SUBJECT: TEMPORARY USE PERMIT 2019-0009
FLOOR AND DECOR GRAND OPENING EVENT
Dear Mr. Peachey:
The Design and Development Department has reviewed and approved your request to have a grand
opening event within the Floor and Decor parking lot. The approval of the event is granted under
Section 9.100.090 of the La Quinta Municipal Code subject to the following Conditions of Approval:
1. The event shall not occur if Floor and Décor has not secured a Certificate of Occupancy to
occupy and operate the building at 79315 Highway 111. This permit is solely for the event
and does not presume approval of any building permit for use of the building.
2. The event is approved to occur on January 18, 2020 from 10:00 am – 2:00 pm, per the
information submitted and on file.
3. The location of the event is limited to the Floor and Decor parking lot. Traffic aisles shall
not be blocked. No handicap parking stalls shall be blocked.
4. All food truck apparatus shall be of the motorized type to provide easy relocating and
evacuation in the event of an emergency or where otherwise required. All food trucks
shall have their own compliment of a minimum 2A10BC (5 lb) fire extinguisher under
current service tag. All food trucks that have fuel-fire equipment shall be provided with
adequate ventilation and a commercial kitchen hood extinguishing system. The hood,
plenum and duct shall be maintained in a clean and safe operation. The hood suppressions
systems shall be operational and provided with current service tag.
5. All vendors, including food trucks, shall have a City of La Quinta business license prior to
event.
6. The applicant shall secure an electrical permit if electric power is to be provided.
7. The event shall be monitored and secured at all times.
8. Roadways, parking areas, and pedestrian traffic aisles outside the proposed area shall be
maintained accessible at all times.
9. Adequate trash receptacles shall be provided.
10. The site shall be left clean and in its original manner at the conclusion of the event.
11. The applicant agrees to indemnify, defend and hold harmless the City of La Quinta in the
event of any legal claim or litigation arising out of the City’s approval of this project. The
City of La Quinta shall have the right to select its defense counsel at its sole discretion
Adherence to these conditions, as outlined, will ensure that adverse impacts to surrounding
properties and businesses will be minimized. The City may elect to add conditions to this application
to mitigate any problems that arise not previously addressed herein.
