By piggybacking the repavement project with a similar one nearby, the City received a 30% savings in construction costs. They would most likely not have been able to repave the road without that savings. One of the challenges had been keeping the project accounting separate in order to verify that the City received maximum reimbursement of their Federal funding. We worked closely with the local Caltrans agency representative to maintain strict oversight of reimbursements. Our staff also supported the City with public outreach and closely coordinated the construction schedule with the Spring break schedule at the Coral Mountain Academy on Van Buren. Recycled the existing base material in -place rather than hauling off and importing new, virgin base material. This conserved natural resources and reduced mining operations and truck trips, thereby saving fuel and reducing pollution. Key land uses along the project segment include Jurupa High School, Vernola Regional Park, Field of Dreams Sports Park, and multiple residential developments. Provided plan/constructability review; traffic studies; utility coordination; established design and permitting standards, guidelines, and protocols; reviewed WQMPs; GIS implementation; permitting, utility coordination, construction management and inspections. Riverside Drive Widening Provided construction management and inspection for the $1.5 million, SB1 funded road and bridge improvement project, involving the widening of a bridge and roadway that serve as a major truck route and access point to a large Costco Distribution Center, The project also involved sidewalk improvements, ADA compliance, and utility relocation, Pyrite Street Complete Streets o Prepared the ATP grant application, secured funding, developed conceptual plans, design management, construction management, and 1---'�---`--��`-�� inspection. This project incorporated many_ -- "Complete Streets" elements. Pyrite Street :^ �-;p -= : a ". was developed prior to City incorporation in 2011 with four through lanes, a 40 mile per hour speed, and 76 feet of pavement width. This type of roadway design was incompatible fronting an elementary school with children crossing the street, bicycle activity, and on -street loading/unloading. Glen Avon Elementary School serves 673 students in a disadvantaged community. Access to the school is limited to Pyrite Street. Consequently, at ingress/egress all student activity, including parents picking up and dropping off children, is concentrated at the front of the school. In addition, Pyrite Street is a Major Arterial and an attractive option to motorists accessing State Route 60. Construction Management and Inspection Services, La Quinta Village Complete Streets0�, Page 111 The comprehensive Pyrite Street project included both continuous sidewalk and curb and gutter along the east and west sides of Pyrite Street between Galena Street and Mission Boulevard in the form of a Road Diet to better accommodate pedestrians, bicyclists, and equestrians while still accommodating automobiles. The project extended the existing sidewalk, curb and gutter on the east side of the street from its existing terminus just north of Glen Avon Elementary School to Mission Boulevard and installed new sidewalk on the west side of the street between Mission Boulevard and Galena Street. ADA-compliant ramping was provided at all intersections along the project and an enhanced crosswalk was developed at the intersection of Pyrite Street and Cassidy Circle, including solar LED flashers and pedestrian push buttons. On -street parking was modified to create pick-up/drop off zones with clear areas around the crosswalks to improve pedestrian safety and visibility. Continuous bicycle lanes were constructed. The added curb and gutter connected to the existing storm drain system, allowed for regular street sweeping, provided for a clear, dry walkway for students going to and from school, and defined bike lanes to encourage more bicycle use. The Road Diet reduced the number of through lanes to one each way and provided bicycle lanes with buffer areas between the bike lanes and auto lanes, a median turn lane, and better defined on -street parking/loading areas. As the City's Project Manager and Plan Review Manager, HR Green played a key role in the planning, design, and construction as well as value engineering and plan check of the award -winning, $500 million OC Bridges Program. We provided extensive value engineering and design engineering input to save time and money, mitigate impacts, enhance infrastructure improvements, and collaborated with OCTA, OC Flood, multiple cities, utilities, and water agencies to facilitate permits and improvements. A key component for success and compliance with design standards was our plan review for $500 million in grade separations and a new, $17 million Metrolink Station, including drainage, water quality management plan, erosion control, sewer, street, traffic signal, street light, by-pass road, landscape and irrigation, demolition, phasing, traffic handling, and traffic control. As part of the OC Bridges/Grade Separation Program, HR Green's Project Manager protected the City's interests as highlighted below: Placentia Avenue Undercrossing/Grade Separation ($69 million): A roadway within the project area, Industrial Way, had very poor pavement conditions. HR Green's Project Manager helped negotiate for OCTA to require the contractor to reconstruct the road at a cost of approximately $50,000 due to adverse impacts of construction. HR Green's Project Manager negotiated with the contractor to incorporate sound attenuation elements and allow for night time construction adjacent to apartments. This mitigated community complaints and reduced the detour schedule by several months. � Construction Management and Inspection Services, La Quinta Village Complete Streets tp ,fix R Page 112 Kraemer Boulevard Undercrossing/Grade Separation ($71 million): The lowering of the roadway created a sump condition with the existing 78-inch diameter storm drain system and a 15- inch diameter sewer trunk line. HR Green's Project Manager worked closely with Anaheim's City Engineer and OCTA's design engineer to facilitate drainage and sewer facilities as gravity systems. This avoided the need for a sump pump system, thereby saving more than $200,000 in construction costs. Orangethorpe Avenue Overcrossing & Grade Separation ($117 million): Southern California Edison was tasked to relocate utilities to allow the contractor to drive 800 piles adjacent to the railroad tracks and homes under a constrained schedule. To mitigate impacts and accelerate the construction schedule HR Green's Project Manager negotiated various design elements and participated at public outreach workshops/meetings. Our Project Manager negotiated a complete road closure and $200,000 from OCTA for additional traffic control while helping to create a viable detour option and reduce the construction schedule by 12 months, Our Project Manager coordinated with OCTA's Public Information Consultant, the single point of contact for public outreach and community engagement. Impacted stakeholders included residents, business owners, first responders, nearby schools, delivery carriers, postal services, hospitality facilities, utilities and others. Including them quite early in the process helped to alleviate anxieties. Maintaining regular contact throughout the duration helped to manage complaints. Similar to the type of detour and traffic movement anticipated for your project, we helped identify the detour routes and worked diligently to maintain access to businesses that were impacted. We even communicated with Google to have its maps indicate closures and reroute drivers to the fastest alternate roads. Stage I improvements consisted of road widening, traffic signals, approximately 5800' of storm sewer of which approximately 700' is large diameter (54") culvert pipe; installation of roadway lighting, installation of decorative lighting with banner arms, brick paver crosswalks, and sidewalk with brick paver accent strips in the downtown Johnsburg area; relocation and removal of approximately 550' of sanitary force main, removal and replacement of the waterproof membrane system for the bridge, installation of 4' x 2' precast box culverts, installation of two retaining walls, and landscaping/pavement markings/signage. ® Construction Management and Inspection Services, La Quinta Village Complete Streets rr�e HRGreen. —Pa g o 13 ' l r Stage II improvements consisted of road widening, construction of a modern roundabout intersection, roadway lighting, sidewalk with decorative brick paver accent strips, stamped concrete aprons, block retaining walls, decorative railings, and associated landscaping/pavement markings/signage in the center of downtown Johnsburg. New storm sewer facilities were installed in conjunction with the roadway improvements, including 200 feet of 4'x10' precast box culvert to divert an existing drainage channel under the intersection. Utility Coordination HR Green assisted with the relocation efforts of Nicor, ComEd, Comcast and the relocation effort of ATT by identifying possible conflicts and then field staking locations of new appurtenances to provide the utility companies with a visual reference of the proposed improvements to ensure utility facilities are relocated clear of the Johnsburg Road improvements. HR Green assisted MCDOT with an advance storm sewer contract for Johnsburg Road in 2012 to allow Nicor to relocate significant facilities after storm sewer was installed. This effort allowed Nicor to complete their relocation efforts of large diameter gas main prior to the start of the Johnsburg Road contract avoiding any possible project. Public Outreach I Community Engagement HR Green assisted McHenry County DOT with a significant stakeholder outreach program for the project. HR Green and MCDOT met with the Village of Johnsburg including Village Police Department, McHenry Township Fire Protect District and Johnsburg School District several times prior to the start of the project to discuss the impacts of the eastbound detour. HR Green assisted MCDOT with two public meetings prior to the start of the project. One meeting was held in conjunction with McHenry Township's Annual meeting and the other meeting was a public open house. HR Green provided project details including the Johnsburg Road construction website. HR Green provided the public with methods to contact construction staff (cell phone numbers, email addresses, contact through the website). HR Green knocked on doors and provided informational door hangers to over 400 residences throughout the project corridor. HR Green created a project website and Facebook page for interested parties to provide residents a forum to ask questions, receive e-mail construction updates, view project detour maps and view the construction progress via job photos. HR Green also met with all the business owners in the corridor to discuss how the project will impact their businesses and also gave out project contact information so they had a dedicated person to contact if any construction related questions arose. This federally funded project was let through the Illinois Department of Transportation and required that all construction inspection was documented on the State quantity tracking software, ICORS. All evidence of material inspection was in accordance with the IDOT Project Procedures Guide prior to issuing payment. Box 5127, Coralville, IA 52241 HR Green has provided extensive city engineering, master planning civil engineering, stormwater design, sustainability, and landscape architecture design services for infrastructure projects. The $5.3 million Iowa River Landing redevelopment project converted a 180 acre industrial area into a mixed -use district comprised of a hotel, conference center, 300,000+ square feet of retail, office, residential and entertainment space, a medical clinic and parking. The City of Coralville sought to incorporate and create a sustainable and pedestrian -friendly development with stormwater best management practices (BMPs), ADA accessibility, and on -street parking to serve and attract local businesses. The multitude of BMPs allowed the City tc grants and state funding to partially pay for the project. HR Green prov engineering, lighting, landscape architectural design services as well a, management and inspection. The design included intricate paver lay accessible walkways, stormwater planters, benches, trash receptacles, lighting, fencing, wayfinding signage and landscaping. Village of Sugar Grove (IL) Contact: Tony Speciale I Director of Public Works 630.391.7230 1 aspeciale@sugargroveil.gov — 601 Heartland Drive, Sugar Grove, IL 60554 HR Green provided resident engineering and construction inspection services for $3.2 million in road improvements. This project consisted of the re -alignment of Granart Road and Dugan Road as well as the construction of a modern roundabout in order to provide additional separation from US Route 30 at Dugan Road intersection and the adjacent Burlington Northern Santa Fe Rail at grade railroad crossing which parallels US Route 30. Project improvements included 3,400 feet of new roadway and curb and gutter, intersection and decorative lighting, stamped concrete truck apron, an asphalt bike path, water main relocation, a detention pond and associated storm sewer and ditch lines. The construction staging and maintenance of traffic was extremely complicated since the roadway realignments required three (3) separate connections to the existing roadways. In addition, a portion of the roundabout overlapped existing Dugan Road, preventing the roundabout from being built in its entirety without impeding traffic. There were numerous businesses along the various roadways that were impacted. Various roadways could not be closed due to the need for the local businesses to remain open during construction. HR Green assisted the Village of Sugar Grove with a stakeholder outreach program (e.g., project website and property owners meeting prior to the start of construction. HR Green coordinated with companies in two business parks on daily basis to ensure large deliveries could pass through the project. ® Construction Management and Inspection Services, La Quinta Village Complete Streets .f�. HRGreen. Page 115 tea.--n.,.. • : m C. PROJECT UNDERSTANDING AND APPROACH OLD TOWN The La Quinta Village has historically been an out of the way destination for curious tourists and local residents. Located three miles south of the Highway 111 business district The Village is not widely known for night life, shopping or year 1 # ■*� round attractions. The businesses in The Village do not generally get adequate foot traffic to support most retail operations which has made it a challenging area M for business attraction. Street improvements in the 1990's and early 2000's along with the development of the Old Town private development project helped attract L f7� I rl more visitors to the area but further improvements are needed to improve the viability of The Village to live up to its full potential. In 2015 the City of La Quinta held a public workshop to gain insight as to what improvements could be made that would entice mixed -use and commercial development and enhance the image to make The Village more attractive to both residents and outside visitors. Improvements to the bicycle and pedestrian access as well as creating attractive public areas within The Village were widely supported by the residents and business community that attended the workshop and completed the follow-up surveys. Based on this input, the City prepared an environmental analysis for a variety of pedestrian and bicycle amenities, including traffic calming measures to improve access for golf carts and neighborhood electric vehicles (NEVs), in hopes of someday creating a city downtown that matched the City's vision. After completing the environmental review in 2016 the major hurdle was how to pay for the improvements to meet this vision. That hurdle was cleared with an approved Active Transportation Program (ATP) grant the City received in 2016 to convert five surrounding intersections to single lane roundabouts with bicycle, golf cart, NEV and pedestrian connections throughout The La Quinta Village. This project is the culmination of nearly four years of work to create the revitalization of The Village to better connect the community to its businesses on a pedestrian and bicycle scale that will hopefully prove attractive to visitors, investors and developers to complete build out of the remaining vacant sites with mixed -use and commercial retail that will make The La Quinta Village a "must see" destination in the Coachella Valley. ® Construction Management and Inspection Services, La Quinta Village Complete Streets t# HRGreen, P a 0 e 116 r. FrM1 Project Approach HR Green is well -qualified to make the City's vision for The Village a reality. We will provide seasoned construction management and inspection to oversee the contractor's operations through all phases of the project working diligently to minimize disturbance to local businesses and residents. HR Green will accomplish this first through a constructability analysis of the contract documents before the project is bid to minimize the chance for major issues arising during construction. The sequence of construction of the improvements will be reviewed to insure it aligns with the traffic control proposed with minimal impacts to private property owners. Parking and access impacts for businesses will also be reviewed to insure as little disruption to operations as possible. Finally, efficiency of the construction sequencing will be reviewed to keep the project on its overall schedule. Roundabouts and Construction Phasing The key design features of this project are five roundabouts at the following locations: 1. Calle Tampico at Desert Club Drive 2. Calle Tampico at Avenida Bermudas 3. Calle Tampico at Eisenhower Drive 4. Eisenhower Drive at Avenida Montezuma 5. Calle Sinaloa/Avenue 52 at Avenida Bermudas Four of the five intersections will require decommissioning the existing traffic signal and salvaging the useable signal equipment prior to installing the roundabout. This will require close coordination between the contractor and the City's traffic signal technicians to insure driver safety during the decommissioning process. HR Green's construction - r - manager will facilitate this as well as the construction traffic control plans in the interim until roundabout construction is complete. Emergency responders must be kept closely in the loop, particularly Fire since the roundabout construction will have a HRGreen Construction Management and Inspection Services, La Quinta Village Complete Streets Page 117 greater impact to larger turning radius vehicles as the center medians are under construction. Fire Station #32 could be particularly affected by the construction of the roundabout at Avenida Bermudas/Avenue 52 since this could block the primary entrance to the Cove neighborhood. Therefore, HR Green will coordinate the contractor's operations to provide emergency access during construction through this area to the station during Phase 2 of the project. Each of the new roundabouts is intended to provide traffic calming and other benefits for pedestrians, golf carts, bicycles and NEV's however each will have critical construction aspects as described below: Phase 1 - Calle Tampico at Desert Club Drive and Avenida Bermudas Roundabouts — June 2019 to January 2019 These two roundabouts are intended to provide a new look and grander entrance to The Village via Calle Tampico from Washington Street by requiring drivers to slow as they proceed from east to west removing vehicle lanes and emphasizing bicycles and pedestrian facilities. Mid -block crossings at the La Quinta Library, Embassy Suites Hotel and Benjamin Franklin Elementary School will help connect the residential neighborhoods, hotel guests and students to the library, Old Town and elementary school respectively. By narrowing Calle Tampico to a lane in each direction pedestrians will be able to safely cross without additional intersection control at these locations. The landscape plans at all three locations will be reviewed by HR Green to insure sight lines are kept when the improvements are installed as well as when the plants reach maturity. These improvements will be constructed during the summer and fall months which will serve to reduce school traffic volumes provided the contractor starts at the west end of this phase. HR Green will work with the contractor to ensure the street improvements and westerly pedestrian cross walk are constructed while the elementary school is on summer break. The contractor should then proceed east to construct the improvements between Desert Club Drive and Avenida Bermudas to reduce impacts as much as possible to the hotel, restaurant and businesses on the north side of the street and the Old Town restaurants and retailers on the south side as each side of the Calle Tampico is under construction. This will require constant communication between HR Green's construction manager and the City's contractor as to what access will be restricted and relaying that to the affected businesses. The contractor's changeable message signs (CMS) must communicate lane closures 48 hours in advance of any changes to traffic patterns. Emergency services must also be alerted to any changes in emergency access a minimum of 48 hours (preferably 72 hours) in advance. The bio swale, storm drain and landscape construction in this phase are critical as Calle Tampico historically has been particularly susceptible to flooding anytime it rains. HR Green will confirm infiltration rates, and new catch basin locations before the swales are constructed to insure maximum drainage effectiveness of these areas. While the street is open HR Green will also check the existing storm drains and dry wells the City has constructed over the years to confirm their functionality and recommend any changes to enhance drainage capacity. Challenges may occur due to the number of marked and unmarked utilities that exist in Calle Tampico as well as CVWD's new irrigation line running on the north side of the street. As part of as building the improvements HR Green will confirm marked utilities in Calle Tampico and have all unmarked utilities recorded for future reference. Finally, HR Green will review remediation measures for any subsidence problems that have historically occurred in this street before the final street section is constructed. Construction Management and Inspection Services, La Quinta Village Complete Streets HRGreen �- Page 118 Consideration should also be given to the future needs of the businesses and residents for an improved broadband experience in The Village. HR Green is well -qualified to evaluate and propose locations for dedicated conduits within the right-of-way for a future backbone fiber optic system that will support 5G broadband to the community. This evaluation will be done at no extra cost as part of the constructability review of the construction documents as it is included in our proposal. HR Green can provide an additional proposal to provide a fiber master plan for Community 5G Wi-Fi in The Village or larger geographic area as desired by the City. Phase 2 — Calle Sinaloa/Avenue 52 — January 2020 to May 2020 Heavy directional traffic flows make this intersection difficult to retrofit to a roundabout at any time of the year. HR Green will work with the City's contractor to clearly label detour routes in and out of the La Quinta Cove neighborhood using Eisenhower Drive while this intersection is under construction. The proposed dedicated north bound right turn should be established as soon as possible to ease traffic flows exiting the Cove neighborhood for the morning commute. The signal timing at Eisenhower Drive and Washington Street should be adjusted to provide a longer eastbound to northbound left turn phase to accommodate the additional drivers that will likely use Eisenhower Drive to exit the Cove on weekday mornings. These improvements particularly affect the property on the south west corner of the intersection. HR Green will work closely with the homeowner (Dixon) and the contractor to insure disruption is minimized and that access to the homeowner's driveway off of Avenue 52 is reestablished as soon as possible after demolition of the existing improvements occurs. Of particular concern with its proximity to the roundabout will be the ability for the homeowner to turn around in the newly configured driveway before turning onto the street. HR Green will work with the contractor to install these improvements as early as possible to facilitate safe ingress and egress for the homeowner. Due to the high approach speeds and the reverse curve just before this intersection it will be particularly critical to have as much advance warning for westbound traffic approaching this intersection. The same is true for northbound traffic including bicyclists approaching the intersection coming down grade out of the Cove. HR Green will work closely with the contractor to insure as much advance warning including CMS's are provided to safely negotiate the construction zone. Phase 3 — Eisenhower Drive at Avenida Montezuma and Calle Tampico — May 2020 to October 2020 Lined by homes on both sides of the street this phase will require the greatest coordination with the public. The five way roundabout at Avenida Montezuma will be particularly challenging since it directly impacts five homeowners on the southwest and northwest corners as well as all of the homeowners to west of Eisenhower Drive who normally use Avenida Montezuma to Eisenhower Drive for their morning and evening commutes. HR Green will work closely with a contractor to keep this neighborhood informed of changing detour plans to get drivers out of the lower Cove neighborhood onto Calle Sinaloa and Avenue 52 while this roundabout is constructed. HR Green will also work closely with Sunline for bus service, the post office for mail delivery and Burrtec for trash pickup. Fortunately access to the animal clinic on the northeast corner of the intersection will not be severely impacted as the driveways off of Avenida Montezuma and Avenida Martinez will not be altered by the street improvements. With the close proximity of the community park and school pedestrian access will also be critical as the improvements are made to this intersection. Further to the north on Eisenhower Drive the roundabout adjacent to Benjamin Franklin Elementary School at Calle Tampico and Eisenhower Drive should be constructed in the summer of 2020 to minimize impacts to the school's operations and traffic flow at the intersection. HR Green will also work with the City's contractor to schedule the improvements to reduce impacts to the adjacent business office complex and Bear Creek Trail located on the west side of the intersection. ® Construction Management and Inspection Services, La Quinta Village Complete Streets HRGreen. p a g e 119 As with the other phases of the project on Calle Tampico the contractor will have to play close attention to marked and unmarked utilities in this street including the abandoned section to the west of the intersection which is now the parking lot of the office complex. CVWD's irrigation line project also terminates at this intersection which will require the contractor to avoid with the street improvements as well. Finally, even though the improvements stay within the existing right-of-way north of Calle Tampico it will be important to keep the La Quinta Resort up to date as to the construction schedule for these improvements. Many of their patrons use the Bear Creek Trail or access The Village via golf cart or car and therefore will need to be aware of detours or alternate routes to avoid the intersection while it's under construction. Communication with the homeowners along Eisenhower Drive also cannot be overemphasized. Trash and mail pick up can be severely compromised without clear communication with Burrtec and the local post office respectively. HR Green will coordinate the contractor's operations to insure homeowner's and service providers are able to access individual properties throughout the construction process to minimize complaints and traffic congestion. Key Issues and Solutions As stated earlier, the HR Green team/staff has legacy project knowledge and experience, dating back to the concept, planning, funding, and design stages, as well as a deep appreciation of the City's goals and expectations for successful project delivery. CITY OFFICERS AND EMPLOYEES: NONDISCRIMINATION. 9.1 Non -liability of City Officers and Employees. No officer, official, employee, agent, representative, or volunteer of City shall be personally liable to Contracting Party, or any successor in interest, in the event or any default or breach by City or for any amount which may become due to Contracting Party or to its successor, or for breach of any obligation of the terms of this Agreement. 9.2 Conflict of Interest. Contracting Party covenants that neither it, nor any officer or principal of it, has or shall acquire any interest, directly or indirectly, which would conflict in any manner with the interests of City or which would in any way hinder Contracting Party's performance of the Services under this Agreement. Contracting Party further covenants that in the performance of this Agreement, no person having any such interest shall be employed by it as an officer, employee, agent, or subcontractor without the express written consent of the Contract Officer, or assigned designee. Contracting Party agrees to at all times avoid conflicts of interest c1--I0.L appearance of any conflicts of interest with the interests of City in the performance of this Agreement. During the term of this Agreement, the Contracting Party shall disclose any financial, business, or other relationship with City that may have an impact upon the outcome of this Agreement or any ensuing City construction project. The Contracting Party shall also list current clients who may have a financial interest in the outcome of this Agreement or any ensuing City construction project which will follow. In accordance with the provisions of Labor Code Sections 1810 et seq., eight (8) hours is the legal working day. Contracting Party also shall comply with State law requirements to maintain payroll records and shall provide for certified records and inspection of records as required by California Labor Code Section 1770 et seq., including Section 1776. In addition to the other indemnities provided under this Agreement, Contracting Party shall c , indemnify, and hold City, its elected officials, officers, employees, and -agents free and harmless from any c-fx i -eF liability arising out of any failure or alleged failure to comply with the Prevailing Wage Laws. Contracting Party shall carry automobile liability insurance of $1,000,000 per accident against all claims for injuries against persons or damages to property arising out of the use of any automobile by Contracting Party, its officers, any person directly or indirectly employed by Contracting Party, any subcontractor or agent, or anyone for whose acts any of them may be liable, arising directly or indirectly out of or related to Contracting Party's performance under this Agreement. If Contracting Party or Contracting Party's employees will use personal autos in any way on this project, Contracting Party shall provide evidence of personal auto liability coverage for each such person. The term "automobile" includes, but is not limited to, a land motor vehicle, trailer or semi -trailer designed for travel on public roads. The automobile insurance policy shall contain a severability of interest clause providing that coverage shall be primary for losses arising out of Contracting Party's performance hereunder and neither City nor its insurers shall be required to contribute to such loss. Professional Liability or Errors and Omissions Insurance as appropriate shall be written on a policy form coverage specifically designed to protect against acts, errors or omissions of the Contracting Party and "Covered Professional Services" as designated In the policy must specifically include work performed under this agreement. The policy limit shall be no less than $1,000,000 per claim and in the aggregate. Note Our policy does not contain a duty to defend a Client Contracting Party shall carry Workers' Compensation Insurance in accordance with State Worker's Compensation laws with employer's liability limits no less than $1,000,000 per accident or disease. Contracting Party shall procure and maintain Cyber Liability insurance with limits of $1,000,000 per occurrence/loss which shall include the following coverage: a. Liability arising from the theft, dissemination and/or use of confidential or personally identifiable information; including credit monitoring and regulatory fines arising from such theft, dissemination or use of the confidential information. b. Network security liability arising from the unauthorized use of, access to, or tampering with computer systems. If coverage is maintained on a claims -made basis, Contracting Party shall maintain such coverage for an additional period of three (3) years following termination of the contract. Contracting Party shall provide written notice to City within ten (10) working days if: (1) any of the required insurance policies is terminated; (2) the limits of any of the required polices are reduced; or (3) the deductible or self -insured retention is increased. In the event any of said policies of insurance are cancelled, Contracting Party shall, prior to the cancellation date, submit new evidence of insurance in conformance with this Exhibit to the Contract Officer. The procuring of such insurance or the delivery of policies or certificates evidencing the same shall not be construed as a limitation of Contracting Party's obligation to indemnify City, its officers, employees, contractors, subcontractors, or agents. E.2 Remedies.
