PC Resolution 2022-005 Street Vacation 51780 Morales (Avenida) LAD 2021-0002PLANNING COMMISSION RESOLUTION 2022 - 005 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LA QUINTA, CALIFORNIA, FINDING THAT THE PROPOSED STREET RIGHT-OF-WAY VACATION OF A 150- SQUARE-FOOT PORTION OF AVENIDA MORALES FRONTING 51780 AVENIDA MORALES IS CONSISTENT WITH THE GENERAL PLAN CASE NUMBER: STREET VACATION LAD2021-0002 APPLICANT / OWNER: PATRICK AND LAURA O’CONNELL WHEREAS, the Planning Commission of the City of La Quinta, California did, on the February 8, 2022, consider the request for street right- of-way vacation of a portion of Avenida Morales fronting 51780 Avenida Morales by the applicant identified above; and, WHEREAS, the proposed vacation is exempt under Section 15301 (c) – Class 1 of the California Environment Quality Act (CEQA) Guidelines, in that the vacation of the subject right-of-way will not result in a direct or reasonably foreseeable indirect physical change in the environment; and WHEREAS, street vacation proceedings may be initiated by the City Council pursuant to Chapter 3, Part 3, Division 9 of the Streets and Highways Code of the Streets and Highways Code; and, WHEREAS, California Government Code (CGS) Section 65402 requires that prior to streets being vacated by the City Council, the Planning Commission make a finding that the proposed right-of-way vacation is consistent with the City’s General Plan; and, WHEREAS, said Planning Commission did make the following Mandatory Finding under CGS Section 65402 confirming that the proposed street right-of-way vacation is consistent with the City’s General Plan: 1. The proposed right-of-way vacation will have no environmental effects that adversely impact the human population, either directly or indirectly, because the street segment is currently unused by the public and inaccessible to vehicles; and secondly, the act of vacating the right-of-way will have no physical environmental effect. No utility agency has objected to the right- of-way vacation. 3.The portion of Avenida Morales fronting 51780 Avenida Morales is no longer needed for public street purposes. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of La Quinta, California, as follows: SECTION 1. That the above recitations are true and constitute the Findings of the Planning Commission in this case; and SECTION 2. That it does find the proposed right-of-way vacation LAD2021- 0002, as shown on Attachment 1, is consistent with the City’s General Plan for the reasons set forth in this Resolution. PASSED, APPROVED, and ADOPTED at a regular meeting of the City of La Quinta Planning Commission, held on February 8, 2022, by the following vote: AYES: Commissioners Caldwell, Currie, Hassett, McCune, Proctor, Tyerman, and Chairperson Nieto NOES: None ABSENT: None ABSTAIN: None
