PLANNING COMMISSION AGENDA 3 JULY 14, 2015 PLANNING COMMISSION MINUTES TUESDAY, JUNE 2312015 CALL TO ORDER A regular meeting of the La Quinta Planning Commission was called to order at 7:10 p.m. by Chairperson Wright. PRESENT: Commissioners Blum, Fitzpatrick, and Vice Chair Wilkinson ABSENT: Commissioner Bettencourt and Chairperson Wright STAFF PRESENT: Community Development Director Les Johnson, Planning Manager Gabriel Perez, Associate Planner Jay Wuu, and Executive Assistant Monika Radeva Commissioner Blum led the Commission in the Pledge of Allegiance. PUBLIC COMMENT Public Speaker: Ms. Neeta Quinn, La Quinta, CA - introduced herself, provided the Commission with information on "Affirmatively Furthering Fair Housing Proposal" from the U.S. Department of Housing and Urban Development and spoke on items related to Agenda 21, United Nations Sustainable Development. CONFIRMATION OF AGENDA - Confirmed APPROVAL OF MINUTES Motion - A motion was made and seconded by Commissioners Blum/Fitzpatrick to approve the Planning Commission Minutes of June 9, 2015, as submitted with the following correction on page 2, paragraph 1, line 6: Commissioner Fitzpatrick asked to replace the word proposed with existing. PLANNING COMMISSION MINUTES 1 JUNE 23, 2015 PUBLIC HEARINGS 1. Zoning Ordinance Amendment 2015-0001 submitted by the City of La Quinta proposing to amend Title 9, Section 9.150.060, Spaces Required by Use, of the La Quinta Municipal Code to allow for the a reduced number of required parking spaces for properties within the Village Commercial Zoning District. CEQA: exempt from environmental review pursuant to Section 15061 (B)(3), Review for Exemptions of the CEQA Guidelines. Associate Planner Jay Wuu presented the information contained in the staff report, a copy of which is on file in the Community Development Department. Commissioner Blum asked staff about the City's current parking requirements and stated he was concerned that by reducing them in the Village the City would be doing a disservice to both the merchant and the consumer. This could result in discouraging potential future development. He suggested the City form a parking benefit district, the cost could be shared by all businesses that would benefit from it. Commissioner Fitzpatrick asked if staff is planning to monitor the effects of the proposed reduction in parking requirements. Community Development Director Johnson noted that there had been a strong interest from current business owners in the Village as well as future developers to review and revise the existing parking requirements. Staff recently brought this matter to City Council and received direction to proceed with the revisions. He said the City would like to encourage a pedestrian -scale in the Village. The Village is the only area where fee can be paid in lieu of providing parking. The proposed interim parking requirements are intended to encourage development in the Village. Staff is in the process of completing a build out analysis for the Village as part of a project Environmental Impact Report. Staff will be identifying new parking standards for the Village, which should replace the interim requirements by the end of June, 2016. He noted staff does not have any plans to monitor peak parking use during this interim period. Commissioner Fitzpatrick asked if this subject matter was being looked at holistically on a city-wide scale as it was integral to creating the pedestrian -walkable mixed -use community envisioned for La Quinta. She noted she was in support of encouraging development in the Village and would like to see similar approach applied to the Highway 111 corridor as well, if applicable. Staff replied it was as part of reviewing parking standards city-wide. Vice Chair Wilkinson asked if existing businesses would benefit from the proposed parking reduction and how the June 2016 deadline will apply for a business in the process of securing a permit. Staff replied businesses would only benefit if they were PLANNING COMMISSION MINUTES 2 JUNE 23, 2015 to expand or change the current use and explained the application of the deadline with regards to the approval process. General discussion followed regarding the current and possible future parking requirements and the build -out analysis for the Village. Vice Chair Wilkinson declared the PUBLIC HEARING OPEN at 8:06 p.m. Public Speaker: Ms. Neeta Quinn, La Quinta, CA - introduced herself and said she lives in north La Quinta and would not be able to walk to the Village, she enjoys walking around Old Town, but she needs to drive there and be able to park. She noted that if adequate parking in the Village is not provided she would simply elect to go elsewhere. Vice Chair Wilkinson declared the PUBLIC HEARING CLOSED at 8:07 p.m. Motion - A motion was made by Commissioner Fitzpatrick to adopt Resolution 2015- 007 recommending City Council approval of Zoning Ordinance Amendment 2015- 0001 as submitted with staffs recommendations. Motion failed due to the lack of second. Vice Chair Wilkinson declared the PUBLIC HEARING REOPEN at 8:09 p.m. Motion - A motion was made and seconded by Commissioners Fitzpatrick/Blum to continue Public Hearing Number 1 to the next regularly scheduled Planning Commission meeting on July 14, 2015. EXECUTIVE SUMMARY • Multiple parties have expressed interest in developing in the La Quinta Village ("Village") (Attachment 1), including new construction, expansion of existing businesses and reuse of existing buildings. • City Council recently provided supportive comments towards establishing interim parking standards for the Village in order to stimulate development interest while staff develops new parking standards. BACKGROUND/ANALYSIS This proposal was considered at the June 23, 2015 Planning Commission meeting and continued to the July 14, 2015 meeting. The Commission discussed the proposed Page 1 of 3 ordinance and requested additional information, which is provided as follows: • According to the 2006 Village District Parking Study, a total parking supply of 2,919 parking spaces exist within the Village. This includes both off-street and on -street parking spaces. Since 2006, approximately 180 additional on -street parking spaces have been added (Village Park Animal Hospital and Plaza Calle Tampico) for a total of 3,099 parking spaces within the Village District. • Property/business owners who have expressed interest in the adoption of the proposed ordinance have been contacted and encouraged to attend the Planning Commission hearing or provide correspondence regarding their interests. Development interest in the Village continues to remain strong. Developers have contacted staff regarding City -owned properties and various Village property and business owners have also expressed interest in establishing new or expanding existing businesses. Feedback received from development interests has generally represented concern over the City's parking standards. The number of parking spaces required is generally consistent throughout the City. This has been of challenge for many representing Village development interests; pointing out the amount of public parking currently available (on -street and at the City parking lot), the willingness for customers to walk a short distance to a business, as well as the need to maintain a pedestrian scale versus auto -oriented commercial development with large parking lots. At the June 2, 2015 City Council meeting, staff proposed interim parking options for the Village. Council encouraged staff to proceed with establishing interim parking standards for the Village as follows: • 50% reduction in required off-street parking for all new development and expansion of existing businesses. • No additional parking required for change of use. • Interim period to exist until June 30, 2016, with option of extending interim period for up to one additional year. Exhibit A of the proposed Planning Commission Resolution identifies the proposed changes to the Municipal Code. This amendment will provide relief from current off-street parking requirements. As a result, there is potential for additional parking demand being placed upon existing on - street parking, the City parking lot at Avenida Bermudas and Avenida Montezuma, as well as existing private parking lots. However, existing on -street parking and the City Page 2 of 3 parking lot are not fully utilized, with the exception being during special events and peak periods in season where on street parking in certain areas of the Village is fully utilized. Providing relief during the identified interim period is expected to stimulate new development as well as the expansion of existing businesses, the extent of which is unknown. The impact to existing public parking opportunities in the Village is dependent upon how much development activity results during the interim period. During the interim period, staff will comprehensively address new parking standards for the Village, as well as update existing alternatives such as the parking fee in -lieu program, consideration of alternative methods and parking reductions specific to the Village. This comprehensive review process will include engagement with the Planning Commission and City Council. Following Planning Commission consideration, the schedule to establish interim parking standards for Village Commercial zoned properties includes a public hearing before City Council on August 4, 2015. If approved by City Council, the interim standards are expected to become effective mid -September. AGENCY & PUBLIC REVIEW Public Notice: This project was advertised in The Desert Sun newspaper on June 12, 2015. To date, no comments have been received. Comments were not requested from any public agencies or other City Departments, given the limited scope of the amendment. ENVIRONMENTAL REVIEW The Community Development Department has determined that the proposed zone text amendment is exempt from environmental review under CEQA, pursuant to Section 15061(b)(3), Review for Exemptions - General Rule, in that it can be seen with certainty that there is no possibility for this action to have a significant effect on the environment, and individual development plans will be reviewed under CEQA as they are proposed. July 14, 2015 Dear Chairman and members of the Planning Commission: I would have liked to address you in person today but I'm out of town. I wanted you to know that the proposed changes in the Village parking requirements are critical to the viability of any new development of both commercial and residential buildings. The current standards are out dated and are not in line with current national standards promulgated by the Urban Land Institute and used in the parking studies required under the City's VUP process. Quality mixed use projects which are pedestrian friendly and which comply with the City's stated goals for Village development are not possible under the current standards unless an applicant uses the Specific Plan process. That process is costly in both time and money and is too burdensome for individual lot owners. This interim Parking plan will allow staff time to study and suggest to you the Council and citizens a comprehensive parking plan for the Village. This issue has been addressed by consultants and in parking studies previously commissioned by the City all of which say that the Village needs less parking. Old Town would not have been possible, nor would it have the charm and pedestrian friendly feel it has if not for a Specific Plan which substantially reduced required parking from that which was required under City Codes. Old Town parking works. Of course, there are always a few who say it's hard to find parking or they can't park right in front of their favorite restaurant or store. These are the same people who will go to Costco or Westfield Mall and walk 100 or 200 yards before getting in the front door then walk for a mile around the store. Every successful downtown has a combination of on street, parking lots, parking structures, and private parking. Think about Carmel, La Jolla, Beverly Hills they work and we love them because they have nice streets rather than acres of flat parking lots. In summary, the proposed 50% interim reduction in parking will encourage new development in the Village to better serve the citizens of La Quinta while a more practical and progressive parking plan is developed by staff. I believe this is exactly the type of pro -active proposal that an enlightened City Staff should bring forward to improve the quality of life in the City while promoting quality new development and adaptive re -use and expansion of existing buildings. This proposal will allow small projects and individual lot owners to have parking requirements which were only available to large developers and large property owners thru the Specific Plan process.
