Executive Summary Serving more than 65 local governments (of which 22 are in California) with short-term rental compliance monitoring and enforcement solutions, Host Compliance has developed a deep understanding of what works and what doesn't when it comes to enforcing short-term rental regulation and making it easy for affected neighbors to report and document ordinance violations. This deep expertise, experience and our data -driven approach allows Host Compliance to help the City of La Quinta quickly implement a proven, cost effective and comprehensive short-term rental compliance monitorinq and enforcement program. In order to provide as much choice for La Quinta as possible, Host Compliance will present two different versions of the software and services offerings with the hope that this will enable the city to find an optimal solution to its needs and budget constraints: 1. The Standard Host Compliance Solution is optimized for cost and includes all the features available from other vendors of short-term rental compliance monitoring and enforcement services. That said, the Standard Host Compliance Solution is offered in the form of an integrated cloud -based software -as -a -services solution. This stands in contrast to the competition's offerings which we have heard described as a patchwork of unproven and error -prone manual processes. 2. The Advanced Host Compliance Solution is even more sophisticated and is designed to surpass all alternative solutions in the marketplace in terms of features and performance. While slightly more costly, this solution provides additional value in terms of revenue enhancement capabilities and labor cost savings over and above the benefits achieved by deploying any other short-term rental compliance monitoring solution available in the marketplace. As a software, data and service provider exclusively focused on helping local governments overcome the compliance challenges associated with short-term vacation rentals, Host Compliance is in possession of the proprietary software tools, experience and know-how to advise La Quinta on the best practices for effectively regulating and enforcing short-term rentals and quickly identify, track and bring La Quinta currently non -compliant vacation rentals into compliance. While Host Compliance's proposed solution is primarily delivered in the form of a software -as - a -service offering, the on -going project management and relationship management work will be led by three of North America's leading authorities on the topic of short-term rental regulation, compliance monitoring and enforcement: Ulrik Binzer — Overall Project Management and Leadership Ulrik is the Founder and CEO of Host Compliance, the industry leader in short-term rental monitoring and compliance solutions for local governments. A pioneer in the short-term rental enforcement solution space, Ulrik developed the first short-term rental compliance monitoring tools and now uses his expertise and insights to help local governments across North America implement, monitor and enforce short-term rental regulation. Ulrik frequently speaks on the topic of short-term rentals, and has been featured at a number of conferences including the American Planning Association's National Planning Conference, The University of Minnesota's Symposium on the Sharing Economy and at numerous events organized by the American Planning Association and the California Association of Code Enforcement Officers. Prior to founding Host Compliance, Ulrik served as Chief Operating Officer of Work4 Labs — an 80 person Venture Capital backed technology company with offices in Silicon Valley and Europe, and Soligent Distribution LLC - the largest distributor of solar equipment to local governments and businesses in the Americas. David's most recent experience was at DwellAware where he served as the Lead Data Scientist, developing models of risks and costs in the residential real estate sector. Goodman — Policy analysis and development Jeffrey is an urban planner and considered one of the nation's leading authorities on short-term rentals and how they impact communities. He has worked with Host Compliance since early 2016. Jeff has previously contracted with the Cities of Vancouver, BC; Pasadena, CA; West Hollywood, CA; New Orleans, Los Angeles, CA and Airbnb, and advised researchers on short- term rentals in range of other cities including San Francisco, Portland, and New York. Jeff has spoken about short-term rentals across North America, including at the APA's National Planning Conference. He graduated from Yale College and earned his Masters of Urban Planning from Harvard University. He is the author of a recent featured article in Planning Magazine on the topic of vacation rental regulation. As provider of scalable yet customizable software -as -a -service offerings, the way we plan to meet the requirements outlined in the RFP is through deployment of either our Standard or Advanced integrated cloud -based software -as -a -services solution. Having these tools and data sources, will allow staff to reallocate thousands of hours of low value added "desk detective" and administrative work to activities that deliver much higher value to the city's residents. It has been our experience that this software -as -a -service centric service delivery approach is very effective and leads to an optimal division of labor and a strong sense of partnership between Host Compliance and its clients. Host Compliance's solutions are build in-house and all data pertinent to our services are delivered through an integrated web interface. That said, we have partnered with leading call center and data center vendors to assure a high level of quality. For call center services we are working with AnswerConnect Teleservices, Inc out of Potland, OR. For data center and related services we are using Amazon Web Services which is the industry's leading provider of such services. Using our customizable software -as -a -service centric approach will allow us to meet the vast majority of the requirements listed in the RFP. That said, there are a small list of the city's very local and specialized requirements that will require some manual involvement from City staff. Specifically: Our software does not currently have direct data connections with the City of La Quinta's TRAkiT and GoRequest systems. That said all of the data in our system can be easily exported (by each user) into Microsoft Excel format. Likewise, we would be happy to facilitate the loading of any relevant third -party system records into our systems whenever requested by the City (the City would just need to provide such data to us in Microsoft Excel or CSV file format). Our software solutions would contain sortable records of all currently and previously active short-term rental listings in the City's jurisdiction. This would include both properties that have already been contacted by us, and properties that have yet to be contacted. The listings can obviously be sorted and filtered to show only the properties that the City's staff would have an interest in reviewing and/or pursuing. Our telephone hotline service is partially "human powered" and partially automated through an Interactive Voice Response (IVR) system. This allows us to offer a number of very powerful evidence collection and call back services while improving data quality and reporting In addition, there are a few of the requirements listed in the RFP that may not be technically possible for any short-term rental compliance solution provider to meet given factors outside of such vendors control. Specifically: ® None of the major short-term rental platforms (Airbnb, HomeAway, VRBO and FlipKey) currently publish phone numbers or email addresses on their short-term rental listings. City of La Quinta — Short Term Vacation Rental Compliance Solutions HOST COMPLIANCE Some owners of properties identified as unregistered properties may not have a valid mailing address registered with the county or respond to letters. Since this is out of any short-term rental compliance solution provider's control, we would therefore argue that it will be impossible for any such vendor to guarantee 90% to 95% registration, business license, permit and TOT compliance among such property owners. Some home owners may engage in double book-keeping and other fraudulent practices in order try to get away with paying a lower amount of TOT than they really should. While we would do our best to identify such fraud, we will not be able to guarantee that we will be able to get everyone to report and remit 90%-95% of the TOT that they owe. D. Scope of Work Program D.1. STR Property & Address Identification Host Compliance has developed a set of proprietary technologies, methodologies and processes to quickly and cost-effectively monitor specific geographies for vacation rental listings. These sophisticated software tools and algorithms are deployed continuously across the 21 largest vacation rental websites ensuring that our database of rental properties is always comprehensive and fully up-to-date. As of the time of writing, Host Compliance monitors 21 short-term rental websites on a weekly/monthly basis (the monitoring frequency depends on whether La Quinta subscribes to Host Compliance's solution). In addition Host Compliance is in the final stages of development of additional monitoring algorithm which will expand the list of websites monitored as part of the Advanced Host Compliance Solution to 50+. These new monitoring capabilities will be launched no later than July 15, 2017. In combination, we believe the listings on these websites represent —99% of the total universe of vacation rentals in La Quinta. Once Host Compliance has identified all active short-term rental listings within La Quinta's jurisdiction, the next step is to identify the exact parcel number,_situs address, owner name, owner address and other pertinent information in our secure cloud -based database. The identification of parcel numbers is critically important at this stage, as it makes it easy to match the identified addresses with the city's permit and business license databases and database of self -reported TOT. The address, parcel number and owner identification is done by utilizing a combination of proprietary data sources, geospatial algorithms and our more than 100 trained address identification analysts. Please note that this online data portal will continue to be updated on a weekly basis over the contact term. In addition to providing the addresses of all identifiable properties in the City, Host Compliance will also -provide the City with the rationale for why any -given listing is matched to the identified address. Having the rationale for the address match is critical in the event that there is ever a dispute with a homeowner over whether or not his/her property was listed for short- term rent at a given time Given the importance of hard irrefutable evidence, we also automatically capture full -screen high -definition screenshots of all active listings on a weekly/monthly basis and attach these screenshots to each property's "file" in the database. The screenshots are captured on a random time and day during the week in order to eliminate the risk of non -compliant short-term rental operators "gaming the system" by making their listings temporarily inactive during regular business hours. Please see Fig. 1 on page 22 for examples. D.2. Data Management and Consolidation of STR Records Features included with both the Standard Host Compliance Solution and the Advanced Host Compliance Solution In addition to always providing the City with a complete and up-to-date database of all active short term rental listings in City of La Quinta's jurisdiction, Host Compliance has a number of other important data management capabilities that are included in both of our proposed solutions: Host Compliance de -duplicates the data in order to easily identify properties that are cross -listed on multiple websites Host Compliance analyzes and segment short-term rental listings by all relevant dimensions including neighborhood (as defined by SHAPE files), usage type and property type. Data Management features included with the Standard Host Compliance Solution The online data portal included with the Standard Host Compliance Solution are updated in real time and accessible on a password protected website 24/7/365. That said, similarly to comparable system available in the market, these read-only dashboards will not allow City of La Quinta's personnel to update and edit records. Figures 2, 3 and 4 on page 23 and 24 shows some examples of the dashboards and reports that would be included with the Standard Host Compliance Solution. STR Compliance Monitoring, Notification, and Reporting STR Compliance Monitoring, Notification, and Reporting features included with both the Standard and Advanced Host Compliance Solutions As soon as the addresses of new short-term rental properties have been identified (which will happen both at the onset of the project and continuously as new short-term rentals are listed on the various websites and identified by o11r software and personnel) we will constantly cross- reference the database of identified short-term rental properties, with City of La Quinta's permit database and database of properties registered for tax purposes and initiate a series of outreach initiatives intended to bring non -compliant properties into compliance with City of La Quinta's short-term rental regulations. In the event, the owner does not comply with the rules within 30 days of receiving the "initial warning" Iett&, we will follow-up with a more sternly worded letter. In the event that an owner does not comply with the rules after receiving the 2nd letter we will refer the case to the City of La Quinta's Code Enforcement team for follow-up. City of La Quinta's follow-up will be greatly aided by our data, screenshots etc. which is available to City of La Quinta's personnel through the previously described online data portal. All information is available 24/7 online on desktop and mobile devices and can be download in jpg, png, pdf, excel or other standard file formats if desired. Please note that all form letters used by Host Compliance will be developed in close cooperation with City of La Quinta and that the final versions will be subject to the City of La Quinta's final approval. Included with the Standard Host Compliance Solution comes standard 1-page color letters that can be customized to the City's specifications. Figures 11 through 13 on page 28 shows some examples of the different types of letters included with the Standard Host Compliance solution. As with everything else we do, Host Compliance is committed to full transparency and accountability and as a result we save each and every letter we send on our client's behalf in our database. As a result all of the letters we send can be assessed in pdf format in full resolution and each letter is timestamped to show when it was sent and delivered. In addition to these highly targeted letter campaigns, our communication plan will also include a set of broader communication initiatives timed to coincide with the launch of City of La Quinta's short-term rental tax compliance initiative. This initial communication campaign will be targeted to the specific needs and preferences of City of La Quinta and we would recommend that it includes at least 1 press release and certain relevant website content additions meant to further educate short-term rental hosts and the general public about the scale, scope and reasoning behind City of La Quinta's short-term rental compliance initiative. Given Host Compliance's expertise, we will be able to initiate the above communication programs within a 30 days of contract execution. Pro -active Permit Compliance Monitoring In addition to the more sophisticated mailing features, the Advanced Host Compliance Solution also includes our sophisticated Pro -active Permit Compliance Monitoring module that provides ongoing monitoring of compliance with the City requirement to list an active permit number on all advertisements. This features saves hundreds of hours of manual labor and allows City of La Quinta's personnel to always have an up-to-date list of STRs operating without displaying the proper permits on their online advertisements. STR Rental Activity Monitoring and Tax Collection STR Rental Activity Monitoring and Tax Collection Assistance features included with both the Standard and Advanced Host Compliance Solutions In addition to monitoring permit compliance, both the Standard and Advanced Host Compliance Solutions provide the ability to provide ongoing monitoring of La Quinta's short-term rental properties for signs of rental activity. In addition, the Advanced Host Compliance Solution includes integrated online payment forms which makes it far easier for hosts to calculate and pay their taxes, while making the reconciliation of payments smooth and easy for City of La Quinta's staff. In combination, these features will allow City of La Quinta to dramatically improve its ability to identify tax fraud and collect taxes while reducing errors and the labor costs associated with cross referencing data across systems. Below, please find more information on these advanced STR Rental Activity Monitoring and Tax Collection Assistance features. Advanced Tax Fraud Detection Algorithms The Advanced Host Compliance Solution includes Host Compliance's newest and most advanced rental activity and revenue estimation algorithms. These algorithms have a far better ability to identify tax under -reporting than more basic models that simply estimate rental activity based on review counts and other "obvious" variables. In total, these model improves the probability of detecting tax fraud by more than 300% over traditional methods, while keeping type-1 errors ("false positives") at approximately the same levels as the ones achieved using less sophisticated models. As a result, the expected returns on City of La Quinta's tax compliance efforts will be significantly higher if these algorithms are deployed. Advanced Tax Collection Letters The Advanced Host Compliance Solution allows City of La Quinta to send more advanced tax collection letters than what is possible using the Standard Host Compliance Solution. Specifically, the Advanced Host Compliance Solution allows City of La Quinta to automatically send tax collection letters that include features such as high -resolution color screenshots and pre -filled tax remittance forms to people suspected of under -reporting or failing to report taxes. In combination, these features dramatically increase the probability of collecting the taxes that are due. Said simply, when a host that has failed to pay his/her taxes receives a letter with a screenshot of his/her listing(s) and a pre -filled tax form, the chance of him/her paying the tax bill goes up dramatically. Figures 17-19 on page 30 shows examples of what such a tax collection letter could look like: Integrated Online Tax Calculation and Payment Forms Included with the Advanced Host Compliance Solution comes optional integrated tax calculation and remittance forms that makes it easy for short-term rental hosts to calculate and remit taxes to City of La Quinta. By reducing the friction in the tax reporting and remittance process, City of La Quinta vastly improves the probability of being paid on time, while reducing the need for time -intensive and costly paperwork and cross -system data reconciliation. Figure 20 on page 31 shows an example of what such, a tax calculation and remittance form could look like. Please note the integrated credit/debit card payment functionality as well as the ability to collect electronic signatures. All payments are processed through a 31d party payment processor called Stripe. Stripe has been audited by a PCI-certified auditor and is certified to PCI Service Provider Level 1. This is the most stringent level of certification available in the payments industry. To accomplish this, Stripe makes use of best -in -class security tools and practices to maintain a high level of security. All card numbers are encrypted on disk with AES-256. Decryption keys are stored on separate machines. None of Stripe's internal servers and daemons are able to obtain plaintext card numbers; instead, they can just request that cards be sent to a service provider on a static whitelist. Specifically, Host Compliance's semi -automated short-term rental hotline technology would allow City of La Quinta to provide 24/7/365 service while eliminating or minimizing the need to invest in 24/7 on -the -ground code enforcement resources. The core of Host Compliance's hotline solution is a sophisticated call center platform that allows neighbors to easily report noise, parking, trash and other short-term rental related issues 24/7/365. The call flow can be customized to City of La Quinta's exact needs but our recommended call flow is illustrated on the chart shown 2 pages from this. The call flow is partially automated in order to ensure 100% consistency and make the service cost-effective. As shown on the call flow diagram shown on Figure 21 on page 32, our solution contains several innovative features worth describing in more detail: 1.
