Chin operates Dune Palms Mobile Estates ("Dune Palms") on the Subject Property. The City of La Quinta has filed an eminent domain lawsuit against Chin, seeking to take a portion of the Subject Property. See City of La Quinta v. Chin Family Properties Limited Partnership, et al., Riverside Superior Court Case No. PSC 1803284. Five mobile home spaces are going to be affected by the City's acquisition. It is our understanding that the resident of Space 82 wishes to be relocated onto vacant Space 66. Overland, Pacific, and Cutler ("OPC") has arranged for A.A. Max Quality Construction to relocate the resident. In order to provide permission for the move, Chin and Dune Palms require A.A. Max Quality Construction to acknowledge and agree to the following: • A.A. Max Quality Construction is responsible for ensuring the mobile home will fit on Space 66 and allow for a parking space. If the mobile home will not fit, or if the mobile home does not withstand the move, A.A. Max Quality Construction must get prior approval to bring in another home that fits that space. + A.A. Max Quality Construction is responsible for the removal of any trees or fencing that may be required for the mobile home to fit on Space 66. • A.A. Max Quality Construction must install a pedestal to attach an electrical meter. The electricity cannot exceed 50 AMPS, and the meter must be a plug in meter, not a hard- wired meter. Max Quality Construction shall set-up the home and will attach the utilities, electrical, water and sewer to the mobile home. Dune Palms can provide A.A. Max Quality Construction shall obtain and maintain at A.A.
