Dear Ms. Hardy:
This is to advise you that an error was made in the case number assignment to the
above referenced Minor Use Permit The originally assigned Case #MUP 2003-384,
should in fact be Case #MUP 2003-385. We have changed our records to reflect this,
and suggest you make note of this change. This does not affect the current approval
in any way, other than changing the case reference number as stated. I apologize for
the error and hope it causes no inconvenience in proceedings associated with your
project.
Enclosed with this letter, for your records, is a receipt for payment of fees associated
with the Minor Use Permit.

SUBJECT: MINOR USE PERMIT 2003-384 - TRACT 29323
MODEL COMPLEX FOR PONDEROSA HOMES (MOSAIC AT ESPLANADE)
Dear Ms. Hardy:
The Community Development Department has approved your application to establish
three model homes, to include a sales office and parking area, pursuant to Section
9.60.250 of the Zoning Code. The model homes are approved for TR 29323
(Esplanade), tract lots 339 - 342.
The following findings are applicable to the approval of this minor use permit:
A. The land use proposed is consistent with the General Plan, which designates
the property for Low Density Residential Development.
B. The use as proposed is consistent with the provisions of the Zoning Code, in
that the RL setbacks and other related development standards have been
shown to be in compliance.
C. Processing and approval of this minor use permit is in compliance with the
provisions of the California Environmental Quality Act (CEQA). This proposal
represents a temporary sales office use of an approved residential use, which
ultimately implements TR 29323 as previously certified under CEQA.
D. Approval of this minor use permit will not create conditions materially
detrimental to the public health, safety and general welfare or injurious to or
incompatible with other properties or land uses in the vicinity. All surrounding
properties are or will be developed as Low Density Residential, consistent with
the subject property's ultimate use.
E. The access, parking and circulation as proposed with this minor use permit will
not result in excess traffic congestion or safety hazards.

Enclosed are copies of approved Exhibits A (site plan) and B (landscape plan). In
addition, development of this use is subject to the following conditions:
1. Prior to any landscape installations, provide written approval from the Riverside
County Agricultural Commissioner's office and CVWD for the landscaping and
irrigation, as to acceptability of water conservation measures and plant
materials for the desert climate.
2. 24" box trees shall have a minimum 1'/2 to 2 inch caliper as measured 6' from
grade, and a minimum 10 -foot height. All 15 -gallon trees shall be a minimum
3/4 to 1 inch caliper as measured 6' from grade
3. The parking area shall be completed prior to the model home complex being
used for sales. Wheel stops shall be provided for all parking stalls, and shall
allow for a 2 -foot forward overhang.
4. Install one 2A10BC fire extinguisher inside the front exit door of the sales
office.
5. One 2' x 3' sign shall be placed close to or on the sales office front door,
displaying a 24-hour emergency phone number (minimum 1" high letters)
which emergency personnel may call if problems arise that need prompt
attention. The sign shall include any temporary address, and may include the
company name for the purpose of identification.
6. A $2,000.00 Model Home Deposit shall be filed with the Community
Development Department to ensure conversion of the sales office 'to a
residential garage, removal of trap fencing, parking, and all other associated
remedial actions necessary to convert the model structures and facilities to
permanent residential use. Such conversion of the subject model complex shall
be completed within 90 days of expiration of this minor use permit approval,
unless extended pursuant to Condition 7.
7. The model home/sales office complex use shall be abandoned by January 31,
2004, unless an extension is granted by the Community Development Director
pursuant to Section 9.60.250.F of the Zoning Code.
8. The applicant/developer agrees to indemnify, defend, and hold harmless the
City of La Quinta from any legal claim or litigation arising out of the City's
approval of this project. The City of La Quinta shall have the right to select its
defense counsel at its sole discretion.
9.. By applying for this permit, the applicant acknowledges that the approved map
for Tract 29323 has not yet been recorded. To that end, the applicant

understands and accepts that any construction on these model units is
undertaken on an at -risk basis, and any inconsistency in property line setbacks
due to final delineation of recorded lot lines will be subject to remedy, up to
and including relocation/demolition of these units.
The City may impose additional conditions to this application to mitigate any problems
that arise not previously addressed herein. This decision may be appealed to the
Planning Commission pursuant to Section 9.200.120, provided the application
requirements of said Section are met within 15 days from the date of this letter. If
