front and exterior side yards. Property shows overgrown
vegetation which includes trees and shrubs. Also noted the
property has a broken side yard gate. Rear and side yard
wood fencing needs to be repaired and misc. items, debris
scattered throughout the yard needs to picked up and
removed. Business license in required for their Mobile Car
washing business. Also the oil and grease which in visible on
the street needs to be cleaned and properly discarded.
Courtesy Notice for these violations were posted on the front
door. (See Pictures). Also noted the property has a trailer
parked on the street. A Notice of Violation was posted stating
no parking on the street longer than 72hrs within a 7 day

tenant who was repairing a trailer which was parked on
the street. stated he has already been in talks with the
property owner to do the repairs himself or to hire someone to
do them for him. I advised he need to come into city hall

in the garage. stated the trailers are no longer being
stored at the residence and are take with him to work. I
explained I would be re-inspecting the property in 21 days and
needed to see progress or a citation would be issued. This

made since last inspection. I did speak with tenant who
stated the landlord is aware of the violations and is working on
fixing the issues. The property lacks ground cover to the front
and side yards. Trash container and misc item are stored
throughout the property. I addressed these violation with
who immediately began putting items into the backyard.
The fencing and gates on the property remain in disrepair and
need to be addressed. I also addressed the business license
and Home Occupation inspection with who stated he
would take care of it soon. I gave 30 day to resolved or show
progress in resolving these violations or I would be forced to
issue citations.

owner Maria Franco via telephone. I asked if she had received
the notices which were mailed to her Nevada address. She
said she had. I addressed my concerns regarding the property
and informed her there has been no progress or attempts to
resolve any of the violations. She was rather shocked
because her father had went by the property to check on
things before leaving out the country. Franco stated she would
contact the tenants have have the issues resolved as soon as
possible and will inform me throughout the process. This case

include wire fencing, plywood, plastic bucket, toilet, and a
dresser. The fencing continues to be damaged and in need of

have been made. I made contact with an individual working on
his truck in the street. He said he lives at the property and his
father was not home at the time. I asked how old her was,
which he replied 20. I asked for his ID, which he gave me. He
then asked why do you guys always give them a hard time. I
explained because there are continued violations, the case
will not be closed. I was able take his DL info and explained a
citation would be mailed for non compliance of a city business
license. I asked that he give the landlord my number also.

02/20/2019 0.25 Upon arrival of 53020 Avenida Diaz, I observed a new rear
yard wood fencing was installed. A female resident was seen
racking the front yard of any landscape debris. A large dead
tree which was seen on the north side of the property was
completely removed. The two large ficus trees were trimmed
by a profession landscaping company. A brand new metal
gate was installed on the side yard. The misc items which
were seen on the side yard have been removed, however a
few new items were now being stored on the side yard. (door).
I made contact with tenant who stated the door
and two patio chairs will be removed this week. He said a new
door was installed and the old one was placed on the side
yard by the installer. I asked about his business license, he
stated his business has been very slow and was
contemplating closing the business. I explained in our last
conversion I gave 30 day to obtain a business license If no
license is obtained a citation would be issued. I will continue to
monitor this property until all violations are corrected.

property maintenance violations which include, misc stored
items in public view. I also observed the landscape is in need
of routine maintenance. I also observed two vehcile parked on
the street with expired registration. The first vehicle is
described as a white F-150 which has been addressed before

been seen before but never addressed. I called tenant

maintenance and watering. I also observed multiple vehicles
on the street with expired registration. I contacted RSO to
assist in the case. Before Deputy Dimaggio. I made contact
with the tenant who stated he has been trying to
get the landlord to address the sprinklers, he said the landlord
will be here tomorrow and should have everything resolved. I
explained he would need to comply with the city municipal
code regarding trash containers and misc items. Deputy
Dimaggio arrived shortly after and ran the license plates of all
the vehicle on the street including the BMW on the driveway.
Dimaggio stated four of the six vehicle were unregistered and
could be towed immediately. The BMW showed expired and
had the wrong month sticker on the plate. Dimaggio gave 14
days to register all the vehicle on the list. Any vehicles not
registered will be towed from the street and citations will be
issued. This case will be rechecked for 14 days

01/08/2020 0.25 Upon arrival of 53020 Avenida Diaz, I observed misc items
stored on an inoperable trailer located on the side yard . I also
observed the trash containers and damaged or broken lawn
furniture stored on the side yard in public view. I noticed the
tenant and tenants son washing a vehicle on the street. I have
made contact with both on numerous occasions resulting in
non compliance. I now call the property owners father directly
and inform him of the violations. He calls his tenants and has
them clear the violations before additional citations are issued.

informed him, he had until end of business day to resolve the
property maintenance violations, which include stored debris,
trash containers in public view, and a non operational trailer
with a missing tire. He said he already informed the tenant last
week. He said he would call him again. While at the location
the tenant came out and asked why I continue to
visit his property. He said I cannot address anything because it
was private property. I informed him of the Cities Municipal
Code and explained why there were violations and how he
could correct them. proceeded to tell me that my
personal boat trailer at my home was also parked on the
gravel. He wanted to make a point to inform me that he knew
where I lived. I explained my boat trailer was parked on an
approved pad and is not missing any tires. I gave until the end
of business day to correct all property maintenance violations
asked that he display the registration on both vehicles located
on the driveway. This case will be rechecked for 01-17-2020

01/21/2020 0.25 53005 Avenida Diaz neighbor called and states
that this property is running a car washing business. He states
that he has spoken many times with Officer Rodarte and that
he has sent a letter 2 weeks ago regarding this car washing
business. He states that nobody cares and that we should be
getting taxes. He states that there is 5-6 cars there now and
that they use a power washer that is very noisy. He states that
he ran against Don Adolph and thinks that Mayor Evans
doesn't care because she was sponsored by JFK to win.Her
thanked me for calling him back.

Police due to the ongoing car washing business at this
property. He states that the City should collect taxes so that
they can buy retire and buy SilverRock. He states that he is
going to move due to it because the City cannot stop this.

property is running a business. I asked him if he knew the
outcome of the Police responding and he said that they were
back to power washing again an hour later. i asked him again
and he never answered. he repeated about the City collecting
it's taxes and that it isn't because they're Mexican. He went on
to say that the Mayor doesn't give a shit and I said Sir that
isn't true. The City is aware and advancing the case and the
Mayor is aware too, she received your letter. He asked what
does that mean advancing the case? He want to say that we
should at least collect the taxes over and over and that his
kids want him to move back to Newport Beach and that we
should make these people move back to Mexico where they
aren't required to have a b/l or do anything right. He said that
he'd leave since we don't care. I repeated that we do and he

01/30/2020 0.00 RSO received two calls regarding this property for noise
issues: #LA20 026 0028 (53-020 Avenida Diaz) Deputy
received a call for service reference subjects at location using
paint remover machine. On going issues. Deputy arrived and
contacted a subject outside cleaning his vehicles. Subject
stated his neighbor always calls. Deputy advised there were
vacuums being used at location. Subject stated Sundays are
the only days he can clean his home.
#LA20 026 0032- related to #LA28. Same complaint. This
information was provided and appears to confirm the r/p's
complaint of a possible car washing business occurring at the
property on the weekends. Since the last inspection at this
property it has come to the City's attention that the 17 year old
juvenile was a person of interest in a "negligent" discharge of
a firearm and apparently admitted to the offence but the
firearm has not been located. The juvenile and his Mother,

The father and son were seen loading furniture from one
flatbed trailer to another. He said the trailer was get loaded
and being taken to Mexico City. I advised them both of
multiple ongoing property violations which include trash
containers, misc. stored items throughout the front and side
yard, a non-operation trailer which is stored on the side yard.
This trailer also has items stored on it. There is a vehicle
parked on driveway on jack stands. He said the vehicle is on
jack stands because he is waiting on new brakes to come in.
He stated the vehicle is operational and currently registered.
Deputy Hughes ran the vehicle plate, it came back as current.
I address the golf cart and quads which were parked on the
sidewalk and street. He stated he just put them out because
they went riding yesterday and was planning on cleaning
them. He stated the quads are normally parked in the garage.
I also asked that the wood/ vinyl fencing coving the AC unit in
the front yard be replaced with approved material. I then
checked the remaining vehicles parked on the street and
found all to be currently registered. I gave
until Thursday to resolve all violations. I advised I would be
returning with a deputy to confirm all violations were
corrected.

Cherokee parked sideways on the driveway. The deputy
stated the vehicle is not illegally parked if it on its owner

the dog over to him and pick him up. stated his cousin
came over because his passenger side window would not roll
down, so he fixed it for him. I asked about the misc.

said he is working on that. I asked about the landscape. He
said the landscape has been sick, it should be trimmed next
week. I thanked for his time and after briefly speaking
with the deputy, left the area.

Villanueva to assist in the matter. I then contacted the

order to change out the windows. stated he will
start to pay a landscaper to address the yard. He stated he
was told that he would need to go to the Palm Springs
Courthouse to start the eviction process. He stated the
tenants owe ten months in back rent. He stated he would start
the eviction process. I gave 14 days to correct

Thank you for taking the time to talk with me regarding the property maintenance issues at 53020 Avenida Diaz.
I’m attaching a few photos so you may have an idea of some of the items that need attention. As I stated, we have
been attempting to gain compliance from the tenant with some assistance from your Father over the past couple of
years but the tenant has been unwilling or unable to completely comply. The current items to address are the
exterior front and side yard landscaping, the stored vehicles, the stored trailer in public view and the stored
miscellaneous items in the exterior front and side yard. Additionally, the neighbors have reported that the tenant
has been running a car washing business at the property, this was confirmed by the Police a couple weeks ago.
As I mentioned, the issues at the property have taken a turn in a more serious manner and Code Compliance
Officers can no longer make contact at the property due to safety concerns. This leaves the City with the option of
taking Police each time an inspection is needed which can become costly and may be charged against the property
to recoup those cost. Code Compliance may also submit the violations to the City Attorney for further legal action
through the Superior Court. Our preferred remedy would be to work with you as the property owner to correct the
issues in a more permanent manner. As we discussed, if proof of legal action to regain possession of your property
(eviction) is provided to the City in the next two weeks we will try and reframe from further legal action pending a
timely outcome.
I’ve attached the press release from the Sheriff’s Department that describes the more serious turn in activity at
your property that has lead Code Compliance to have to shift our enforcement efforts.

in contact with the property owner and believed they were taking action to permanently resolve the issue but due

Dear Ms. Franco:
It has come to our attention that you are the owner and/or have a legal interest in the
property located at 53020 Avenida Diaz in the City of La Quinta (“Property”). We have been
informed that the Property is in violation of several sections of the La Quinta Municipal Code
(“LQMC”). Under the LQMC, each owner of the Property is responsible to ensure that the
Property is in compliance with the applicable standards for maintaining properties within the
City.
The City has made an exhaustive internal effort to obtain voluntary compliance from you
including notifying you by way of notices of violations and administrative citations. However,
while you have had more than a reasonable amount of time to remedy the violations, no remedial
work has been done. Due to your failure to respond to these prior requests, it is apparent to the
City that you have chosen to ignore the City’s efforts. At this point, the City has turned the case
over to our office, acting in the capacity of City Attorney for the City of La Quinta, to handle this
matter.
The Property is in violation of the each of the LQMC sections set forth in the document
attached to this letter. You must bring the Property into compliance within the deadlines set
forth for each of the listed violations as set forth in the attachment.
We are providing you notice that “in accordance with Sections 17274 and 24436.5 of the
Revenue and Taxation Code, a tax deduction may not be allowed for interest, taxes, depreciation,
or amortization paid or incurred in the taxable year” for any property that is deemed a public
nuisance. (Cal. Health & Saf. Code § 17980(d).) Moreover, as required by law, we are hereby
providing you notice that it is unlawful for a lessor to retaliate against a lessee pursuant to
Section 1942.5 of the Civil Code for reporting a violation.
If you fail to bring the Property into compliance by the times prescribed above, the City

Corrections Required: Remove from public view all items/refuse, abandoned materials, or
unused objects or equipment. All such work must be completed and inspected by the City of La

7. LQMC § 3.28.030 - BUSINESS LICENSE REQUIRED
Corrections Required: A business license application must be completed and an annual business
license fee must be paid by all business(s) or person(s) conducting business within the City or a
sworn statement must be received stating that you are not, have not and will not engage in
business in the city. All unpermitted business activity must cease immediately.
8. LQMC § 11.72.030 (T6) - GASOLINE, OIL OR GREASE
Corrections Required: Remove all toxic materials and disposed materials at approved locations.
Oil and Grease which is visible on the street needs to be cleaned or discarded. All such work
must be completed and inspected by the City of La Quinta (after property owner calls for

9. LQMC § 9.60.130 (D-l) - RV STREET PARKING
Corrections Required: Immediately remove the recreational vehicle from public street location.
10. LQMC § 9.60.130 (D-2) - RV - COVE AREA
Corrections Required: To correct the violation, the recreational vehicle must immediately be
parked or stored in an area zoned for parking, on an approved pad and does not extend over any
rights-of-way, per Municipal Code.
11. LQMC § 6.04.050 (G) - CONTAINER STORAGE
Corrections Required: Immediately store trash containers out of public view except on pickup
day.

LICENSE REQUIRED
VIOLATION:
Subject to the provisions of this chapter, all businesses engaged in or
carried on in the city shall pay annual business license fees in the
amounts as provided in this chapter except where specific provisions are
made for daily, monthly, quarterly or semi-annual payments pursuant to
Sections 3.28.320 and 3.28.330 of this chapter. It is unlawful for any
person to initiate, transact, engage in , or carry on any business in the
city without first having obtained and paid for a valid business license,
or without complying with any and all provisions of this chapter
applicable to that business.
When any person shall by use of signs, circulars, cards, telephone book,
electronic media or newpapers, advertise, hold out, or represent that
s/he is in business in the city, or when any person holds an active
license or permit issued by a governmental agency indicating that s/he
is in business in the city, and such person fails to deny by a sworn
statement given to the collector that s/he is not conducting a business in
the city after being requested to do so by the collector, then these facts
sall be considered prima facie evidence that s/he is conducting a
business in the city.
CORRECTIVE ACTION: A business license application must be
completed and an annual business license fee must be paid by all
business(s) or person(s) conducting business within the City or a sworn
statement must be received stating that you are not, have not and will
not engage in business in the city.

VIOLATION: Gasoline, oil, grease, water or other materials flowing
onto a right-of-way or an accumulation of refuse, waste, grease and oil

fences.

FENCING MATERIALS
VIOLATION:
E. Fence Construction and Materials. All fencing in
residential districts shall conform to the following
construction and material standards:
1. Wood and Vinyl Fencing.

a. Except for gates, split two rail fencing, and
for equestrian fencing regulated by Section
9.140.060, wood and vinyl or similar recycled
fencing materials are permitted in rear or
interior side yards only, and only if not visible
from the street. Wood-framed fencing with a
stucco finish is a permissible in any location
on the lot provided the color of the masonry
or stucco matches or complements the
adjacent wall or structure. Gates may be of
wood in any location provided they comply
with the standards of this section.
b. All wood fencing shall be constructed of
not less than a grade of construction heart or
merchantable and better redwood or No. 2 and
better (no holes) western red cedar, stained or
painted to match or complement the adjacent
wall or structure. Alternatively, if left in
natural color, all wood shall be treated with a
water-repellant material.
c. All vinyl or similar recycled fencing
material shall be constructed of an aluminum-
reinforced non-reflective material that
contains antistatic and UV-radiation inhibiting
additives.
d. Fence boards may be horizontal or
vertical. Support posts shall be a minimum of
nominal four inches by four inches redwood,
pressure-treated lumber, tubular steel or block
and installed per the Uniform Building Code.

statement given to the collector that s/he is not conducting a business in
the city after being requested to do so by the collector, then these facts

business in the city.

material shall be constructed of an aluminum-
reinforced non-reflective material that
contains antistatic and UV-radiation inhibiting
additives.
d. Fence boards may be horizontal or
vertical. Support posts shall be a minimum of
nominal four inches by four inches redwood,
pressure-treated lumber, tubular steel or block
and installed per the Uniform Building Code.
