We are also currently working on three fire station remodels and a Police Department locker room renovation. It is very unusual to assess Liquidated Damages to an Architect. Please strike this clause: Exhibit A, p5., 6. Liquidated Damages. Since the determination of actual damages for any delay in performance of the Agreement would be extremely difficult or impractical to determine in the event of a breach of this Agreement, Contracting Party shall be liable for and shall pay to City the sum of One Thousand dollars ($1,000.00) as liquidated damages for each working day of delay in the performance of any of the Services required hereunder, as specified in the Schedule of Performance. In addition, liquidated damages may be assessed for failure to comply with the emergency call out requirements, if any, described in the Scope of Services. City may withhold from any moneys payable on account of the Services performed by Contracting Party any accrued liquidated damages. As you may know, your indemnification clause in Exhibit F Page 1, F.1is not compliant with California Civil Code Section 2782.8. In the Civil Code the intent is to say that any indemnification clause relating to a design professional against liability for claims against the indemnitee, are unenforceable, except to the extent that the claims against the indemnitee arise out of, pertain to, or relate to the negligence, recklessness, or willful misconduct of the design professional. In no event shall the cost to defend charged to the design professional exceed the design professional's proportionate percentage of fault. You’re language includes errors and omissions. With respect to the design of public improvements, the Contracting Party shall not be liable for any injuries or property damage resulting from the reuse of the design at a location other than that specified in Exhibit A without the written consent of the Contracting Party. In no event shall the cost to defend charged to the design professional exceed the design professional's proportionate percentage of fault. In Section F.1.b, this contract is for Professional Services and so there is No “Indemnification for Other than Professional Liability”. Please omit this clause. In Section F.1.d.1. It appears that this is more in line with the State language and conflicting with F.1. Aviation Facility This project included a new 27,500 s.f. maintenance hangar, a 22,500 s.f. storage hangar and 11,500 s.f. of operations offices for the new Sheriff’s Aviation Operations Facility. This includes situation and community rooms for emergency operations and search and rescue operations. The Sheriff’s operations offices include emergency communications systems, locker rooms, restrooms and weapons storage. The maintenance hangar included a foam fire suppression system for the entire hangar as well as a paint booth. Several key agencies were involved including Caltrans, TSA, AQMD and the Airport Authority. The project included a significant renovation to the restrooms, showers, kitchen and dormitory of the fire station as well as the addition of a new workout room and a larger living / gathering space for the firefighters. Our work included assessing their existing facilities for ADA improvements, mechanical, plumbing and electrical systems, and analyzing their existing staffing requirements to determine the best approach to renovating for additional lockers and gender-neutral issues. TR Design Group interviewed staff, developed several conceptual plans with budgets to present to City Council. Currently in plan check with the City. MORENO VALLEY FIRE STATION NO. 48 SUNNYMEAD RANCH MORENO VALLEY, CAL We are familiar with how agencies process projects as well as public bidding requirements. We bring the following approach to the Fire Station 70 Revitalization project. AS-BUILTS / WORKSHOP Our team will go out to your site, measure, observe and ideate how to creatively renovate the fire station while remodeling it. We will prepare drawings of the existing facility from which to work both from your drawings and field measurements. We will identify issues and discuss solutions. We will also host a workshop with City staff to then discuss the improvements and potential issues / solutions. CODE AND ACCESSIBILITY REGULATIONS Next we will review the Code and Accessibility issues for proposed changes. It is anticipated that you will need additional space for accessibility requirements, although no expansion to the facility is included. We are very familiar with ADA requirements for restrooms and have completed numerous similar facilities. We deal with ADA requirements on every project. We can creatively solve your station’s issues. CONCEPTUAL DESIGN Then, with your input and code issues in hand, we will prepare concept drawings that illustrate (2) potential new layouts and how to improve the station in the areas listed. We will solve the problems and present ideas to you. We can work with you to refine the concepts. MATERIALS FIXTURES AND EQUIPMENT We have worked on several high traffic and public use restroom facilities and can provide you with recommendations and selections for the fixtures, materials and partitions that will be timeless as well as durable for the day-to-day use of the facility. We will assist you in the design and selections for the station that will provide you with quality and value. CONCEPT FINALIZATION / DESIGN DEVELOPMENT Upon City selection of the materials and the preferred design concept, we will prepare a final Conceptual Floor Plan and an Opinion of Probable Construction Cost. Once these are approved, we can move quickly into preparation of the Construction Documents. CONSTRUCTION DOCUMENTS Dimensioned plans will be prepared; details will be designed; fixtures and hardware coordinated; and building materials, colors and finishes will be finalized. Detailed drawings and schedules will be prepared for mechanical, plumbing and electrical systems. We will coordinate our drawings with our consulting engineers. U N D E R S T A N D I N G & A P P R O A C H C . After the plans are complete, a detailed statement of probable construction cost will prepared. A complete set of drawings and book specifications will be provided to you for review and approval. PEER REVIEW As part of our team, Rick Jaeger is a Certified ICC Building Plans Examiner with Quality Plan Reviews (QPR). QPR will review the set of drawings before the plans go out to bid. We will perform this review while 1st Plan Check is being reviewed in order to save time on the schedule. We are committed to quality and will review the documents for coordination, accessibility and constructability issues prior to bid. PERMITS We make every effort to assure that the plans we prepare are in compliance with applicable code requirements and local regulations. We research requirements during all phases of design. We anticipate the City of La Quinta will assist in preparing their departments for the review of the project. We will work closely with the City of La Quinta departments to process the permits in a timely manner. BIDDING We will assist you in issuing the plans for public bid. We will attend the Pre-Bid meeting and be available for RFI’s and Addenda, if needed. CONSTRUCTION ADMINISTRATION As part of the construction of the locker rooms, we will provide construction administration, including the review of shop drawings and submittals. This will include products and materials and hopefully very limited substitutions. We will provide site visits as listed in our proposal including a visit from our MEP Engineer. Near completion, we will conduct a punch-list review as well as the final completion letter to assist you in the completion of the contract. With provision of as- builts from the contractor, we will prepare updated electronic documents to the City. Let’s get your project done! CONSTRUCTION MANAGEMENT (OPTIONAL) Although not requested in your RFP, we can also provide Construction Management services on the project from Bidding through Construction. This would include additional services on our part to include: Reviewing deliverables and time constraints, tracking GC's adherence to the schedule, reviewing progress and construction payments, coordination with the GC and subs, and reporting to the City. MORENO VALLEY FIRE STATION NO. 48 SUNNYMEAD RANCH MORENO VALLEY, CAL TR Design Group, Inc. will provide the City of La Quinta with architectural consistent with the established local and state law and guidelines. The services shall be performed in accordance with the sample agreement with noted exceptions. Under this agreement, TR Design Group Inc. will provide, but not be limited, to the following scope of services: TR Design Group will deliver completed and approved assignments on or ahead of schedules. All deliverables shall be prepared and submitted in a manner that ensures a complete package, fully reviewed and approved by the city with no more than three successive review submittals being required for any given review and approval process. We will be proactive and knowledgeable of the City’s design criteria, environmental, and funding requirements for the Fire Station No. 70 revitalization project. We will be an advisor, advocate, and produce a product with the best interest intended for the City. TR Design Group shall be the prime consultant and shall contract with, and coordinate the work of all sub-consultants to meet the specific project needs. All work shall be done in conformance with applicable laws, City Design Manuals, City Standard Plans and Specifications, the Uniform Building Code, (Fire, Electrical) and as revised and amended. We will work with you to address and requirements for federally funded projects. We will work to provide a cost effective design and shall strive to minimize the impacts of the renovation activities on the ongoing public use of of existing city facilities. We are concerned that your budget is thin in comparison to other, similar projects we have experienced. We see public-agency renovation costs in the $ 500 / s.f. range. TR Design Group will either perform or coordinate with a sub-consultant to perform the following project activities: 1. Meet with staff to determine the extent and character of the project, and visit the site to become familiar with existing conditions that may impact the projects outcome. 2. Conduct/coordinate research of all applicable existing files and records for on-site infrastructure 3. Prepare plans and specifications for the revitalization which includes (at this point): A. New paint and energy efficient lighting throughout B. Floors - polished concrete in all spaces except dormitories and bathrooms. We do not recommend polished concrete for a number of reasons but will offer alternatives and the reasons. C. Restroom renovations including replacement of fixtures and tile. Shower areas to be modernized to promote privacy. We anticipate additional space will be required to improve the restrooms and meet ADA requirements. D. Men’s Dormitory and Captain’s Bedroom will have the furniture removed and replaced with furniture specified by the Fire Department (furniture selections, coordination and ordering not in Scope). The carpet will be removed and replaced. The new furniture layout will consider three to five bunking stations (space permitting) that include extra-long twin beds, desks, and cabinets. E. Sliding glass exterior door will be replaced with a single commercial door with key pad. F. Reception/Control Room: Furnishings will be removed, including built in book shelf with new furniture (furniture selections, coordination and ordering not in Scope). G. Exterior Patio - The existing wood trellis will be painted and modified to provide a more efficient shaded environment for personnel and exterior equipment (Generator). H. No. 48 Moreno Valley, CA: In 2013, TR Design Group was selected as the architectural team for the renovations and addition to an existing fire station in the City of Moreno Valley. The project involved a combined square footage of 5,650 s.f. The project was a significant renovation to the kitchen, restrooms, showers and dormitory of the fire station as well as the addition of a new workout room and a larger living / gathering space for the firefighters. This project was completed in 2015. Brian K. Sheriff’s Aviation Facility, San Bernardino, CA: Brian was the Project Architect for the new 50,000 s.f. hangar and 11,500 s.f. of offices for the new Sheriff’s Aviation Facility. San Bernardino Sheriff’s Dept. Aviation Facility This project included a new 27,500 s.f. maintenance hangar, a 22,500 s.f. storage hangar and 11,500 s.f. of operations offices for the new Sheriff’s Aviation Operations Facility. Their fleet included both fixed wing and rotary aircrafts. This includes situation and community rooms for emergency operations and search and rescue operations. The Sheriff’s operations offices include emergency communications systems, locker rooms, restrooms and weapons storage. The maintenance hangar included a foam fire suppression system for the entire hangar as well as a paint booth. Several key agencies were involved including Caltrans, TSA, AQMD and the Airport Authority. He is a strong team member and recently completed his architectural licensing. He has developed from a draftsman to a Job Captain to a Project Manager and now is a licensed Architect.
