Dear Mr. Cunningham:
This letter is to report denial of your recent application for a setback adjustment,
pursuant to Chapter 9.188 of the City of La Quinta Planning and Zoning Regulations.
After review it was determined that:

1. This adjustment is not consistent with the intent and purpose of the zoning
ordinance with regard to setback adjustments.
2. There are no special circumstances applicable to the property, including such
factors as size, shape, topography, location or surroundings that justify
approval of the adjustment.
3. In 1991, the City granted temporary approval of your request to reduce the
rear yard setback from 10 feet to +2 feet during review of the model complex
(Plot Plan 90-452) provided the model home was reconstructed to meet the
existing R-1 Zoning Standards. Therefore, based on this agreement with the
City, please remodel the existing home to meet our current and/or past
standards.
