WORKERS' COMPENSATION INSURANCE
This contractor carries workers' compensation insurance for all its employees.
MECHANICS LIEN WARNING
Anyone who helps improve your property, but who is not paid, may record what is called a mechanics' lien on your property. A
mechanics' lien is a claim, like a mortgage or home equity loan, made against your property and recorded with the county recorder.
Even if you pay your contractor in full, unpaid subcontractors, suppliers, and laborers who helped to improve your property may
record mechanics' liens and sue you in court to foreclose the lien. If a court finds the lien is valid, you could be forced to pay twice or
have a court officer sell your home to pay the lien. Liens can also affect your credit.
To preserve their right to record a lien, each subcontractor and material supplier must provide you with a document called a '20-day
Preliminary Notice.' This notice is not a lien. The purpose of the notice is to let you know that the person who sends you the notice
has the right to record a lien on your property if he or she Is not paid.
BE CAREFUL. The Preliminary Notice can be sent up to 20 days after the subcontractor starts work or the supplier provides material.
This can be a big problem if you pay your contractor before you have received the Preliminary Notices. You will not get Preliminary
Notices from your prime contractor or from laborers who work on your project. The law assumes that you already know they are
improving your property.
PROTECT YOURSELF FROM LIENS. You can protect yourself from liens by getting a list from your contractor of all the subcontractors
and material suppliers that work on your project. Find out from your contractor when these subcontractors started work and when
these suppliers delivered goods or materials. Then wait 20 days, paying attention to the Preliminary Notices you receive.
PAY WITH JOINT CHECKS. One way to protect yourself is to pay with a joint check. When your contractor tells you it is time to pay for
the work of a subcontractor or supplier who has provided you with a Preliminary Notice, write a joint check payable to both the
contractor and the subcontractor or material supplier.

You, the buyer, have the right to cancel this contract within three business days. You may cancel by e-mailing,
mailing, faxing, or delivering a written notice to the contractor at the contractor's place of business by
midnight of the third business day after you received a signed and dated copy of the contract that includes this
notice. Include your name, your address, and the date you received the signed copy of the contract and this
notice. If you cancel, the contractor must return to you anything you paid within 10 days of receiving the
notice of cancellation. For your part, you must make available to the contractor at your residence, in
substantially as good condition as you received it, any goods delivered to you under this contract or sale. Or,
you may, if you wish, comply with the contractor's instructions on how to return the goods at the contractor's
expense and risk. If you do make the goods available to the contractor and the contractor does not pick them
up within 20 days of the date of your notice of cancellation, you may keep them without any further
obligation. If you fail to make the goods available to the contractor, or if you agree to return the goods to the
contractor and fail to do so, then you remain liable for performance of all obligations under the contract,"
I, the customer of Esser HVAC wish to waive my right to cancel due to an immediate/emergency need for an
Air conditioning system installation in my home. I will provide Esser with a handwritten waiver of my request

A NOTE ABOUT EXTRA WORK AND CHANGE ORDERS
Extra work and Change Orders become part of the contract once the order is prepared in writing and signed by the parties prior to
commencement of any work covered by the new change order, The order must describe the scope of the extra work or change, the
cost to be added or subtracted from the contract, and the effect the order will have on the schedule of progress payments
Exclusions:
Please Note: Next to customer satisfaction, Esser prides itself in being upfront with its customers and placing everything on the table
prior to signing a proposal or starting work. Estimating in the construction field, by nature is very limited to what we are able to see at
the time of the estimate. We are not able to bid something we are not able to see, The below exclusions are a description of things that
we MIGHT possibly run across once the equipment is removed. 11 is very rare that Esser AC finds serious issues once the equipment is
removed, as we do our best to catch every potential obstacle before the install is performed. Each of the below are subject to individual
review on a case by case basis. Esser ultimately reserves the right to cancel the contract at any time for any reason. Esser is under no
obligation to absorb the cost of extra work needed OUTSIDE the written scope of work above.

1. Esser will be using existing HIGH and LOW voltage wiring, unless otherwise specified in proposal.
1, Like other items, the low voltage wiring may be condemned during installation if its overall integrity is found to
be poor and not in useable condition. Continuity testing can generally notify installers of potential issues.
Sometimes low voltage shorts may not present themselves during the time of installation. If low voltage wiring
is not listed in the scope of work, it may be subjected to extra costs down later on. Existing wiring is NOT a
warranty item.
2. However, not all issues are able to be detected. In fact, the low voltage wire may be okay at the time of
installation and defect later. Existing items are not covered under warranty, High voltage to be referred out to
a licensed electrician at the owner's expense,
2. Condensation piping and/or draining systems-
1. Esser will use existing condensate, unless otherwise specified in proposal.
1. If it is discovered the condensate is not in reusable condition during installation, installation of new
condensate pipe will be subject to extra cost.
2. Often there is no way to predict a condensation plug or blockage, even during a new installation. We
will always make sure that the system is draining properly at the time of installation, but can in
absolutely no possible way can guarantee that it will stay unplugged. There are too many outside
factors, separate from the installation that could cause drain issues.
3. In the case of condensation drain blockage or leak due to outside factors, Esser will not be held
responsible for repairs needed to drywall, paint, etc,

1. Ducting recommendations will be made and are a separate item from the equipment install.
1. ALL ducting upgrades will be subject to extra cost.
2. NOTE: Ducting may not always be accessible. If a run is not accessible, it will not be replaced.
3. If HERS cannot pass inspection, extra repairs and replacements are subject to extra costs.

be subject to extra cost.
2. Please understand that Esser can only do a visual inspection. Once the unit is removed from the platform, Esser can
do a further inspection of the platforms integrity. Platforms are not included, unless other specified,

reasonable access to the unit on the roof, and Illes are broken, Esser AC will not be held responsible.
2. Roof Screening: Esser will use existing screening on roof or front yard. However, if" screening exists, then
customer will be responsible for hiring and providing code compliant screening around the condenser or package unit
on the roof or ground.
9. Home Intelligence: Customer is responsible for notifying Esser of a pre-existing home inteliigencelmonitoring system prior to
Esser installation viawrilten notice. idexla i-wave is proprietary and only compatible with The Nexia platform at Ihls time. Esser
will not be held Liable for arty changes or modlftcatlons needed in order to have a compatible home intelligence system.
However, if notified prior to installation, Esser may be able to offer compatible solutions.
1. Nexia Membership: Is FREE for basic thermostat use ONLY. For misc items (cameras, locks, garage door openers,
switches etc.) a monthly $10.00 fee is charged by NEXIA. This is subject to change at any time and separate from
Esser entirely,
10, Attic Entry/Hatch: Esser will take the proper steps to protect the attic hatch. However, damage to paint is inevitable. Esser
cannot and will not be held responsible for the re -painting or repairs needed around the attic halch. owner to be responsible
for the repairs to paint and drywall after installation. Holding payment from Esser once installation is complete could lead to
service charges for late payment after 10 days or a lien against the property,
EXTENDED WARRANTIES: Extended warranties are a great way to remain free of repair bills and commonly purchased by our
customers. NOTE: twice a year maintenance MUST be done in order to keep warranty valid. Like an oil change for your car, AC
systems must be properly maintained for even the basic manufacturer warranty to be valid. The same goes for extended warranties.
