Assistant City Attorney Van Ligten recommended an amendment to the proposed resolution adding Sub-section No. 5 to the Whereas clause under the heading, Extenuating Circumstances, providing language stating that the City has conducted a fact specific analysis of this particular project and finds that extenuating circumstances did exist in this case. 7 MOTION – A motion was made and seconded by Commissioners Bettencourt/Nieto to find the project categorically exempt under CEQA Guidelines 15301, Minor Alterations to Existing Facilities and adopt Planning Commission Resolution 2020- 005 subject to the Findings and Conditions of Approval as submitted and with the following additional finding: 5.Extenuating circumstances. The City has conducted a fact specific analysis of this particular project and finds that extenuating circumstances do exist to justify the placement of the facility at issue; specifically, the City has determined that the proposed equipment is the quietest that is reasonably available and coupled with the fact that the wall between the two properties provides further mitigation for any possible sound effects that are needed to be mitigated. Commissioner Bettencourt requested to recuse himself from the vote on the item due to his consultation with Anthony Petros of LSA Associates on the subject of Vehicle Miles Traveled Analysis Policy as it relates to property Mr. Bettencourt owns outside of the City of La Quinta within an unincorporated area of Riverside County. It was noted by the City Attorney’s Office that while no actual conflict existed, Commissioner Bettencourt recused himself in an abundance of caution to avoid any appearance of a conflict due to his prior work with consultants who had taken similar approaches to VMT analyses in the past. REPORTS AND INFORMATIONAL ITEMS - None COMMISSIONERS’ ITEMS Commissioner Bettencourt shared his disappointment in not being able to receive a hardcopy of the information provided in the Planning Commission agenda packet. Chairperson Caldwell commented on the meetings of the Short-Term Vacation Rental Ad Hoc Committee. Commissioner Proctor inquired as to whether the Planning Commission meetings might be able to be held in a conference room at City Hall or return to being held in the Council Chamber. STAFF ITEMS 1.UPCOMING PROJECTS UPDATE Planning Manager Flores presented the staff report regarding upcoming projects which is on file in the Design and Development Department. She also provided an update on the current status of conducting business at City Hall. Public Works Director/City Engineer McKinney provided updates about the SilverRock Venue Site; the La Quinta Auto Center area landscaping and signage; and improvements regarding the landscaping, restroom, and gates leading to the parking lot at the top of the Cove. Commission Secretary Wise-Latta announced her retirement and the Commission extended to her their gratitude for her service and best wishes for the future. EXECUTIVE SUMMARY •The September 8, 2020 meeting is the first regularly scheduled meeting of the Planning Commission (PC) for 2020/21. •Pursuant to La Quinta Municipal Code 2.06.050, the PC shall choose a member to serve as Chairperson and a member to serve as Vice Chairperson for the fiscal year. BACKGROUND/ANALYSIS In accordance with La Quinta Municipal Code 2.06.050, “unless otherwise provided by law, ordinance or resolution of the city council, each board, commission and committee shall choose one of its members as chairperson and one as vice chairperson at its first meeting held after June 30th of each fiscal year.” Pursuant to this section, staff has placed this item on the agenda for selection of a Chairperson and Vice Chairperson. THE DEPARTMENT HAS DETERMINED THAT THE PROJECT IS CATEGORICALLY EXEMPT UNDER CEQA GUIDELINES 15301, MINOR ALTERATIONS TO EXISTING FACILITIES. RECOMMENDATION Approve Minor Use Permit 2020-0004. EXECUTIVE SUMMARY •Teserra, on behalf of the Owner, applied for a Building permit to construct a new pool with associated equipment. •The pool equipment was proposed to be installed within the five (5) foot (ft) side yard setback. Proposing pool equipment within this setback requires Planning Commission approval of a Minor Use Permit (MUP). BACKGROUND/ANALYSIS On June 9, 2020, the Applicant applied for a Pool Building permit to construct a new pool and outdoor amenities, which included proposing pool equipment within the side yard setback (Attachment 1). Per La Quinta Municipal Code Section 9.60.075(C): “Mechanical equipment may be in a side yard of five feet BUSINESS SESSION ITEM NO. 2 13 or less if: … (2) if approved by the planning commission through a minor use permit if findings are made that extenuating circumstances exist”. The Applicant is requesting approval for this equipment due to site configurations and performance ability of the new units (Attachment 2). This performance ability includes noise efficiency, including typical noise levels ranging from 31- 43 dB from 9 ft away when operational, well below the City’s noise standard. The equipment is proposed to be set back four (4) feet from the west side property line wall, and measures three (3) feet in height, eight (8) feet in length running parallel to the house, and two (2) feet in width. The property line wall between the equipment and the neighbor to the west is a six-foot-high masonry block wall. The neighbor’s house is set back seven feet from the masonry block wall (Attachment 3). The existing wall would help with noise attenuation. City Building and Fire staff reviewed the proposed location and found the location to be acceptable in providing adequate egress and emergency access, meanwhile meeting all product specifications (Attachment 4). None of the bedrooms and the emergency egress windows are in a location that would impede egress through the egress court as affected by the new locations of the condenser units. PUBLIC REVIEW Per La Quinta Municipal Code Section 9.60.075(C), notification was provided to adjoining impacted property owner ten days prior to this meeting. No comments have been received. ENVIRONMENTAL REVIEW The Design and Development Department has determined that the project is categorically exempt under CEQA guidelines 15301 – Minor Alterations to Existing Facilities. Minor Use Permit WHEREAS, upon hearing and considering all testimony and arguments, if any, of all interested persons desiring to be heard, said Planning Commission did find: 1.Consistency with General Plan. The land use is consistent with the general plan. 2.Consistency with Zoning Code. The use is consistent with the provisions of this zoning code. Pool equipment is allowed within the side yard setbacks with approval of a minor use permit. 3.Compliance with CEQA. The Design and Development Department has determined that the project is categorically exempt under CEQA guidelines 15301 – Minor Alterations to Existing Facilities. 4.Surrounding Uses. Approval of the application will not create conditions materially detrimental to the public health, safety and general welfare or injurious to or incompatible with other properties or land uses in the vicinity. The Village parking management program monitors parking demand by conducting parking surveys for on-street and off-street parking occupancy in peak season (January) and off-peak season (August). This report is intended to update the Planning Commission on the August 2020 off-peak season survey (Survey) results. There are 4,126 parking spaces available in the Village District (Attachment 1). Of these, 3,239 are off-street spaces, and 887 are on-street spaces. As a note, 54 spaces were removed from the parking spaces available due to construction of the new Starbucks along Washington and Tampico. Below are the results from the Survey compared with previous surveys: 1The Village Core Zone is bounded by Avenida Navarro, Desert Club Drive, Calle Tampico, and Calle Estado Given the current stay at home order and social distancing requirements, executed by the Governor of California in response to the state of emergency relating to novel coronavirus disease (COVID-19), the parking occupancy rates are the lowest observed since we initiated tracking in 2016. However, the village core area is still being utilized above 26 percent during peak times. The parking occupancy results demonstrate that there is adequate parking throughout the Village. 8/27/20 Page 4 of 4 33 34 City of La Quinta PLANNING COMMISSION MEETING STAFF ITEM TO: Honorable Chair and Members of the Planning Commission FROM: DATE: SUBJECT: Carlos Flores, Senior Planner September 8, 2020 WIRELESS TELECOMMUNICATIONS INVENTORY UPDATE Wireless telecommunication facilities are governed by the requirements of the La Quinta Municipal Code (LQMC) Chapter 9.170, Wireless Telecommunication Facilities (facilities). New facilities require approval of a conditional use permit (CUP) by the Planning Commission and additions to existing facilities require approval of a minor use permit by Director Decision. Section 9.170.080 requires a ten-year review by the Planning Commission and the Planning Commission previously requested for this to be an annual occurence. The Planning Commission, in July 2017, July 2018, and July 2019 received status reports of approved facilities in the City of La Quinta for compliance with conditions of approval. Six facilities were out of compliance during the 2017 report, one facility was out of compliance during the 2018 report, and no facilities were out of compliance during the 2019 report. A total of 19 facilities are constructed and currently operational (Attachment 1). Staff conducted a visual survey during the week of August 17, 2020 of the facility locations and reviewed the condition of the facilities for compliance with conditions of approval. These facilities may be subject to revocation by the Planning Commission if the operation of the facilities is inconsistent with the conditions of approval. One facility was observed to be out of compliance with its CUP conditions of approval and has not had a final building permit. Staff has made contact with the facility operator to inform them of compliance issues and possible consequences. A summary of the status of the 19 operational facilities is provided in the table below as well as a detailed table in Attachment 2.
