the provisions of the Contractor's License Law, Chapter 9 (commencing with Section 7000) of
Division 3 of the Business and Professions Code, or that. he is exempt therefrom, and the basis
for the alleged exemption. Any violation of Section 7031.5 by 'any applicant for a permit
subjects the applicant to a civil penalty of not more than five hundred dollars ($500).

Dear Mr. Haltman:
Staff of the Energy Commission have received a complaint that certain gas swimming pool
heaters manufactured by Comfort Zone are being sold and installed in California illegally.
The Appliance Efficiency Regulations prohibits the sale or offering for sale of any pool heater
that is equipped with constant burning pilots in California. (Title 20, Sections 1601 and
1605, California Code of Regulations).
The Building Energy Efficiency Standards also place requirements on pool heaters. Section
2-5314(c) states that any gas pool heater shall not be installed if equipped with a continuously
burning pilot.
All existing units of Comfort Zone (or any other brand) pool heaters that are equipped with
standing pilots must be removed from .your stock. No further units of pool heaters with
standing pilot lights can be sold, offered for sale, or installed in California.
Your response to this letter, outlining the action you have taken correcting this situation is
