It has come to our attention that you are the owner, occupier, or have a legal interest in the
property located at 78002 Lago Drive in the City of La Quinta ("Property"). We have been
informed that there are several ongoing La Quinta Municipal Code ("LQMC") violations on the
Property relating to unpermitted work. Under the LQMC, the owner/occupier of a property is
responsible to ensure that the Property is in compliance with all applicable codes and standards for
a property within the City.
The City has made an exhaustive administrative effort to obtain voluntary compliance from
you including notifying you by way of several notices of violations and citations over a number of
years. However, while you have had more than a reasonable amount of time to remedy the
violation, you have not done so. At this point, the City has turned the case over to our office,
acting in the capacity of City Attorney for the City of La Quinta, to handle this matter.
The Property is in violation of the following sections of the LQMC:
1. The Property is in violation of LQMC § 8.02.010 (incorporating by reference the
California Building Code, including section 105.1 thereof) by conducting building activity without
the benefit of the required permit. There are numerous improvements that have been performed
on the Property without a permit or a permit that has been finaled.
In order to avoid further enforcement action, you are required to contact my office no

Last week I was at your office to address why there was a claim that my permit was not properly closed.
I was shocked to hear this claim after performing all that Burt Hanada requested and him telling me that
he closed this matter. You indicated that due to Burt Hanada passing away, you were acting in his place.
You had met with me before at Burt's office and had knowledge that I was working directly with Burt.
You know that other City personal who acted wrongfully resulting in Thomas Hartung to intercede.
Therafter I was directed to Burt Hanada. Mr. Hartung and Mr.Hanada wanted the conflict resolved with
any hearings or litigation. I agreed to work direct with Mr. Hanada and agreed to relinquish filing any
claim against the city. I fully cooperated with Mr. Hanada and was told that this matter was resolved and
closed.
You recalled the incident with the city personal and you found what I said in Burt's/City/my file. You said
you had no reason to doubt what we discussed yet the Code Enforcement Division had my permit still
outstanding. This is the Cities administrative problem, not ours. You indicated that you wanted to help
close this entire matter and so do we.
I was at your office because the City Attorney asked me to discuss this matter with you. I told you after
this matter with City was resolved, I wanted to get involved with the City as a volunteer. I mentioned to
Burt and you, I was not looking for employment but wanted to volunteer on the Community Service
Committee. Burt said to me that it would also help to get to know city personal. Burt knew that I do a
lot of volunteer work at St. Francis of Assisi Catholic Church and we wanted to build that youth activity
center. I mentioned to you, that the person who handles much of the building issues, is about to
become a Deacon. After his ordination, his employment by the parish will be in conflict with Diocesan
rules. Bishop Barnes will resolve this but I will be involved helping to get this building built on our
parishes campus and wanted a good relationship with the City.
After leaving your office, I mentioned our meeting to other long time parishioners and the observation
was any City Official handling my permit would not let it go unresolved for years. It goes against
common judgment and procedure of any City. I received no notices from the City in years. You have
work for and with Burt Hanada for years; and I don't think you will say Burt Hanada, or a notice from the
City of La Quinta, would not been sent to me, if this was not resolved. You know Mr. Hanada would and
so too would the City.
was very frank and open with you. I even mentioned the one extension I was late on my renewal and
paid the City the fine and had my extension renewed. Burt Hanada �ew this and said he would handle
extensions and or code enforcement in that he was the supervisor and was controlling my permit file. If
Mr. Hanada did not notify Code Enforcement as he stated he would, I will pay the City one Hundred
dollars for an administrative fee for a late extension just to get this matter closed again.
A.J., you have sufficient information in the City file, or in Burt's file to close this matter. I am requesting
that your do so.
If the City wants to default on its agreement with us, and force legal action, we have no choice but to
call all the personal who have been involved, to a hearing, to show, what occurred.

I along with Mr. Gleason were at your office this morning. As we promised
once all revisions and supportive documents were obtained, I would bring
them to you directly. When we were advised you were out of the office, we
left with all documents because there was a couple of items, I wanted to
point out to you.
The HOA compliance letter which set forth my full compliance with rules,
regulations and architechtual guidelines was obtained. This document is
placed into may revised packet. The HOA Board members being out of
town, took me time to locate them and have my property checked and
validated.
As for the issue of a "wet signature on the structural drawings and
calculations that were rejected by the City of La Ouinta; I request Core Civil
and Structural Engineering to contact the city directly. I have attached (#1),
an email response from Robert Style, Chief Operating Officer, dated July
24, 2019. He set forth, California Civil Code, Title 16, Division 5 sections
400- 476. He points out to planning review that section 411, (e) , states,"The
seal shall be capable of leaving a permanent ink representation, a
permanent impression, or a electronically -generated representation the
document. The signature may be applied to the documents electronically."
Also attached, (#2 ), is California Civil Code Section 1633.7,(a) " A record or
a signature may not be denied legal effect or enforceability soley because it
is in electronic form. "
Section 1633.7(b,c,d),are also attached.
I will come into your office next week to get confirmation from you that my
packet is in proper order.
I personally will be hand carrying all documents to my contractor or any
third party to avoid any delay.
My wife has been placed on "Palliative Care", and we have treatments set
by her doctors starting again in September and October, 2019. We have
being trying to obtain everything the City has requested but many items
occured years before we owned the property. All this emotional and

We are providing you with an Owner -Builder knowledgment and Information Verification Form to make you aware of your
responsibilities and possible risk you may incur by having this permit issued in your name as the
Owner -Builder. We will not issue a building permit until you have read, initialed your understanding of each provision,
signed, and returned this form to us at our official address indicated. An agent of the owner cannot execute this notice
unless you, the property owner, obtain the prior approval of the permitting authority.
OWNER'S ACKNOWLEDGMENT AND VERIFICATION OF MORMATION
DIRECTIONS: Read and initial each statement below to sign6 you understand or verb this information.
4LI. I understand a frequent practice of unlicensed persons is to have the property owner obtain an "Owner -Builder"
building permit that erroneously implies that the property owner is providing his or her own labor and material personally. 1, as
an Owner -Builder, may be held liable and subject to serious financial risk for any injuries sustained by an unlicensed person
and his or her employees while working on my property. My homeowner's insurance may not provide coverage for those
injuries. I am willfully acting as an Owner -Builder and am aware of the limits of my insurance coverage for injuries to workers
on my property.
j_2. I understand building permits are not required to be signed by property owners unless, they are responsible for the
construction and are not hiring a licensed Contractor to assume this responsibility.
&j 3. I understand as,an "Owner -Builder" I am the responsible party of record on the permit. I understand that I may protect
myself from potential financial risk by hiring a licensed Contractor and having the permit filed in his or her name instead of my
own.
0 4. I understand Contractors are required by law to be licensed and bonded in California and to list their license numbers on
permits and contracts.
&5. I understand if I employ or otherwise engage any persons, other than California licensed Contractors, and the total value
of my construction is at least five hundred dollars ($500), including labor and materials, I may be considered an "employer"
under state and federal law.
&6. I understand if I am considered an "employer" under state and federal law, I must register with the state and federal
government, withhold payroll taxes, provide workers' compensation disability insurance, and contribute to unemployment
compensation for each "employee." I also understand my failure to abide by these laws may subject me to serious financial
risk.
&_7. I understand under California Contractors' State License Law, an Owner -Builder who builds single-family residential
structures cannot legally build them with the intent to offer them for sale, unless all work is performed by licensed
subcontractors and the number of structures does not exceed four within any calendar year, or all of the work is performed
under contract with a licensed general building Contractor.
KJJ 8. I understand as an Owner -Builder if I sell the property for which this permit is issued, I may be held liable for any
financial or personal injuries sustained by any subsequent owner(s) that result from any latent construction defects in the
workmanship or materials.
V-9. I understand I may obtain more information regarding my obligations as an "employer" from the Internal Revenue
Service, the United States Small Business Administration, the California Department of Benefit Payments, and the California
Division of Industrial Accidents. I also understand I may contact the California Contractors' State License Board (CSLB) at 1-
800-321-CSLB (2752) or www.cslb.ca.gov for more information about licensed contractors.
&10. I am aware of and consent to an Owner -Builder building permit applied for in my name, and understand that I am the
party legally and financially responsible for proposed construction activity at the following address:
M11. I agree that, as the party legally and financially responsible for this proposed construction activity, I will abide by all
applicable laws and requirements that govern Owner -Builders as well as employers.
916 12. I agree to notify the issuer of this form immediately of any additions, deletions, or changes to any of the information I
have provided on this form. Licensed contractors are regulated by laws designed to protect the public. If you contract with
someone who does not have a license, the Contractors' State License Board may be unable to assist you with any financial loss
you may sustain as a result of a complaint. Your only remedy against unlicensed Contractors may be in civil court. It is also
important for you to understand that if an unlicensed Contractor or employee of that individual or firm is injured while working
on your property, you may be held liable for damages. If you obtain a permit as Owner -Builder and wish to hire Contractors,
you will be responsible for verifying whether or not those Contractors are properly licensed and the status of their workers'
compensation insurance coverage.
Before a building permit can be issued, this form must be completed and signed by the property owner and returned to
the agency responsible for issuin ermit. Note: A copy of the property owner's driver's license, form notarization, or
