SUBJECT: SETBACK ADJUSTMENT 90-011
Dear Mr. Gallant:
Your request for a setback adjustment to allow an encroachment
of two feet into a required 10-foot street sideyard for a
chimney chase has been reviewed and approved based on the
following determinations:
1. This adjustment is consistent with the intent and
purpose of the zoning ordinance, in that -the two
foot encroachment affects only a small area and
still allows an eight foot clearance for access
along the affected sideyard.
2. There are special circumstances applicable to the
property, including such factors as size, shape,
and location that justify approval of the
adjustment.
3. This adjustment will not be detrimental to the
health, safety, and general welfare of the
Community, nor will it be detrimental to property
in the vicinity of the subject parcel.

our file.
