(CASC), a California S corporation, was established in 1993 to provide professional civil and environmental engineering, surveying, and related consulting services to government agencies, utility companies, school districts, private developers, and industry groups. RELATED EXPERIENCE CASC has been providing food service, hazardous material facility, and commercial/industrial inspections since 2003 to cities throughout Southern California to meet the varied requirements of the MS4 NPDES permits in the Counties of Riverside, San Diego, Orange, Los Angeles, and San Bernardino. Responsibilities have included tracking and inspecting hundreds of commercial/industrial facilities per city, troubleshooting grease control devices and other BMP failures, facility prioritization, database research, educational material development and distribution, and GIS/photomapping of illicit connection/illegal discharge locations. Depending on city requirements, non- compliance was followed up with progressive enforcement actions in accordance with the city's stormwater ordinance including assisting the city in writing Notices of Non -Compliance and referrals to the Regional Water Quality Control Board as required for compliance with the Industrial General Permit. INSPECTION OF COMMERCIAL, INDUSTRIAL AND FOOD FACILITIES CITY OF PALM SPRINGS CASC is the City's Consultant Storm Water Program Manager responsible for kA management and implementation of the City's storm water program.Commercial, industrial, and food facility inspections are required by the City'sMS4 permit and are being conducted as part of CASC's storm water programmanagement responsibilities. �` With over 375 facilities subject to the MS4 permit's inspection requirements, CASC developed a ArcGIS database to organize, prioritize, and track the , inspection program. CASC also created an electronic inspection report to allowV- Inspectors to document inspection results, obtain the signature of the facility representative, and immediately email the completed inspection report to the site representative and archive the report for long-term storage. Inspectors contact the site representative upon arrival for an inspection, and then commence the inspection process. The Inspector walks the site, both inside and outside, making observations related to compliance with the City's pollution prevention requirements. Because many site representatives elect to accompany the Inspector during the site walk, the site walks become an important opportunity to provide operator education and outreach. CA,$C CITY OF LA QUINTA ON -CALL STORMWATER COMPLIANCE INSPECTION SERVICES rugineering and N Nit11.ing Most sites in Palm Springs are in compliance with MS4 program requirements, which is no surprise given the high - end resort status of the community. However, a few problem sites have been identified, with problems arising primarily from aged facilities, but also from operators that are unaware of requirements. In these situations, CASC documents the issues of concern directly on the inspection forms, and verbally explains the issues and potential pathways to compliance with the site representative to determine a plan to bring the facility into compliance. Follow-up inspections are conducted to verify that corrective actions have been implemented. When the follow- up inspection indicates that corrective actions have not been successful in eliminating violations, enforcement is escalated and a Notice -of -Correction is issued providing the owner or operator a specific compliance date along with involving Code Enforcement as needed. ® Contact Name: Rick Minjares a Contract Dates: 2016-Present Contact Phone Number: (760) 323-8523 x8741 INSPECTION OF INDUSTRIAL AND COMMERCIAL FACILITIES CITY OF TEMECULA, CA CASC provides industrial and commercial inspections for the City in accordance with their Municipal Separate Storm Sewer System (MS4) permit and their storm water ordinance. Inspections include observing best management practices at facilities used for protecting storm water runoff and verifying that facilities that require coverage under the Industrial General Permit have the required WDID and SWPPP on site. For high priority inspections, generally industrial and selected commercial facilities, the inspector uses EnerGov software in the field to schedule and document facility inspections. These inspections are conducted on a per facility basis. For medium and low priority inspections, the inspector conducts drive -by reviews. CASC uses Collector for ArcGIS, a web -based mapping interface, as an organizational and scheduling tool. Collector for ArcGIS allows CASC inspectors to view which facilities have been inspected, need to be inspected, and require follow-up. For the commercial/industrial inspections, CASC works closely with the City's NPDES coordinator to identify commercial and industrial businesses within the City's jurisdiction that meet inspection criteria per the Riverside County Phase I MS4 Permit Santa Ana Region, and Drainage Area Management Plan. Inspectors visit each site and document the status of best management practices in place to minimize pollutant discharges to the drainage system. CASC assembled a team to develop a GIS-based interactive inspection program that is used by inspectors and City staff. The interactive program has also been designed to be compatible with the City's database system. Inspectors visited each site and documented the status of best management practices in place to minimize pollutant discharges to the drainage system. CASC performed water quality inspections of targeted facilities within the City at frequencies established by the Riverside County MS4 Permit for the Whitewater River Basin. CASC's responsibilities included reviewing the facility list from the Riverside County Department of Health (DEH), prioritizing facilities to be inspected, preparing inspection schedules, and providing bi-weekly progress reports to the City. CASC was also responsible for developing an Inspector Procedures Manual for the City's future use, developing coordination procedures with the City's Code Enforcement Division, and training City staff on specific requirements of the MS4 Permit inspection program. La Quinta's inspection program was initiated following the end of the Riverside County Compliance Assistance Program (CAP) which ceased inspections in December 2014. CASC has also provided NPDES training, including commercial/industrial inspections, to municipal Permittee staff for the Riverside County Storm Water Program since 2003. Based on the experience of the team with the requirements of the Riverside County — Whitewater Watershed MS4 Permit, the former Compliance Assistance Program, and our knowledge of the Industrial General Permit, CASC has prepared the following project approach to meet the inspection needs for the City of La Quinta. KICKOFF MEETING CASC will schedule an inspection kickoff meeting between the Project Manager and the City's NPDES Coordinator within one week of a notice to proceed to discuss the following items: • List of industrial, commercial, and restaurant facilities and their priorities from the City database. • City of La Quinta's Stormwater Ordinance and Enforcement Procedures. • Contact List and Coordination Procedures between City staff and CASC. • Educational Materials coordination (provided by the City). • Letter from the City regarding inspections (to be provided to facilities at start of inspection). ■ Review of the city map displaying facilities in zones for efficient inspections. • Confirmation of project schedule including start date for inspections. • Dates for progress reports to the City. • CASC will prepare a brief summary of the meeting to document decisions made and action items. INSPECTION SCHEDULE CASC will prepare a schedule of inspections based on the facilities list from the City database. • The Project Manager will obtain an electronic copy of the facilities list from the City, review the facilities list, and set up a schedule based on the MS4 Permit frequency of targeted commercial facility inspections and targeted industrial facility compliance inspections, accounting for facilities that may have had required inspections already completed. The schedule will layout the plan for dividing the required inspections over the 3-year contract, focusing on requirements to promote Permit compliance. • Update the city map displaying facilities in zones for efficient inspections • Food preparation facilities that have not been inspected at least once during the current permit term (June 20, 2013 through June 19, 2018) will be scheduled for inspection. Priority consideration will also be given to facilities requiring reinspection. • Hazardous waste/hazardous materials facilities that have not been inspected at least twice during the current permit term (June 20, 2013 through June 19, 2018) will be scheduled for inspections. • Consideration will also be given to facilities requiring reinspection. PERFORM INSPECTIONS CASC will conduct inspections at food facilities and hazardous materials facilities in accordance with the Whitewater River Region MS4 Permit requirements and complete the inspections at the Permit -required frequencies. Our inspectors are familiar with the Whitewater River MS4 Permit and all requirements regarding the inspections of targeted industrial / commercial sources. Our Project Manager, a QISP, and/or the Assistant Project Manager, will be available at all times to discuss issues that may arise, and will confer with the City NPDES 7 CAR$ 4 C CITY OF LA QUINTA ON -CALL STORMWATER COMPLIANCE INSPECTION SERVICES . Tnginnering and Canilting Coordinator periodically to provide an update on the inspection progress and to provide copies of all documentation relating to the facility inspections. The inspectors are trained on the specific requirements of the MS4 permit inspection program and will continue to use the Inspection Procedures Manual prepared specifically for the City. INSPECTIONS Inspections will be performed in the following manner: • Inspections will be scheduled to avoid peak business hours in order to minimize disruptions. • The inspector will perform a pre -inspection file review to become current on facility history, with special focus on previous and current compliance issues. CASC's files include copies of past inspections conducted by CASC inspectors. ■ The inspector will field verify if the businesses are still operating and report observations to the Project Manager and/or Assistant Project Manager. • The Inspector shall dress professionally and in a manner appropriate for the conduct of industrial, commercial and restaurant facility inspections. • Communications during the inspections will be done in a business friendly and non -threatening manner. ■ The inspector will meet with the facility representative, conduct a walk-through of the facility and identify practices that may result in an illicit discharge to the storm drain system. • Non-compliance areas will be noted on the inspection form, and if a follow-up inspection is required, it will be recorded on the inspection form. 0 The inspector will obtain photos off instances of non-compliance. 0 The inspector will then coordinate with the facility representative to coordinate a follow-up inspection. Follow-up inspections may be performed either digitally or in -person depending on the issues of non-compliance observed during the inspection. See Follow-up Inspections section below. 0 Suggestions will be made to the facility representative for alternate methods for bringing the facility into compliance. • The inspection report will be, signed by the inspector and the facility representative and a copy of the form will be provided to the facility representative within 24 hours. ■ Industrial facilities subject to coverage under the Industrial General Stormwater Permit (IGP) will be identified and the inspector will verify the facility operator has a current Waste Discharge Identification Number (WDID) or a current No Exposure Certification (NEC). 0 If the industrial facility has not obtained IGP coverage the inspector will notify the owner or owner's representative and provide information on obtaining coverage. As needed to assist the facility owner's representative, the CASC inspector will distribute business - specific educational materials to the business as part of the facility inspection. NOTIFICATIONS • The inspector will notify the Project Manager of facilities that require a follow-up inspection. • As necessary, coordination with City's Code Enforcement Division will occur when violations are observed to verify corrections are conducted. • The inspector will provide to the City in an electronic format photos off instances of non-compliance. • If immediate threats to the health and safety of the public and the environment are observed, including illicit connections, or illegal discharges, the City will be contacted immediately. • CASC will provide a hard copy of completed inspection forms to the City upon completion of inspection services. CITY OF LA QUINTA C ON -CALL STORMWATER COMPLIANCE INSPECTION SERVICES Engineering and Cow Elting FOLLOW-UP INSPECTIONS (RE -INSPECTIONS) CASC proposes the ability for certain follow-up inspections to be conducted via digital format (i.e. email). For certain food facilities and hazardous materials facilities that are found to contain issues of non-compliance that may be repaired or addressed and then feasibly documented through photographic and other evidence, may demonstrate compliance through an email follow-up inspection. CASC inspectors will work with site owners or representatives to allow an email submittal of compliance documentation that will be reviewed and documented on the inspection form. By providing the option of digital follow-up inspections, certain facilities will be able to demonstrate that noted issues have been brought into compliance without impacting business day activities. Facilities that are to be followed -up digitally will require that the facility owner or representative submit digital documentation (e.g. photos, receipts, etc.) to the inspector via email. Implementation of corrective actions will be documented on the inspection form and will be provided to the facility owner or representative. Not all sites will qualify for a digital follow-up inspection. Sites which the inspector notates as having significant issues of non-compliance, or a facility owner or representative that chooses not to document issues via email, will require follow-up inspections to be conducted onsite at the facility. Field follow-up inspections will require the inspector to visit the site per the schedule agreed upon with the facility owner or representative during the initial inspection. During the follow-up inspection, implementation of corrective actions will be verified and documented on the inspection form. Construction Site Inspections, City of Palm Springs: Mr. Flores has conducted inspections of privately owned and city owned construction site projects to determine compliance with the City of Palm Springs stormwater ordinance. ADDITIONAL INSUREDS a. I. Trade Show Event Lessor 1. With respect to a Named Insured's participation in a trade show event as an exhibitor, presenter or displayer, any person or organization whom the Named Insured is required to include as an additional insured, but only with respect to such person or organization's liability for bodily injury, property damage or personal and advertising injury caused by: a. the Named Insured's acts or omissions; or b. the acts or omissions of those acting on the Named Insured's behalf, in the performance of the Named Insured's ongoing operations at the trade show event premises during the trade show event. 2. ADDITIONAL INSURED - PRIMARY AND NON-CONTRIBUTORY TO ADDITIONAL INSURED'S INSURANCE The Other Insurance Condition in the COMMERCIAL GENERAL LIABILITY CONDITIONS Section is amended to add the following paragraph: If the Named Insured has agreed in writing in a contract or agreement that this insurance is primary and non- contributory relative to an additional insured's own insurance, then this insurance is primary, and the Insurer will not seek contribution from that other insurance. Otherwise, and notwithstanding anything to the contrary elsewhere in this Condition, the insurance provided to such person or organization is excess of any other insurance available to such person or organization. 3.
