CONSENT CALENDAR ITEM NO. 1 5 Street vacation proceedings may be initiated by the City Council pursuant to Chapter 3, Part 3, Division 9 of the Streets and Highways Code of the Streets and Highways Code. California Government Code Section 65402 requires that prior to streets being vacated by the City Council, the Planning Commission make a finding that the proposed right-of-way vacation is consistent with the City’s General Plan. The right-of-way proposed to be vacated is not needed for street purposes. No utility agency has requested easements over the proposed street vacation area and no utility agency has objected to the street vacation proposal. BACKGROUND/ANALYSIS The proposed street vacation area (Attachment 2) on Avenida Morales was dedicated for public use on the subdivision map for Santa Carmelita at Vale La Quinta, Unit No. 2 in 1934. When the City constructed Avenida Morales under Assessment District 92-01, an area was created that is not needed for street purposes. A building permit to construct a pool and spa in front of the house at 51780 Avenida Morales is put on-hold until this street vacation is approved and recorded. No utility agency has requested easements over the proposed street vacation area and no utility agency has objected to the street vacation proposal. The proposed street vacation is consistent with General Plan goals and policies relating to circulation. Additionally, the General Plan recognizes the need for flexibility in applying and adapting roadway design standards and specifications, and authorizes the Public Works Director to make consistency findings to permit modifications that do not compromise the operational capacity of the subject roadway or intersection. The proposed street vacation area is no longer needed for street purposes and can be conveyed to the underlying property owner without compromising the operational capacity of the roadway. AGENCY AND PUBLIC REVIEW Public Agency Review This request was sent to all public utility agencies and Planning Division for review. No utility agency has requested easements over the proposed street vacation area and no utility agency has objected to the street vacation proposal. 6 Environment Review The Design and Development Department has determined the proposed action is categorically exempt under the California Environmental Quality Act (CEQA), Section 15301 (c) – Class 1, pertaining to existing highways and streets, in that the vacation of the subject right-of-way will not result in a direct or reasonably foreseeable indirect physical change in the environment. EXECUTIVE SUMMARY The applicant has proposed a second amendment to SDP 2004-816, for nine (9) new architectural plan types and change in square footages for the remaining 60 single-family homes (Attachment 3). The project includes a Minor Adjustment to reduce the rear yard setback requirement for two (2) residential lots. The Planning Commission (Commission) held a public hearing on January 11, 2022, where the project was continued to a date certain, February 8, 2022, to allow the applicant additional time to address the concerns from Commission and public comments. GENERAL PLAN 19 BACKGROUND/ANALYSIS On October 26, 2004, the Piazza Serena development architecture was approved for 97 single-family residential development within a ~37-acre project site located on the northwest corner of Avenue 58 and Monroe Street by the City of La Quinta City Council (Attachment 2). After a change in market conditions, the project architecture was updated, which was approved on January 22, 2008, by the City Council, for the remaining single-family homes. A total of 37 homes have been constructed, leaving 60 single-family homes remaining to be built. The amended SDP2007-895 approval was never used for any of the units. At a January 11, 2022, public hearing, the Commission had comments on the newly proposed applications. Most notably, the Commission and public raised concerns regarding the proposed reduction of square footage of the homes and architectural styles. The public hearing was continued to give the Applicant time to address these concerns and revise the architectural package accordingly. The following tables show the changes between the originally approved plans, January 11th architectural package and the updated, currently proposed architectural package, identifying all of the components that make up the total square footage of each plan. The architectural style incorporates elements from the existing homes such as corbels, flat tile roof, stone finish (Attachment 3, page 3), Condition No. 7 was added to address concerns with the Monroe Street landscaping enhancements reading: “Prior to Certificate of Occupancy of the 1st for-sale home the landscaping improvements along Monroe Street shall be installed.”, and The applicant revised their construction plans to show access using the emergency access gate. Staff has confirmed with Fire, Building, and Public Works/Engineering divisions that utilizing the emergency access gate for construction ingress/egress is acceptable. 22 Minor Adjustment The project proposes a Minor Adjustment (MA) from the 20 foot minimum rear yard requirement from La Quinta Municipal Code (LQMC) Section 9.50.030, Residential Development Standards. The project proposes two residential homes with an 18 feet 4 inches rear yard setback and 18 feet 3 inches rear yard setback on Lots 9 and 40 (Attachment 3, Page 40). The MA is being requested due to the size and shape of the project site which provides a constraint on these two lots. The floor plan proposed for both lots is the shallowest single-story plan that will be offered in the community and fits on all typical lots in the tract, however in the case of Lots 9 & 40, the plan does not fit due to the atypical condition of the lots. The minimum rear setback required is 20 feet. As plotted, they are requesting a minor setback adjustment approval for Lot 9 to have an 18 feet 3 inches rear yard setback and Lot 40 to be 18 feet 4 inches. This request produces a rear yard setback adjustment of less than 9% per lot. The applicant attempted various plotting scenarios by shifting the footprint to meet the desired setback but were unable to achieve the minimum setback standard. AGENCY AND PUBLIC REVIEW Public Agency Review This request was sent to all applicable City departments and all applicable comments have been adequately addressed and/or incorporated in the recommended Conditions of Approval. Public Notice The public hearing notice was advertised in The Desert Sun newspaper on December 30, 2021, and was sent to property owners and occupants within a 500-foot radius of the project site. Since the project was continued to a date certain, a second public notice was not required.
