RECITALS
WHEREAS, ,Plaintiff City of La Quinta ("City") commenced this action on December 3,
2019, when it filed its complaint ("Cornplaine') seeking to quiet title to the fee interest in a small
parcel of land located in the City of La Quints, California, underlying the All -American Canal
("Canal"), subject to the Federal government's right-of:way:to maintain the Canal (the "Subject
Property");
WHEREAS, the Subject Property is located in the City of La Quinta, and is legally
described in the attached Emhibit A;
WHEREAS, the Subject Property specifically -.consists of the fee interest ownership of the
land underlying three separate parcels of real property all located in the City of La Quinta, County
of Riverside, State of California, located on the following parcels: Assessor's Parcel Number
("APN") 777-490-024 ("ParceI 1"), APN. 777=490-023 ("Parcel T% and:APN 777-060-008 f
("Parcel 3'�;
WHEREAS, as of the time this action was commenced, review of preliminary title reports
for the Subject Property obtained by Plaintiff identified names of parties with a potential interest
in the Subject Property including the named. Defendants herein;
WHEREAS, review of preliminary 'title reports for the Subject Property obtained by
Plaintiff shows the following entities potentially have an ownership interest in the Subject
Property as shown below:

WHEREAS, due to the nature of the Subject Propertyand the conveyances that impacted
the Subject Property to date, it is .unclear what portions of each parcel within the Subject Property
is described in each of the deeds listing the aforementioned individuals/entities, and as such, in an
abundance of caution, they were named as Defendants by Plaintiff as if the relevant conveyance
documents granted an interest .to the Defendants in the entirety of the listed parcel to which they
were named;
WHEREAS, the City filed this action to quiet title to the entirety of the interests held in the
Subject Property based on adverse possession-;
WHEREAS, the City's adverse possession claim is based on the occupation and use of the ,
Subject Property by the City and, its agents and invitees;
WHEREAS, the City has authorized the installation of certain bridges over and across the
Subject Property to gain access to the City's remaining property on either side of the Canal;
WHEREAS, no property taxes were assessed against the Subject Property for the previous
5-year period while the City and its immediate predecessors Jn-interest were exercising dominion
over the Subject Property;
WHEREAS, the named Defendants herein have either been personally served or served
through publication;
WHEREAS, with the exception of Defendant Ross A. Lee, none of the Defendants named
herein have appeared in this action;
WHEREAS, the City has made contact with certain children of some of the name
defendants, and whose children have. executed a quitclaim deed for any interest (including fee
interest) in the Subject Property to the City;
WHEREAS, Defendant Ross A. Lee and his sister Ms. Susan Miller have entered into a
settlement agreement with the City and executed quitclaim deeds conveying any interest

(including fee interest) they may have in the Subject Property to the City;
WHEREAS, defaults were entered as to all named Defendants except Ross A. Lee on May
119, 2021;
WHEREAS, Defendant Ross A. Lee, in his own capacity and as a testate and intestate
successor of Ross H. Lee and Hazel H. Lee, has been dismissed with prejudice.
WHEREAS, based on the above recitals, the Complaint on file herein, the Statement of
Case filed in Support of Entry of Default Judgment, and the Declaration of Jon McMillen, the
Court finds that the City has established the elements necessary to quiet title to the Subject
Property based on adverse _possession.
JUDGMENT
IT IS HEREBY ORDERED, ADJUDGED AND DECREED:
1. The City has demonstrated that it, and its immediate predecessors -in -interest, the
La Quinta Redevelopment Agency and the Successor Agency to the La Quinta Redevelopment
Agency, have occupied and exercised dominion over the Subject Property, under claim of right, in
an open and notorious manner, for a continuous 5-year period. -Accordingly, the City has
demonstrated the requisite elements to perfect title in the Subject Property by adverse possession.
(See Nielsen v. Gibson (2009).118 Cal.App.4 h 318, 325 [claimant entitled to quiet title by adverse
possession where claimant occupied property in an open manner; hostile to true owner's title,
under claim of right, for a continuous 5-year period, provided the claimant pays "all of the taxes
levied and assessed upon the property during the period"]; Costa v, Fawcett (1962) 202
Cal.App.2d 695, 701 [property tax payment element for adverse possession not applicable where
taxes have not been levied against the propertyj; Sorensen v. Costa (1948) 3.2 Ca1.2d 453; 461-462
[adverse possession claimant may establish elements for adverse possession by relying on adverse
occupation from immediate predecessors -in -interest pursuant to the "tacking." rule]..)
2. Title to the following described real property shall hereby vest in the name of the
City of La Quinta, a California municipal corporation: The fee title interest to the property
described in Exhibit A, and depicted in Exhibit B, subject to the right-of-way easement to the
United States federal government to maintain the All -American -Canal.

3, The City shall, and the Riverside County Recorder's Office shall accept for
recording, a certified copy of this Judgment, within thirty (30) days after entry hereof.
4. Upon recordation of this Judgment, the. Riverside County Recorder shall undertake
all actions necessary -such that record title to the Subject Property is reflected in'the name of the
City of La Quinta, a California municipal corporation.
S. The City's second cause of action seeking an order for Declaratory Relief, as set
forth in the Complaint, is hereby dismissed without prejudice.
6. Defendants Does I through 50, inclusive, are hereby dismissed with prejudice.
