Dear Mr. Miller:
This letter is to report approval of your recent application
t- for a setback adjustment, pursuant to Chapter 9.188 of the City
of La Quinta Planning & Zoning Regulations. The following
setback adjustment has been approved subject to conditions and
in accordance with attached Exhibit A.
SETBACK ADJUSTMENT:
Five foot side & front yard setback reduced to three feet
• _ for the proposed pool.
FOR: Swimming Pool
CONDITIONS:•
1. The pool shall include reinforcing and be designed per
the Uniform Building Code requirements.
2. The perimeter block. wall shall be five feet high
(minimum).
3. Self-closing gates shall be installed which prevent
children from entering the property, etc.
4. A building permit shall be obtained.
6. Pool equipment shall be maintained 5 -feet from side and
rear property lines.
After review it was determined that:
1. This adjustment is consistent with the intent and purpose

2. There are special circumstances. applicable to the
property, including such factors as. size, shape,
topography, location or surroundings that justify 416
approval of the adjustment.' These special circumstances
are:
a. The lot is approximately 50 -feet x 100 -feet'
therefore, the usable yard area is very limited to
allow recreational opportunities abutting the home
(e.g. barbecue, sunbathing, etc.) and to provide,
pedestrian safety between the pool and the xu,,
residence.
3 This adjustment will not be detrimental .to .the health,. y
safety, and general welfare of the community or be
detrimental to property in the vicinity of the. parcel for
which the adjustment is requested.
