The following determination was made: Per La Quinta Municipal Code (Code) Section 9.60.340 (D), flagpoles that were installed in locations other than front yards of residences are allowed to remain in place as long as they meet the height requirement of 20 feet and obtain a building permit. The flagpole at this address was installed prior to February 14, 2019, per documentation submitted by the applicant, which includes a date stamped photograph and invoice for the flagpole installation. The flagpole is not to exceed 20 feet in height, to comply with the height requirement of the Code. Bojic July 17, 2019 Page 2 Definition: A flag pole, defined by Merriam -Webster, is: a pole on which to raise a flag. The CBC, on the other hand, does not define a flagpole, nor does it state whether it is a regulated structure with a specific occupancy classification. Therefore, in absence of a clear definition or other acknowledgement from the CBC, the Building Division determines that a flagpole may be one or more pole, column, post, staff, or similar structure, supported solely by being inserted into the ground or footing, erected for the purpose of displaying one or more banners or flags. There may be many variations and shapes included within this general definition and each proposal should be looked at individually to determine if the structure fits the definition. Since flagpoles can be very tall structures, it is this Building Official's opinion that, in the interest of public safety, a permit shall be required in order to insure these structures are being installed in a manner that is consistent with minimum CBC structural requirements to resist wind, seismic and gravity loads. In addition, flagpoles have been determined to be regulated structures and most nearly fit the Group U occupancy classification. Other documents, sources, and materials were consulted and reviewed in connection with the application referenced above. The Carroll Property is directly behind that property owned by Francis and Marie Johnston and located at 79125 Coyote Creek, La Quinta, California 92253 ("Johnston Property"). There is a very large unpermitted Ship Mast located in the backyard of the Johnston Property which the Carrolls must view every day from every room facing the backyard of the Carroll Property. Pictures of the same are attached herein below for your convenience. On October 2, 2018, the City of La Quinta City Council and Planning Commission had a joint meeting. At the time, the only city ordinance governing flagpoles was a requirement that they be attached to the house. At the October 2, 2018 joint meeting, the Planning Commission submitted a Pr()osed Amendment as follows: 9.60.340 Flagpoles A, Flagpoles shall be allowed in all residential zoning districts subject to the following standards: 1. Height of flagpoles shall not exceed 20 feet. 2. Flagpoles are allowed within the front yard only. The minimum front yard setback for flagpoles shall be ten (10) feet. 3. A copy of the Planning Commission Meeting minutes of April 23, 2019 which sets forth the are attached hereto for your convenience. If the Ship Mast Structure had been a flagpole, it would have been approved as a grandfathered flagpole by the City of La Quinta. However, it is not a flagpole and should be classified as a structure. Furthermore, the it has been under protest before the 2019 code amendment proposals and long before it was adopted by the city council on May 7, 2019. The Johnsons' installed this unpermitted Ship Mast in 2018, long before February 14, 2019 and would need a building pen -nit pursuant to Section 9.60.340. This issuance of the Building Permit by the City of La Quinta should be denied based upon the following reasons: 1. The Ship Mast is a 3LIUkA ire aS opposed to a "flagYoie". in fait, the Building Official, James "JW" Wiatrak, labeled it as a "structure" in the February 15 email attached hereto. As such, the amendment does not apply to "structures". This combination of a square rigged spar with yardarms, halyards, ropes, turnbuckles, lights and flags is clearly not a flagpole but some kind of ship mast structure. 2. It is a private and public nuisance. (See attached) 4. Even if it was a flagpole, it was still under protest when Mr. Carroll filed his code complaint with the city in January. Based upon the foregoing, the Carroll's respectfully request that the necessary Building Permits sought by the Johnsons from the City of La Quinta be denied. Furthermore, that the City of La Quinta order the Johnsons to remove or relocate the Ship Mast to the front yard of the Johnson Property. This amendment clarifies the intent of the Council as relayed by staff. BACKGROUND/ANALYSIS Code amendments were adopted by the Council January 15, 2019 to streamline the development review process and clarify development standards. One Code amendment established new development standards for flagpoles in residential districts. These standards limit placement of flagpoles to front yards. During the public hearing, Council asked if flagpoles that currently exist' in locations other than front yards would be "grandfathered-in." Staff indicated that they would, in accordance with the non -conformities section of the Code. Staff proposes language be added to the Code stating that flagpoles that are established in locations other than the front yards prior to the ordinance effective date of February 15, 2019, would need to acquire a building permit if there was none issued previously. Pursuant to Government Code Section 65857, no public hearing before the Planning Commission is required for this clarification language, but the "grandfather in" provisions were not previously presented. Per State law, staff is requesting a recommendation on this discreet issue before returning to the Council for final consideration. ENVIRONMENTAL REVIEW The Design and Development Department has determined that the proposed Code amendment is exempt from environmental review under CEQA, pursuant to Section 15061(b)(3), Review for Exemptions - General Rule, in that it can be seen with certainty that there is no possibility for this action to have a significant effect on the environment, and individual development plans will be reviewed under CEQA as they are proposed.
