It was a pleasure to discuss with you the above-referenced File/Escrow Number in
connection with the acquisition by Final Order in Condemnation of the fee interest in the property
commonly known as the Dune Palms Mobile Home Park. Per your request, this l etter
memorializes the final requests made by you and Stewart Title (as Title Officer), and my responses
thereto on behalf of the City of La Quinta (City) and La Quinta Housing Authority (Housing
Authority). I have also included attachments for your refer ence. Do not hesitate to contact me if
you have any questions, as I know that the City and Housing Authority would like to expeditiously
proceed to closing.
With that summary, please refer to the following:
The City and Housing Authority confirm that no appeals or objections have been
filed against the Final Order in Condemnation and Withdrawal of Lis Pendens, filed
on January 7, 2021 (Final Order), in Riverside County Superior Court Case No.
PSC 1503254. Four Seasons Escrow (as Escrow Holder) was sent, and should be
in possession of, a Certified Copy of the Final Order which will be ready for
recordation upon Closing of Escrow.
The City and Housing Authority confirm that Paragraph 1(f) of the Final Order has
a typographical error with the identified APN, which should read: 600-030-010, not
600-0330-010.
The City and Housing Authority confirm that the definition of “Remainder” in
Paragraph 1(f) of the Final Order means the fee simple interest of the entire real
property at APN 600-030-010, 46-600 Dune Palms Road, La Quinta, CA, as more

particularly described in Exhibit H of the Final Order, excepting therefrom the
items in clauses (i)-(iii) of said Paragraph 1(f).
Attached is the form of a Grant Deed with Reservation of Easements, a recordable
instrument that will effectuate the conveyance of the “Remainder” (i.e., the entire
fee simple interest at APN 600-030-010, 46-600 Dune Palms Road, La Quinta, CA,
as more particularly described in Exhibit H of the Final Order, excepting therefrom
the items in clauses (i)-(iii) of said Paragraph 1(f)) to the Housing Authority, with
a Reservation of Easements retained by the City for the “Roadway Easement
Parcel,” ““Bridge Easement Parcel,” and “Bridge TCE Parcel,” as identified,
described, and defined in Paragraphs 1(a)-1(e) of the Final Order (collectively, the
Easement Areas). The Escrow Holder will be instructed, and by copy of this letter
hereby is instructed, to record the Grant Deed with Reservation of Rights and
Easements immediately after the recording of the Final Order. Please confirm that
this form of the Grant Deed with Reservation or Easements meets with your
approval so that it may be executed and notarized and delivered to the Escrow
Holder.
Attached are the approvals of the La Quinta Housing Authority Board of Directors
for the acquisition of the “Remainder” (i.e., the entire fee simple interest at APN
600-030-010, 46-600 Dune Palms Road, La Quinta, CA, as more particularly
described in Exhibit H of the Final Order, excepting therefrom the items in
clauses (i)-(iii) of said Paragraph 1(f)); specifically:
o Resolution No. HA 2020-001, adopted June 16, 2020, which is the Housing
Authority’s approval of the FY 2020-21 Budget and the revenues and
expenditures therein; the 2020-21 Budget, Page 19, line item 249-0000-
74010, “land acquisition” authorized the capital expense for the acquisition
of the Dune Palms Mobile Home Park [see high-lighted item];
o Minutes from the Tuesday, May 19, 2020, Regular La Quinta City Council
Meeting, reporting out of closed session on the City Council’s approval of
the Settlement Agreement for the acquisition of the Dune Palms Mobile
Home Park, including the all-inclusive purchase price and acquisition “by
use of restricted affordable housing funds” [see high-lighted items].
Finally, please confirm, as we discussed, that the final policy for title insurance will insure
the “Remainder” (i.e., the entire fee simple interest at APN 600-030-010, 46-600 Dune Palms
Road, La Quinta, CA, as more particularly described in Exhibit H of the Final Order, excepting
therefrom the items in clauses (i)-(iii) of said Paragraph 1(f)), in the name of the La Quinta
Housing Authority, and the interests and easements in the Easement Areas to be retained and

A regular meeting of the La Quinta City Council was called to order at 3:01
p.m. by Mayor Evans.
This meeting was held by teleconference pursuant to Executive orders N-25-
20, N-29-20, N-33-20, and N-35-20, executed by the Governor of California
in response to the state of emergency relating to novel coronavirus disease
2019 (COVID-19) and enabling teleconferencing accommodations by
suspending or waiving specified provisions of the Ralph M. Brown Act
(Government Code § 54950 et seq.).

REPORT ON ACTION(S) TAKEN IN CLOSED SESSION:
City Attorney Ihrke said the City Council considered the Closed Session items
out of Agenda order and reported the following pursuant to Government Code
Section 54950 et seq. (Brown Act):
CLOSED SESSION ITEM NO. 3 – the City Negotiator provided the City
Council with an update on labor negotiations, and pursuant to
Government Code Section 54957.1, subdivision (a)(6), negotiations
between the City and the La Quinta City Employee’s Association have
concluded, and the proposed Side Letter Agreement resulting from the
negotiations is on the Agenda tonight as Business Session Item No. 1
for review and consideration; and
CLOSED SESSION ITEM NO. 1 – the City Council discussed the threat
to public services and closure of facilities caused by the threat of the
spread of novel coronavirus disease 2019 (COVID-19), and received an
update on Round II COVID-19 Small Business Emergency Economic
Relief Program (Program), previously authorized by the City Council on
May 5, 2020, consisting of the Ad-hoc Committee’s recommendations
on the applicants who would be awarded loans under the Program.

and other relevant hygiene practices, in order to limit the spread of
COVID-19. Motion passed unanimously.
MOTION – A motion was made and seconded by Councilmembers
Radi/Sanchez to express Council’s support of the “Safer Together.
Greater Together.” Tourism Pledge as drafted and developed by the
Greater Palm Springs Convention and Visitors Bureau, and to proceed
accordingly. Motion passed unanimously.
CLOSED SESSION ITEM NO. 2 – pursuant to Government Code
Section 54957.1, subdivision (a)(3), the City Council received and
reviewed a copy of a settlement agreement from the defendant, Chin
Family Properties Limited Partnership (Defendant), the substance of
which involves the settlement of the pending eminent domain case and
acquisition of real property for right of way, preservation of housing
stock, and other public purposes.
The Substance of the settlement agreement is summarized as follows:
The pending roadway right-of-way and bridge project right-of-way
properties would be acquired by the City along with the remainder
of the real property (land and amenities) owned by the Defendant
at 46400 Dune Palms Road, commonly known as the Dune Palms
Mobile Home Park; and
Except for the right-of-way portions of the real property, there
would be no change in use, no relocation of mobile home park
residents, and no other modifications to existing tenants’
leaseholds interests by entering into this agreement; and
Public purposes for acquisition of mobile home park include
meeting current and projected Regional Housing Needs
Assessment (RHNA) numbers, preserving and promoting
affordable housing, and facilitating Senate Bill 330 (2019)
compliance; and
All-inclusive purchase price for the real property is $6,125,000 to
be acquired by use of restricted affordable housing funds; and
Part of the purchase price would be deposited into the state-
administered condemnation fund and would be used to acquire
the right-of-way, even if escrow does not close for the mobile
home park; and
Acquisition of all real property would be through an independent
escrow, with a due diligence period of 180 days, following the
opening of escrow, which would allow for environmental
inspection and other inspections; and
City has sole discretion to approve the inspections and accept any
conditions on title; and

Multiple representations and warranties for the City’s benefit are
provided by the Defendant concerning the condition of the real
property, as the property will be accepted “as-is” except as
provided in the agreement; and
If the City does not acquire the entire real property for the mobile
home park, the agreement allows the eminent domain action to
proceed for final roadway and bridge project right-of-way
acquisition.
MOTION – A motion was made and seconded by Councilmembers
Radi/Sanchez to approve and execute the settlement agreement subject
to non-substantive corrections for signature blocks for Defendant, and
other non-substantive corrections for insertions to exhibits. Motion
passed unanimously.
If and when the settlement agreement is completely signed and final,
upon inquiry of any person, the terms and conditions of the agreement
are subject to disclosure and would be available for inspection as a
public record.
Council encouraged businesses to partake in the CVB’s Tourism Pledge.
Council noted that the public comments received from the residents do not
fall on deaf ears, and Council is here to serve the community, and do what is
in the best interest and safest for the entire community.
Council noted Memorial Day is coming up, and the community will honor those
we’ve lost over the years that have served our country and have allowed us
to live in the freedoms that we are trying to get more of during this pandemic.

There being no further business, a motion was made and seconded by
Councilmembers Radi/Fitzpatrick to adjourn at 10:34 p.m. Motion passed
unanimously.

RESOLUTION NO. HA 2020 – 001
A RESOLUTION OF THE HOUSING AUTHORITY OF
THE CITY OF LA QUINTA, CALIFORNIA,
APPROVING FISCAL YEAR 2020/21 BUDGET
WHEREAS, each year the La Quinta Housing Authority adopts a Budget
for Revenues and Expenditures for the upcoming Fiscal Year; and
WHEREAS, the Housing Authority desires to make provisions for a level
of services commensurate with the needs of the City; and
WHEREAS, the Housing Authority has reviewed said budget and has had
several public meetings to receive public input; and
WHEREAS, the Housing Authority has, after due deliberation and
consideration, made such amendments in the proposed budget as it considers
desirable; and
NOW, THEREFORE, BE IT RESOLVED by the La Quinta Housing
Authority to adopt, as follows:
SECTION 1. The Fiscal Year 2020/21 Budget, which is on file with the La
Quinta Housing Authority Secretary is hereby approved.
SECTION 2. Budget adjustment procedures are approved as follows:
A. Additional appropriations and the transfer of cash or unappropriated fund
balance from one fund to another shall be made only upon Housing
Authority approval.
B. Transfers of budgeted appropriations between divisions or capital projects
shall be made only upon Housing Authority approval.
C. Transfers of budgeted appropriations between accounts within a division
or capital project may be made with the approval of the Executive
Director or his designee.
D. Prior year budget continuing Appropriations and Encumbrances for
unexpended capital project appropriations remaining from uncompleted
prior year capital projects shall be made with Executive Director
approval. These carry-over appropriations are for prior year Housing
Authority approved capital projects and shall not exceed the approved
project budget.

FOR A VALUABLE CONSIDERATION, receipt of which is hereby acknowledged, the
CITY OF LA QUINTA, a California municipal corporation and charter city (the “Grantor”), does
hereby grant to the LA QUINTA HOUSING AUTHORITY, a public body, corporate and politic
(the “Grantee”), all of Grantor’s right, title, and interest in the fee interest in that certain real
property located in the City of La Quinta, County of Riverside, State of California, commonly
known as APN 600-030-010, 46-600 Dune Palms Road, La Quinta, California, and more
particularly described in the legal description attached hereto as Exhibit A and incorporated herein
by this reference (collectively, the “Property”), subject to Grantor reserving right, title, and
interest in the following:
1. A permanent easement for street and public utility purposes over some 2,610 square
feet of the Property, more specifically described in Exhibit B attached hereto and
incorporated by this reference and depicted in the map attached hereto as Exhibit C and
incorporated by this reference (the “Roadway Easement Parcel”); and
2. A permanent easement for street and public utility purposes over some 3,040 square
feet of the Property, more specifically described in Exhibit D attached hereto and
incorporated by this reference and depicted in the map attached hereto as Exhibit E and
incorporated by this reference (the “Bridge Easement Parcel”); and
3. A temporary construction easement over some 13,508 square feet of the Property, more
