SUBJECT: SETBACK ADJUSTMENT FOR 54-430 EISENHOWER DRIVE 'W qo-QIS
Dear Mr. Lopez:
Your request for a setback adjustment to allow construction of
a swimming pool with a three foot setback (adjacent to the side
property. line) and four foot setback. (adjacent to the house)
has been reviewed and the following determined:
1. This adjustment is consistent with the intent and purpose
of the zoning ordinance.
2. There are special circumstances. applicable to the
property, including such factors as size, shape, and
location that justify approval of the adjustment.
3. This adjustment will not be detrimental to the health,
safety, and general welfare of the vicinity, provided all
pool equipment is maintained five feet from the side
property line and the equipment, is enclosed within a
noise -attenuating masonry enclosure.
Therefore, your request is approved subject to the following
conditions:
1. That the pool equipment shall be a minimum of five feet
from the side property line and shall be enclosed in a
masonry wall enclosure as required by Municipal Code
Section 9.42.050D(5)b.
2. Pool area is enclosed by fencing per . State law
requirements.
