The decision was based partly off the HOA that but also based off our own assessment. We essentially concurred with
the HOA assessment and the HOA review provides another layer for us to say it shouldn’t be allowed. I’m not aware of
an appeal process we have for this, if the applicant wishes to do so we can explore if that’s possible. It would then at
that point perhaps go to a Planning Commission or Council meeting, but again not sure exactly what it would be.

The City did not approve of the permit. We provided the following to the owner: “BMCH2021‐0313 is not approved as it
is currently proposed. Due to this, please have the equipment removed immediately as it is out of compliance. If you
wish to still install this equipment, you can reapply for the building permit with the equipment in a different location.

My understanding is the owner is looking to appeal. On our end though, we are looking for the equipment to be
removed and not functional.
