SUBJECT: TEMPORARY USE PERMIT 2019-0002
TEMPORARY ART STUDIO 78095 CALLE CADIZ
Dear Mr. McQuaid:
The Design and Development Department has reviewed and approved your request to
operate an art studio using a temporary relocatable building at 78095 Calle Cadiz, per the
attached exhibits and information on file. Per La Quinta Municipal Code Section 9.100.180
Relocatable Buildings, a relocatable building is permitted within this zone. Per the submitted
information on file, the primary use of the building and site will be an art studio, which will
include storage of materials and outdoor artwork. This approval is subject to the following
Conditions of Approval:
1. The temporary use permit is approved for a period of two (2) years, with an
expiration date of March 11, 2023. Please note: This date may be pushed back if
building permit issuance for operation of building and associated work is delayed.
2. The applicant shall secure a bond in the amount of $1,100 to secure removal of
building if necessary. A draft bond agreement is attached to this letter.
3. The applicant shall work on securing a permanent plan for the project site. Six
months prior to expiration date (September 11, 2022) the applicant shall submit
a complete application for entitlement of the permanent project and/or indicate
that the relocatable building will be removed from the premises.
4. The use on the site shall be consistent with the uses provided to staff on file. This
includes no guest attending the site and it being solely used by the
owner/applicant and employees.
5. All operations, including outdoor operations, shall comply with the City of La
Quinta’s outdoor noise ordinance, per Section 9.100.210.
6. Separate permitting required from the Building Division for the container
placement & alterations, block walls and other site fencing, and any propane / gas
and electrical installations. All required building permit(s) shall be fully approved
prior to first use. This shall include approval from building, fire, and planning
division.
7. A fence surrounding the building, consisting of both masonry wall and corrugated
metal fence, is approved to surround the building. Changes to materials of the
fence shall be submitted to the planning division prior to installation for review.
8. Per site plan submitted, the exterior of the fence, particularly the corrugated metal
fence, shall include some landscaping.
9. The container is to be kept clean, tidy and free of debris or graffiti at all times.
10. Any building, structure, facility, complex or improved area, or portions thereof,
which are used by the general public shall be provided barrier free design to
ensure that these improvements are accessible to and usable by persons with
disabilities. The proposed facility shall comply with the California Accessibility
Standards defined in Title 24 Chapter 11B and Federal ADA Regulations as
applicable.
11. Show that the proper number of plumbing fixtures are being provided for the
proposed occupancy meeting the requirements of Chapter 4 of the California
Plumbing Code (CPC), Table 422.1 and Table-A.
12. City staff reserves the right to inspect the containers at any time to review
compliance with this permit. Staff may add, modify, or revoke this permit if not
in compliance with this permit or if activity is harmful to the public.
Adherence to these conditions, as outlined, will ensure that adverse impacts to surrounding
properties will be minimized. The City may elect to add conditions to this application to
mitigate any problems that arise not previously addressed herein.

FAITHFUL PERFORMANCE BOND

Temporary Use Permit Bond
WHEREAS, the City of La Quinta, California, is prepared to issue Temporary Use Permit #
2019-0002 in accordance with the La Quinta Municipal Code ,to Jason McQuaid as Principal, whereby
Principal will be authorized to install a temporary relocatable building in the permit, to privately-owned
property generally known to the City and others as 78095 Calle Cadiz; and
WHEREAS, Said Principal is required under the terms of the permit to furnish a bond to
insure removal of the building and restoration of the site, per La Quinta Municipal Code 9.100.180, in
accordance with the approved plans, specifications, and permit requirements; or, if the work is
abandoned (not completed as required), Principal shall correct or eliminate any hazardous conditions
that may exist.
NOW, therefore, we the Principal, as Surety, are held and firmly bound unto the City of
La Quinta, as Obligee, in the penal sum of One thousand one hundred Dollars ($ 1,100) lawful money of
the United States, for the payment of which sum well and truly to be made, we bind ourselves, our
heirs, successors, executors and administrators, jointly and severally, firmly by these presents.
The condition of this obligation is such that if the above bonded Principal, his or its heirs, executors,
administrators, successors or assigns, shall in all things stand to and abide by, and well and truly keep
and perform the covenants, conditions and provisions in the said permit and any alteration thereof
made as therein provided, on his or their part, to be kept and performed at the time and in the manner
therein specified, and in all respects according to their true intent and meaning, and shall indemnify and
save harmless the Obligee, its officers, agents and employees, as therein stipulated, then this obligation
shall become null and void; otherwise, it shall be and remain in full force and effect.
As a part of the obligation secured hereby and in addition to the face amount specified therefore, there
shall be included costs and reasonable expenses and fees, including reasonable attorney’s fees,
incurred by the Obligee in successfully enforcing such obligation, all to be taxed as costs and included
in any judgment rendered.
The surety hereby stipulates and agrees that no change, extension of time, alteration or addition to the
terms of the permit or to the work to be performed there under or the specifications accompanying the
same shall in anywise affect its obligations on this bond, and it does hereby waive notice of any such
change, extension of time, alteration or addition to the terms of the permit or to the work or to the
specifications.

Statement of Use
The intended use of this property is as a private art studio for Jason McQuaid and
Nicole McQuaid in the creation of artworks. There will be no public use as this will be a
space for creating and not a showroom or gallery for exhibit. Kilns used will be
powered by electricity and natural gas. Proper ventilation which includes an up blast
fan will be installed. All non combustible materials will be used for construction. Space
will be secured while not in use. There will be no public access.
