A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LA
QUINTA, CALIFORNIA, AUTHORIZING THE CITY MANAGER
TO EXECUTE A SIDE LETTER AGREEMENT WITH LA QUINTA
CITY EMPLOYEES ASSOCIATION TO IMPLEMENT AB 119
WHEREAS, Assembly Bill (AB) 119, requires public employers to provide
employee associations the right to access new employee orientations and names and
contact information of new employees in bargaining unit positions; and
WHEREAS, AB 119 exempts public employees' personal email addresses from
disclosure under the California Public Records Act; and
WHEREAS, In compliance with AB 119, the City met and conferred with La
Quinta City Employees Association and reached agreement on a Side Letter
Agreement.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of La Quinta,
California, as follows:
The City Manager is authorized to execute a Side Letter Agreement (Exhibit A)
with La Quinta City Employees Association implementing the provisions of Assembly
Bill 119 related to new employee orientation access to union representatives.
PASSED, APPROVED, and ADOPTED at a regular meeting of the La Quinta City
Council held on this 6th day of February 2018, by the following vote:

EXHIBIT A
Letter of Agreement
Between the City of La Quinta and the La Quinta City Employees Association
Re: AB 119
The City of La Quints (CITY) and the La Quinta City Employees Association (LQCEA),
hereby agree as follows:
1. The City will provide LQCEA with 10 -days advance notice of new employee
orientation unless there is an urgent need that is critical to the employer's operations
that was not reasonably foreseeable, and in that case the City will provide as much
advance notice of the employee orientations as possible.
2. The LQCEA President or his/her designee will be able to attend the new
employee orientation and be permitted up to 30 minutes at the end of the orientation
to meet with the new employee to discuss, among other things, the rights and
obligations created by the contract, and the role of the LQCEA, and to answer any
questions that the new employee has.
3. Within 30 days of hiring the new employee, the City shall provide the LQCEA
with the Payroll Deduction Form that includes the name, work phone, home/cell
phone, street address, date of hire, job title, and department of the new hire. The
City must also provide the LQCEA with a list of all of that information for all
employees in the bargaining unit at least every 120 days, upon LQCEA's request.
4. The parties agree to reopen this agreement upon LQCEA's request to meet
and confer regarding the City providing the personal email addresses on file with
the City of the new hire and current bargaining unit employees.
