Section 66020 of the Government Code asserted by Assembly Bill 3081, effective January 1, 1997, requires that this District provide (1)'a written nonce to the
project appellant, at the time of payment of school fees, mitigation payment or other exactions ("Fees?% of the 90 -day period to protest the imposition of these
Fees and (2) the amount of the fees. Therefore, in accordance with section 66020 of the Government code and other applicable law, this Notice shall serve to
advise you that the 90 -day protest period in. regard to such Fees or the validity thereof, commences with the payment of the fees or performance of any other

Greg we request an extension of the building permit for 180 days until April 12, 2010.
Mr. Rise originally put the project on hold, because of.the uncertainty of the financial
markets. Mr. Rise, for cost savings reasons; has now omitted the detached guest
house and extra detached garage. We recently resubmitted the plans for plan check.,
and after approval by the City Mr. Rise is ready to begin the project.
The current extension expires on October 12, 2009. We will not be ready for our
plumbing ground waste inspection before the current expiration date. Therefore we
respectfully request the building permit extension.

Final Design Review with Modifications & Owner/Contractor Meeting
Dear Mr. Demetriou:
The Design Review Committee met to review your revisions to the Final Design Review
submittal previously received for review in 2008. The nroiect was approved for you to begin
construction. However, there are some items on the plans which will need to be modified in the
field. Please review the notes listed below which encapsulate our DRC review .and on-site
meetings with Scott Birdwell.
Architectural
1. The side yard building encroachment was previously, approved by management and
therefore is acceptable to the DRC as submitted.
2. The rear yard building encroachment was previously approved by management and
therefore is acceptable to the DRC as submitted.
3. The removal of the Casita and Guest Garage was approved as submitted.'
Landscape
1. The adjacent lot (J) and the golf course landscaping must be • included on the plans for a
full review of the proposed improvements. A final, review of the transitional planting
cannot be completed without this information:
2. The proposed design showsmany of the trees planted very close together. This may create
a maintenance issue as well as an aesthetic issue as the trees may grow into one another.
Please explain the design intent and/or remove some of the trees which will be a cost
savings for Mr. Rise.
3. There are trees shown in the neighbor's view corridor. No trees or plant material over 3'
in height may be utilized in the rear view corridors unless the adjacent neighbor has
provided written acceptance of the proposed design.
4. Landscape lighting is still being proposed in the, rear yard — off property. All lighting must
occur within the property line boundaries:
Grading
1. The grading plan indicates a substantial amount of grading over the rear property line and
into the golf course property. The revised plans submitted for review indicate that grading
will occur up to •35' from the rear property which is consistent with an Agreement made
with Discovery on behalf of the golf club. Therefore the design is acceptable to the DRC
as submitted.
2. The grading plan is not consistent with the landscape plan as it relates to the proposed
grass area on the golf course property. It appears that the grass area is intended to be a
have a maximum slope of two percent however this does not appear to work on the

grading plan. The edge of the grass, as it approaches the golf course, appears to increase to. a 16
percent slope which will have a very strong visual impact as viewed from the golf course. Please
modify the plans to be consistent for record keeping purposes.
3. Not all wall heights were provided but they are necessary for review that all heights are consistent
with the Design Guidelines.
Site
1. The pool is proposed in the rear natural area with the coping touching the rear property line. The
pool deck hardscape appears to extend into the golf course property as much as five feet. It is the
understanding of the DRC that this encroachment has been approved by Discovery on behalf of the
golf club and therefore it is acceptable as submitted.
2. There were minimal site details provided. Critical details such as walls, gates and pool feature
elements (shown on the plan but not identified) are visible to public viewing and therefore need to
be submitted for review and approval.
3. As discussed, and agreed upon, the proposed retaining wall on the golf course property needs to be
further defined and detailed utilizing natural materials that relate to the golf course. In. addition, the
wall will be pulled back towards the house approximately 10 feet per a discussion in the field
between Mr. Rise and Scott Birdwell.
