This letter is intended to accompany the attached Planning Application for a
Development Agreement, which is being submitted by CM Wave Development, LLC
("Applicant") in connection with its proposed Coral Mountain Specific Plan project
("Project"). The fees for this Application have been separately submitted by the Applicant in
accordance with City requirements.
Following initial conversations with City Staff and the City Attorney, we believe a
Development Agreement for the Project is in the best interests of both the City and the Applicant
to ensure that, if approved by the City, the Project will be implemented successfully by providing
certain assurances to the City and Applicant regarding the policies, rules, regulations and
conditions applicable to the Project. Specifically, we believe a Development Agreement can
address the following:
1. Ensure that despite the lack of property tax revenue to the City until 2035, the Project
will not have a negative net fiscal impact to the City;
2. Ensure that the issue of short -terms rentals is addressed for all uses and planning areas
within the Project;

3. Vest the Applicant's right to develop the Project subject to the rules, regulations and
conditions in effect at the time Development Agreement becomes effective, consistent
with the legislative purpose of the Development Agreement statutes (Government Code
Sections 65864 et seq.);
4. Ensure that all required infrastructure and public facilities are properly completed in a
timely manner to serve the Project and avoid impacts to the surrounding community; and
5. Address any other issues of concern to the parties that cannot otherwise be fully
addressed in the other Project entitlements and conditions of approval.
We look forward to working cooperatively with the City to develop a full list of proposed
terms for the requested Development Agreement, and we will make our team available for an
initial meeting at the City's earliest convenience.
