirements, or to fit actual
field conditions, the work shall be performed by the Permittee as directed by and
to the satisfaction of the City Engineer at no cost to the City of La Quinta.
7. Surrounding roadways and intersections shall remain readily accessible for
passage of emergency response vehicles and private vehicles. There shall be no
queuing of vehicles along all surrounding roads or parking lot drive aisles for the
purposes of entering the lot. Roadways to activities in and around the lot shall be
maintained accessible to emergency vehicles at all times.
8. The access way that provides ingress and egress from Dune Palms shall be kept
clear of any vehicles, fences, gates, etc.
9. Per the attached site plan, a temporary chain link fence may be set up around the
perimeter of the gas station site, so long as it is kept in good condition. The
applicant is responsible for the maintenance and appearance of the fence. The
fence must be removed at the end of the permit period.
10. The use of the lot is subject to spot inspections by the Police Department and/or
City Staff to ensure compliance with the conditions of this letter.
11. Any damage to public hardscape caused by this use shall be repaired as directed
by the City Engineer. This includes but is not limited to sidewalks, curb and gutter,
landscaping, and pavement especially within the surrounding public streets.
12. The City of La Quinta reserves the right to revoke, suspend, or void this permit at
any time.
13. The permittee shall indemnify, hold harmless and assume the defense of the City
from all damages, delay costs, costs or expenses in law or equity that may arise
out of work under this permit.
14. The City may elect to add conditions to this application request to mitigate any
problems that may arise and are not addressed herein.
