The adjustment requested is cons.istent with the intent and purpose of Title 9 of the La Quinta Municipal Code (Zoning Regulations) in that the proposed location of air conditioning mechanical equipment will create a lesser noise impact in the general vicinity than if the regulations were stringently enforced. 2. There are special circumstances applicable to the subject property, in that the La Quinta General Plan encourages larger parcel divisions through mergers and lot line adjustments to reduce densities and allow for thee" provision of higher quality housing; in so doing, the Applicant has incurred difficulty in strictly adhering to the setback requirements as applied by the SR Zoning regulations. 3. The air conditioning condenser unit shall be located as shown on approved "Exhibit A", as maintained in the file for SBA 90-035. 2. Applicant shall adhere to all other requirements of the SR Zone,, .including . Section 9.42.070.F. Fencing Regulations) with the following exception: a:. Walls provided at or near the north side yard, within the front yard area (between .20 -foot setback line and front property line) shall be 5 -feet in height from finished grade. All other walls in the front yard area, as defined in Section 9.08.920 shall be limited to 4 -foot and 5 -foot as permitted by the fencing requirements.
