I want to thank you for this letter today. This explains the property lines and provides us with
information that we are able to present to our HOA Powerstone Management and HOA Board. These
are very difficult situations and we do want to follow the regulations.

Hello,
Per our conversation, a couple points of clarification:
Per the diagram below, if the AC is placed in the yellow highlighted area, BEHIND the red line (which is supposed to be in
line with the garage), then it is acceptable as far as planning is concerned. You can see from that diagram as well that
your property line is five (5) feet away from where your current garage is. Setbacks for AC equipment are from property
lines.
If you are unable to place the AC in that area and have explored alternate options, and would like to place it again in
original location, you may revisit that (however, HOA review will still be necessary). A barrier placed in that area, such as
a block wall, is an option anywhere within your property. If the wall is non‐retaining and under 3’, no permit required.

Good Morning Linda,
Thank you for your email, the Stockings have also emailed us an incident report. If there are
criminal activities such as harassment or assault happening on your property you should contact the
Riverside County Sherriff's Department. The HOA will not be involved in anything other than the a/c
installation which we have scheduled an appeal as explained in this email sent to you last week. The
Board of Directors hopes to have the a/c issue resolved as soon as possible and according to the
associations governing documents policies and procedures. We have communicated the same to the
Stockings.
This issue has been carried on longer than we all wish, but as you are now aware, asking for
forgiveness rather than permission has it's ramifications and because of that we must follow the
processes set forth in the associations governing documents, which takes time. We all want resolution
and are working as quickly as possible for one.
You will have to determine with the city if the marking is the 5ft. Speaking with Carlos from the
city, your garage wall is the 5ft but again, confirm with him or the city. You will have to follow the
architectural process and procedure to install plants or a wall. Once you have approval you can than
make the exterior modification to your home. Part of the arch approval process is a contingent approval
based off of the City of La Quinta’s permit and approval process, if applicable to your exterior
modification. The architectural committee and board of directors trust that once an owner receives

approval they ensure all permits and permissions required from the city are received prior to said
modification.

This morning around 11:35 AM.,Mr. Glenn Stocking came out of us his house and
verbally confronted me. We need to know if the property line on curb is the correct
marking that is 5 feet from our garage wall. Does this mean we can plant or remove
plants per Architectual Committee or put up a

small wall from existing side wall?
We are also looking for help to mediate this situation, facilitate communication and
acting as a neutral liaison. He seems very angry, upset, and threating to sue us.

at the clubhouse. This is an open session meeting that will be noticed to the association as required by
Civil Code. This open session will have your appeal on the agenda with no other matter for discussion
other than the homeowners open forum another requirement set forth by Civil Code. We look forward
