AS AMENDED
ORDER OPENING AND ALLOWING LIMITED USE OF CHILD PLAY
EQUIPMENT AT CITY-OWNED PARKS
EFFECTIVE IMMEDIATELY

Pursuant to Chapter 2.20 of the La Quinta Municipal Code and City Council
Resolution No. EM 2020-001, the City Manager for the City of La Quinta
hereby ORDERS the following:
1. All child play equipment located on or at parks and recreational
areas owned by the City of La Quinta are hereby closed and to
be sealed off from public use until subsequent order from the
City Manager.
2. No person, child or adult, may touch or use the child play
equipment at parks and recreation areas owned by the City of
La Quinta for whatever purpose, whether that use is for the
purpose for which the child play equipment was installed or
otherwise.
3. After the California Department of Public Health authorizes the
re-opening of playgrounds and picnic areas (currently part of
“Stage 3” of the State Resilience Plan for re-opening industries),
and after cleaning and readiness for use as determined by the
City Manager, child play equipment located on or at parks and
recreational areas owned by the City of La Quinta may be
opened and available for public use in accordance with this
order and any notices, guidance, recommendations, or
requirements posted by the City of La Quinta. Once re-opened
by the City, any person, child or adult, who may use the child

play equipment at parks and recreation areas owned by the City
of La Quinta is strongly recommended to use and observe
applicable state guidance to minimize the spread of COVID-19,
including but not limited to social distancing, washing hands
frequently, refraining from or limiting the touching of high-
contact surfaces, and use of a face covering. For purposes of
this order, “social distancing” means maintaining at least 6 feet
of distance from other people (except from those who live in the
same household). For purposes of this order, “face covering”
includes scarves (dense fabric, without holes), bandanas, neck
gaiter, or other fabric face coverings or masks that cover the
mouth and nose; provided, however, persons are discouraged
from using Personal Protective Equipment (PPE), such as N95
masks, for non-medical reasons. A face covering should be
washed after use.
4.The Assistant to the City Manager is hereby directed to
coordinate, deploy, and monitor the sealing off, and eventual
re-opening and use of,child play equipment subject to this
Executive Order with notices to the public and any other
reasonable means necessary or appropriate to effectuate this
order.
5. This order shall remain in effect until terminated or amended by
subsequent order from the City Manager.
This Executive Order is issued because a Local Emergency, as defined in
Section 2.20.020 of the La Quinta Municipal Code, has been proclaimed by
the City Council of the City of La Quinta to exist due to the threat of the
existence and spread of novel coronavirus disease 2019 (COVID-19) in and
throughout the city. All of the findings set forth in the recitals to Resolution
No. EM 2020-001 adopted by the City Council are hereby incorporated by
reference into this Executive Order.
This Executive Order is issued, pursuant to Sections 3, 5, and 8 of
Resolution No. EM 2020-001 and Section 2.20.100, Subsections (A) and (B),
of the La Quinta Municipal Code, under which the City Manager has the
authority and power to issue executive orders for any matters related to the
Local Emergency.
This Executive Order is issued in furtherance of the authority and power to
address the Local Emergency as provided in the California Emergency
Services Act, Chapter 7 (commencing with Section 8550) of Title 2 of the
Government Code, and implemented by Chapter 2.20 of the La Quinta
Municipal Code. Any violation of this Executive Order may be determined to
be a misdemeanor and punishable by a fine or imprisonment, or both,

pursuant to Section 8665 of the Government Code, Section 2.20.140 of the
La Quinta Municipal Code, and any other state or city law as may be
applicable.
