EXECUTIVE SUMMARY: The applicant proposes to reconfigure two existing commercial parcels and create one new parcel within the 111 La Quinta Specific Plan area (Attachment 1). As part of the proposal, the City will obtain easements for constructing a planned traffic signal at the Adams Street/Corporate Center Drive intersection. Staff supports the proposal and has no significant issues with the proposed subdivision. BACKGROUND: The 111 La Quinta Specific Plan is predominantly developed (Attachment 2). On February 17, 2015, the City Council approved an MOU between the City, Kohl's and the center ownership for the developers' participation in the Adams Street Signal and Street Improvement project. This improvement project will relieve congestion and improve north/south traffic flow on Adams Street between Highway 111 and the Adams Street Bridge. It will also improve traffic conditions associated with crossing Adams Street between the Kohl's parking lot and The Pavilion at La Quinta shopping center. The center owner previously maintained temporary offices along the west side of Adams Street, at the general location of the proposed intersection with Corporate Center Drive. Page 1 of 2 These structures have been removed, and demolition work for the signal's construction has recently begun. The improvements include installing a new west leg to the intersection, signalizing the intersection, and installing a hardscape median from Highway 111 to the Adams Street Bridge. PROPOSAL & ANALYSIS: The City has been working with the center ownership and Kohl's to reconfigure the subject area to allow the planned signal project and create an additional commercial pad. The proposed map subdivides two parcels into three parcels (Attachment 3). Parcel 1 is a reconfiguration of the existing Kohl's parcel to provide access to Adams Street and the proposed intersection alignment. Parcels 2 and 3 are a reconfiguration of an existing parcel between Adams Street and Parcel 6, which accommodates the access way and creates the new commercial parcel boundaries. The new entry will "split" the two new parcels and create a 4-way intersection with Adams Street and Corporate Center Drive. The parcel map will also accommodate the necessary driveway easement at the Adams Street access. AGENCY AND PUBLIC REVIEW: Public Agency Review: This request was sent to all applicable City departments and affected public agencies on May 20, 2015. All written comments received are on file and available for review with the Community Development Department. All applicable comments have been incorporated in the recommended Conditions of Approval. Public Notice: This project was advertised in The Desert Sun newspaper on July 3, 2015, and mailed to all property owners within 500 feet of the site. To date, no comments have been received from adjacent property owners. Any written comments received will be made available at the hearing. ENVIRONMENTAL REVIEW The Community Development Department has determined that this tentative map application is exempt from environmental review under the California Environmental Quality Act (CEQA), per CEQA Guidelines, Section 15315 (Minor Land Divisions), in that the project meets the exemption criteria outlined in 15315 as a subdivision of fewer than four parcels within an existing commercial urbanized area. The proposed tentative parcel map is consistent with the La Quinta General Plan and the 111 La Quinta Center Specific Plan. The proposed map incorporates existing fully developed improvements that are consistent with design guidelines and standards of the General Plan for General Commercial designated properties, as set forth in the Land Use Element, and the tentative map maintains commercial development standards including setbacks, pad elevations, and other design and performance standards set forth in the Corporate Center Specific Plan. The proposed tentative parcel map will implement necessary traffic improvements consistent with circulation policies identified in the La Quinta General Plan. B. The design or improvement of the proposed tentative parcel map is consistent with the La Quinta General Plan in that the property is developed with street and parcel improvements in conformance with applicable goals, policies, and development standards when the property was developed, and already provides adequate infrastructure and public utilities. Additionally, traffic signal improvements will be accommodated based on the design of the tentative parcel map. C. The design of the tentative parcel map and the proposed improvements are not likely to cause substantial environmental damage nor substantially injure fish or wildlife or their habitat, in that the parcel map boundary incorporates an existing built -out condition, which has no value for natural habitat or wildlife. The City of La Quinta Community Development Department has determined that this project is Categorically Exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15315 Class 15 (Minor Land Divisions). D. The design of the tentative parcel map and the proposed improvements are not likely to cause serious public health problems, as the traffic improvements contemplated under the tentative parcel map will not result in any increased hazard to public health or welfare and, in fact, will reduce such impacts through provision of a 4-way signalized intersection to replace the uncontrolled 3-way intersection condition. E. The site of the proposed tentative parcel map is physically suitable for the type of development and proposed density of development. As conditioned, the proposed design of the subdivision is physically compatible with the site with regards to site characteristics (relief, drainage, development intensity, etc.) and conforms to the existing development on the subject property, and existing in the surrounding area. G. As conditioned, the design of the tentative parcel map will not conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision, in that such easements either presently exist within the project and will be retained as currently provided for, or, will be provided as part of the tentative parcel map. CONDITIONS OF APPROVAL GENERAL 1. The applicant agrees to defend, indemnify and hold harmless the City of La Quinta ("City"), its agents, officers and employees from any claim, action or proceeding to attack, set aside, void, or annul the approval of this Tentative Parcel Map, or any Final Map recorded thereunder. The City shall have sole discretion in selecting its defense counsel. The City shall promptly notify the applicant of any claim, action or proceeding and shall cooperate fully in the defense. 2. This Tentative Parcel Map, and any Final Map recorded thereunder, shall comply with the requirements and standards of Government Code §§ 66410 through 66499.58 (the "Subdivision Map Act"), Chapter 13 of the La Quinta Municipal Code ("LQMC"). The City of La Quinta's Municipal Code can be accessed on the City's Web Site at www.la-quinta.org. 3. This Tentative Parcel Map shall expire on July 15, 2017, which is two years from the date of Director's Hearing approval, unless recorded or granted a time extension pursuant to the requirements of La Quinta Municipal Code 13.12.160 (Extensions of time for tentative maps). 4. Developer shall reimburse the City, within thirty (30) days of presentment of the invoice, all costs and actual attorney's fees incurred by the City Attorney to review, negotiate and/or modify any documents or instruments required by these conditions, if Developer requests that the City modify or revise any documents or instruments prepared initially by the City to affect these conditions. This obligation shall be paid in the time noted above without deduction or offset and Developer's failure to make such payment shall be a material breach of the Conditions of Approval. 7. Developer shall reimburse the City, within thirty (30) days of presentment of the invoice, all costs and actual consultant's fees incurred by the City for engineering and/or surveying consultants to review and/or modify any documents or instruments required by this project. This obligation shall be paid in the time noted above without deduction or offset and Developer's failure to make such payment shall be a material breach of the Conditions of Approval. PROPERTY RIGHTS 8. Prior to issuance of any permit(s), the applicant shall acquire or confer easements and other property rights necessary for the construction or proper functioning of the proposed development. Conferred rights shall include irrevocable offers to dedicate or grant access easements to the City for emergency services and for maintenance, construction and reconstruction of essential improvements. The applicant shall establish the aforementioned requirements in the right of way documents for the development or other agreements as approved by the City Engineer. Pursuant to the aforementioned, the applicant shall submit and execute an "AUTHORIZATION TO REMOVE GRAFFITI FROM PRIVATE PROPERTY" form located at the Public Works Department Counter prior to Certificate of Occupancy of future development. 9. Pursuant to the aforementioned condition, conferred rights shall include approvals from the master developer over easements and other property rights necessary for construction and proper functioning of the proposed development not limited to access rights over proposed and/or existing parking, access aisles that access public streets and open space/drainage facilities of the development. Said rights shall also include reciprocal access and reciprocal parking rights within Tentative Parcel Map 36836 and easements for utility lines to the satisfaction of the City Engineer. 10. The applicant shall offer for dedication all public street rights -of -way in conformance with the City's General Plan, Municipal Code, applicable specific plans, and/or as required by the City Engineer. 11. The public street right-of-way offers for dedication required for this development include: A. PUBLIC STREETS 1) Adams Street (Secondary Arterial) - the hatched area at the intersection of Corporate Center Drive as shown on the Tentative Parcel Map to include the new traffic signal and its equipment. 12. Dedications shall include additional widths as necessary for other features contained in the approved construction plans. Pursuant to this requirement, the Applicant shall include in the submittal packet containing the draft final map submitted for map checking, an offsite street geometric layout, drawn at 1-inch equals 40 feet, detailing the following design aspects: median curb line, outside curb line, lane line alignment including lane widths, left turn lanes, deceleration lane(s), and traffic signal equipment. The geometric layout shall be accompanied with sufficient professional engineering studies to confirm the proposed improvements that may impact the right of way dedication required of the project. When the City Engineer determines that access rights to the proposed street right- of-way shown on the approved Tentative Parcel Map are necessary prior to approval of the Final Map dedicating such rights -of -way, the applicant shall grant the necessary rights -of -way within 60 days of a written request by the City. 14. Where public facilities are placed on privately -owned setbacks, the applicant shall offer for dedication blanket easements for those purposes on the Final Map. 15. The applicant shall offer for dedication those easements necessary for the placement of, and access to, utility lines and structures, drainage basins, mailbox clusters, and common areas on the Final Map. 16. Direct vehicular access to Adams Street is restricted, except for the access point at Corporate Center Drive identified on the tentative parcel map, or as otherwise conditioned in these conditions of approval. The two access openings on the west side of Adams Street north of Corporate Center Drive are to be abandoned. The vehicular access restriction shall be shown on the recorded final parcel map. 17. The applicant shall cause no easement to be granted, or recorded, over any portion of the subject property between the date of approval of the Tentative Parcel Map and the date of recording of any Final Map, unless such easement is approved by the City Engineer. STREET AND TRAFFIC IMPROVEMENTS 18. The applicant shall comply with the provisions of LQMC Sections 13.24.060 (Street Improvements), 13.24.070 (Street Design - Generally) & 13.24.100 (Access for Individual Properties and Development). FINAL MAPS 19. Prior to the City's approval of a Final Map, the applicant shall furnish accurate mylars of the Final Map that were approved by the City's map checker on a storage media acceptable to the City Engineer. The Final Map shall be 1" = 40' scale. MAINTENANCE 20. The applicant shall comply with the provisions of LQMC Section 13.24.160 (Maintenance). 21. The applicant shall make provisions for the continuous and perpetual maintenance of common areas, perimeter landscaping up to the curb, access drives, sidewalks, and stormwater BMPs.
