WHEREAS, the Seller is the current owner of the property located at the address specified above
(the "Property"); and
WHEREAS, the Buyer has agreed to purchase the Property from the Seller; and
WHEREAS, the Buyer acknowledges that they have been informed of the existing building and
safety violations on the Property as identified by the City of La Quinta (the "City"); and
WHEREAS, the City of La Quinta has indicated that it will address these building and safety
violations directly with the Buyer as the new owner of the Property.
NOW, THEREFORE, the Parties agree as follows:
1. Acknowledgment of Violations:
The Buyer hereby acknowledges that they have been informed of the current building and safety
violation, consisting of missing Home Energy Rating System (HERS) Certification on the Property,
as identified by the City of La Quinta Building Department. The Buyer agrees to assume
responsibility for addressing these violations in accordance with the City's requirements.
2. City of La Quinta's Role:
The Buyer understands that the City of La Quinta will directly communicate with and guide the
Buyer regarding the steps required to remedy the building and safety violations.
3. Release of Liability:
The Buyer releases the Seller from any further liability or responsibility for the building and safety
violations after the closing of the sale. All obligations related to these violations shall transfer to the
Buyer upon the completion of the sale.
4. Notarization:
This Acknowledgment shall be notarized and signed by both parties and shall be recorded as part
of the closing documents for the sale of the Property.
