SUBJECT: APPROVAL FOR MINOR ADJUSTMENT 97-443
On June 12, 1997 the Community Development Department approved the above
referenced request, subject to conditions. In that `approval, the allowed 2 -foot
reduction in the front setback was limited to the bay window feature of the house.
The reduction should apply generally to the front of the building as proposed, which
would include the- pilasters at the garage as well.
This letter is provided to clarify that intent, and to advise you of the following
modification to approval finding #2:
2. This adjustment is consistent with the intent and purpose of the Zoning Code
in allowing development of single family homes and swimming pools/spas in.
the RC Zoning District. Reduction of the front yard setback will allow
maximization of the area between the house, swimming pool/spa, rear and side
property line in order to accommodate necessary equipment and adequate
walking surfaces around the pool/spa for the occupants and guests.

This letter is to report that the Community Development Department has reviewed your Minor
Adjustment application, pursuant to Section 9.210.040 of the City of La Quinta Planning and
Zoning regulations. Please note that the APN and lot description do not match;.based on your
site layout and lot information, the above APN should be correct. Please verify this information
with your records.
MINOR ADJUSTMENT REQUEST:
To reduce the front yard setback from 20 feet to 18 feet for the bay window, and to increase
the building height 2 inches, to 17', 2".
DECISION:
Approval is granted for both the requested reduction in the front yard setback, and the 2 -inch
exceedance of the 17 -foot height limit.
CONDITIONS:
:1. Obtain -the necessary building permit(s) from the Building and Safety Department.
2. No pool or FAU equipment locations are shown on Exhibit A. Any such equipment shall
maintain the .minimum distances as specified in Section 9.60.070.B.2 of the Zoning Code.
3. The water's edge of any .portion of the proposed pool and spa may be no closer than
three feet from any property line, in accordance with. Section 9.60.070. B.1 of the- Zoning
Code.

After review it was -determined that:
1. This adjustment is consistent with the La Quinta General Plan, in that the proposed
modifications do not affect physical land use characteristics of the property, as
designated Medium Density Residential, and is not in conflict with any related General
Plan policy,
2. This adjustment is consistent with the intent and purpose of the Zoning Code in allowing
development of single family homes and swimming pools/spas in the RC Zoning District.
The 2' adjustment only applies to the facade bay window. Reducing the front yard
setback will allow maximization of the area between the house, swimming pool/spa, rear
and side property line in order to accommodate necessary equipment and adequate
walking surfaces around the pool/spa for the occupants and guests.
3. The proposed adjustment is in compliance with the California Environmental Quality Act
(CEQA), in that the proposal is considered exempt from such review under Section
15305; CEQA Guidelines.
4. This adjustment will not be detrimental to the health, safety, and general welfare of the
community because the yard improvements will be privately maintained and fenced to
prohibit access to the improvements unless by the owner's permission, and will be
situated in the rear yard area so as to be'unobtrusive on the surrounding properties.
