Homeowner has the duty to schedule these yearly inspections. Diversified Roofing Services shall be paid for the inspection and repair services. The cost for the yearly maintenance. Diversified Roofing Services is not responsible for wind, lightning, fire, hailstorms or any form of natural occurrence that may damage the integrity of the roofing system. Roofer shall be excused for any delays or defaults caused by the Architect, Owner, Contractor, Customer, and / or any other subcontractor, the act of of any agent of the other, the act of any govemmental authority, the act of any public enemy, acts of God, the elements, war, war defense conditions, litigation, strikes, walkouts, or other causes beyond the party's control. Each party shall use reasonable diligence to avoid any such delay or default and to resume performance under this Contract as promptly as possible after such delay or default. It is also acknowledged and understood that any changes in the plans and specifications made by the Architect, Owner, contractor, Customer, Roofer, or any governmental agency will extend the time in which the Project will be completed and may cause damage to Roofer. Customer is responsible for the delay in delivery or availability of materials selected by Customer and / or Architect and warrants that the material will not impair Roofer's work. If Roofer is unreasonably delayed, rooter has the right to terminate this contract or increase its contract price to cover increased staging, overhead, material, and labor costs. Customer has approved the roofing material and verified the accuracy of the size and descriptions of all material supplied hereunder. Roofer does not warrant the specific roofing material selected by the Customer. Customer's exclusive remedy for defective roofing material selected by Customer shall be against the warranty of the manufacturer of the roofing material. Any claim or dispute arising out of or relating to this contract / proposal, shall be settled by an arbitrator in accordance with the applicable Construction Industry Arbitrator Rules of the American Arbitration Association which are in effect at the time of the demand for arbitration is filed. A judgment award based upon evidence presented by parry (ies) who do (does) appear and participate. Notwithstanding Contractor's right to arbitrate, contractor does not waive any of its lien rights. The arbitration venue shall be in the Coachella Valley, California area.
