SUBJECT: APPROVAL LETTER- MUP 2021-0025 KAREN MUSMECI BED &
BREAKFAST
Dear Ms. Musmeci:
The City of La Quinta Design and Development Department has reviewed and
approved Minor Use Permit 2021-0025 for a Bed and Breakfast facility located at
78470 Singing Palms Drive in an existing home. The following findings can be made
as required by the La Quinta Municipal Code Sections 9.60.270 Bed and breakfast
regulations and 9.210.025 Minor Use Permits:
1. Consistency with the General Plan: The land use is consistent with the general
plan. The proposal does not alter the approved land use for the property or
affect land use on surrounding similar properties. It is consistent with the
general plan goals and policies regarding balanced and varied economic base
with a range of businesses and providing a broad range of goods and services
to the community.
2. Consistency with Zoning Code: The proposed use is consistent with the
provisions of the Low-Density Residential District zoning designation and
requirements of La Quinta Municipal Code Section 9.60.270 Bed and Breakfast
regulations. The intent of the Bed and Breakfast facilities is to provide small
commercial lodging facilities in residential districts.
3. Compliance with CEQA: Processing of this Minor Use Permit complies with the
provisions of the California Environmental Quality Act. The Design and
Development Department has determined that this project is exempt from
environmental review pursuant to Section 15301 (Class 1) of the California
Environmental Quality Act for existing facilities since the residential home is
already existing and no modifications are being proposed.
4. Surrounding Uses: Approval of the application will not create conditions
materially detrimental to the public health, safety and general welfare or
injurious to or incompatible with other properties or land uses in the vicinity.
The location is appropriate for the proposed use. Conditions have been added
to ensure that the operation will not be detrimental to the public health,
safety, and general welfare with other properties.
The Minor Use Permit is subject to the following conditions of approval:
1. The applicant/property owner agrees to defend, indemnify, and hold harmless
the City of La Quinta (the “City”), its agents, officers and employees from any
claim, or litigation arising out of the City’s approval of this project. This
indemnification shall include any award toward attorney’s fees. The City of La
Quinta shall have the right to select its defense counsel in its sole discretion.
The City of La Quinta shall promptly notify the applicant of any claim, action, or
proceeding and shall cooperate fully in the defense.
2. Per La Quinta Municipal Code (LQMC) Section 9.200.130, the use permit may
be modified or revoked at any time by the Design and Development Director,
City Council, or Planning Commission, should they determine that the proposed
uses or conditions under which it is being operated or maintained is detrimental
to the public health, welfare, or materially injurious to property, or
improvements in the vicinity, or if the property is operated or maintained, so
as to constitute a public nuisance.
3. The Bed and Breakfast shall be conducted only by a person owning the dwelling
and residing therein as their principal place of residence. The use permit shall
be voided upon the sale or transfer of the property ownership.
4. The applicant shall obtain and secure a city business license prior to operation.
5. Operation of the Bed and Breakfast shall be consistent with the existing site
plan and operations on file with the Design and Development Department.
6. Advertisements for rental of the Bed and Breakfast shall be consistent with the
existing site plan and operations on file and all other conditions of approval
contained in this letter.
7. The Bed and Breakfast shall accommodate a maximum of four guests in two
guest rooms.
8. The individual guest rooms used for renting purposes shall not contain cooking
facilities.
9. Signs shall not exceed two square feet attached to the house.
10. The Bed and Breakfast shall be subject to all applicable provisions of Chapter
3.24 of the municipal code (Transient Occupancy Tax).
11. The City may conduct an onsite inspection of the property to verify compliance
at any time. This may include, but not be limited to, inspections by the City’s
Fire department for compliance with some alarms for renters and Staff review
of premises to review operations of bed and breakfast.
12. Any complaints about the operations of the Bed and Breakfast shall be
responded to in a timely manner.
13. If the applicant wishes to revise this Minor Use Permit, they must make this
request in writing to the Design and Development Department who will
determine its applicability and whether a new Minor Use Permit will be required.
This decision may be appealed to the Planning Commission by any party who
submits the necessary paperwork and filing fee of $1,526.00 to this office within 15
days of the date of approval of this permit. If you have any questions, please contact

Our property at 78470 Singing Palms Drive in la Quinta is intended to be used as a bed and
breakfast to be called "Happy Palm." There will be two bedrooms for use and dogs are
allowed.
Happy Palm is situated in a lovely neighborhood with mountain views. It is a prime location near
many popular tourist destinations and special event venues. It has a very large driveway
providing ample off street parking and ease of access.
The home has an excellent floor plan, the master is separated by the living room, providing a
great deal of privacy. The living room is large and comfy. The interior design includes fun and
interesting art created by me. I have done the la Quinta art festival almost 20 times.
Also, the house is on a large lot with a wonderful landscaped backyard great for dogs. It even
has a doggie door.
Our goal is to provide a clean, cozy, safe environment for all who come and stay. We want to
make our guests want to come back.
