--GREATER COACHELLA VALLEY SOAP BOX DERBY --
This permit authorizes special event activities to be accomplished within City of La Quinta
right-of-way ONLY. Whenever the special event activities extend into private property, it is
the responsibility of the applicant, or their agents, to secure permission from abutting property
owners. Such authorization must be secured by the applicant prior to staring the special event
activities.
1. The applicant, Lucia Moran, shall be available during the event by cellular phone at 805-
1603; pager 836-6135 or a message can be left at 347-1412.
2. The necessary traffic control signage, barricades, and cones identified on the approved traffic
control plans will be provided and set up by the City. The applicant shall notify the City
immediately if replacement equipment is needed.
3. The applicant shall be responsible to have volunteers at the intersection of Bermudas &
Nogales at all times during the event to allow residents living on Avenida Bermudas within
the event area, their guests, mail carriers, and companies delivering to them, access to the
southbound one-way fire lane provided on the traffic control plans.
4. The applicant. shall also assign volunteers to regularly monitor the intersections of: 1)
Bermudas & Chihuahua, 2) Bermudas & Monterey, 3) Bermudas & Colima, and 4)
Bermudas & Arroba.
5. The permittee is responsible for making sure that temporary no parking signs along the
parking area affected by the special event are existing. The signs shall be placed along the,.
area 48hrs prior to the start of closing the area, and removed immediately after the
construction completion date.
6. The City of La Quinta reserves the right to revoke, suspend or void this permit at any time.
7. The permittee shall indemnify, hold harmless and assume the defense of the City from all
damages, delay costs, costs or expenses in law or equity that may arise out of work under this
permit.

BACKGROUND AND OVERVIEW:
On March 8, 2005, representatives of the Don' .Berry. Memorial Greater Coachella
Valley:Soap Box Derby applied for a temporary use permit to hold their annual event
on Saturday, April 16, 2005, between the hours of 5:00 a.m. and 7:00 p.m. The
Community Development Department will issue Temporary Use Permit 2.005-529 after
they receive comments.from potentially affected agencies.
The proposed. race route. is identical to -the route used in previous years, and requires
the closure of Avenida Bermudas between Calle Arroba and Calle Nogales, and closure
of the side streets .to the west that connect to Avenida Navarro, which include Calle
Arroba, Calle Colima, Calle Monterey, Calle Chihuahua, and Calle Nogales.

Temporary street closures are allowed if the City Council adopts a Street Closure
Resolution pursuant to Municipal Code Section 12.32. If the Resolution is adopted,
the Public Works Department will issue an Encroachment Permit pursuant to Municipal
Code Section 12.16 that requires implementing traffic safety measures including
traffic control signs, barricades, and other safety measures.
The temporary street closure will have minimal impacts on the surrounding area
because other streets adjoining the site are available to provide access to the
surrounding residential properties. The affected property owners will be notified of the
upcoming event pursuant to the conditions of Temporary Use Permit 2005-529.
Approval of the temporary street closure will not create conditions that may threaten
the public health and safety needs of the community because specific conditions will
be imposed as.a part of Temporary Use Permit 2005-529.
FINDINGS- AND ALTERNATIVES:
The alternatives available to the City Council include:
Adopt a Resolution of the City Council approving the temporary closure of
Avenida Bermudas between Calle Arroba and Calle Nogales, and the side streets
to the west that connect to Avenida Navarro, for the annual Don Berry

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
La Quinta, California, as follows:
Section 1. That the above citations are true and correct and constitute the
findings and requirements of the City Council in this case.
Section 2. The City Council approves the closure of portions of Avenida
Bermudas between Calle Arroba and Calle Nogales, and the side streets to the west
that connect to Avenida Navarro (Exhibit "A"), from 5:00 A.M. to 7:00 P.M. subject to
conditions imposed by the Public Works and Community Development Departments.
Section 3. The City Engineer, or his designee, will issue an Encroachment
Permit (Chapter 14.16- of the Municipal Code) to the Don Berry Memorial Greater
Coachella. Valley Soap Box.Derby regulating the closure of the streets provided certain
traffic control standards and the Conditions of Approval for Temporary Use Permit
2005-529 are met.
Section 4. "No parking" signs will be posted (Chapters 12.16 and 12.32 of the
Municipal Code) as required by the Public Works Director, a minimum of 24-hours prior
to the event. The Riverside County Sheriff's Department will tow any unauthorized
vehicle within this area at the time of the event.
Section 5. . In case of bad weather, the City Manager is authorized to
reschedule the street closure provided all conditions of approval under Temporary Use
Permit 2005-529 are met.
Section 6. The Don Berry Memorial Greater Coachella Valley Soap Box Derby
personnel shall obtain an Encroachment Permit from the Public Works Department,
including a traffic control plan, prior to closing the streets, and make arrangements to
install all traffic safety signs and barricades prior to the closure of said streets.
Section 7. A condition of Temporary Use Permit 200.5-529 shall be to have
Riverside County Sheriff's Department personnel on hand to assist the applicant with
on -site security and provide traffic control measures needed to carry out the street
closure permit.
Section 8. The City Council authorizes City staff or other assigned safety
personnel to close the event if at any time all safety standards are not being met, and
thus could jeopardize those persons attending the function; and
Section 9. The City Clerk shall cause this Resolution to be posted after its
adoption.

Dear Dodie:
This letter is a follow-up to our conversations regarding this years Don Berry
Memor' eater Coachella Valley Soap Box Derby. The race is scheduled
for This year the Franchise Fee has increased to One
�,� �'1'housan our Hundred Fifty Dollars ($1,450.00) for the two Divisions, Stock
& Super Stock. The Boys & Girls Club of Coachella Valley issued a check to the
International Soap Box Derby for the Franchise Fee, so I could meet their
payment requirement deadline. I am asking that you please reimburse the
Boys & Girls Club of CV for the Franchise Fee ($1,450.00) at your earliest
convenience (copy of check & Invoice attached).
Other costs associated with the Soap Box Derby, which is usually taken care of
under the Public Works Department budget, is the Street closure (noticing,
cones, barricades & personal to set-up and break -down of street closure),
street sweeping the morning of the race (SAM) and any other staff time
required. I usually type the notices for the Avenida Bermudas residents and
the other residents within the 300-foot required noticing radius. I then take
the notices to public works and have them copy the required number of each.
We then have kids (or committee members) take a copy of the appropriate
letter and post to each resident the week before the race.

Former President Gerald Ford has again agreed to be our Honorary Chairman
this year. As in precious years, we will call on the business community to
donate other services, including but not limited to trash receptacles, large
trash bin & porta potties by Waste Management. Printing, postage, water, t-
shirts, trophies, graphic artist, travel arrangements for winners and their
families are a few of the other expenses covered by various corporate &
individual sponsors, community organizations and other entities that believe
in the soap box derby program.
I thank you for all your support these past 10 years. If you have any
questions, please don't hesitate to give me a call.
