Your email has been forwarded to me as City Manager. Please be advised that California law and the La Quinta Municipal Code set forth processes under which land use applications are governed. Generally speaking, these processes extend from U.S. and State constitutional provisions that entitle persons and property owners to due process of law and use of real property, subject to the valid exercise of the City’s police powers governing land use and its regulatory review. The land use applications for the Coral Mountain project, like any other land use applications, are entitled to the review processes. Moreover, the proponents of these land use applications are subject to the regulatory review process as would be other similarly-situated projects. The regulatory review process includes, but is not necessarily limited to, the review processes and requirements set forth in the State Planning and Zoning Law (Gov. Code, § 65000 et seq.), the State Subdivision Map Act (Gov. Code, § 66410 et seq.), the California Environmental Quality Act (Pub. Resources Code, §21000 et seq.), and the applicable provisions set forth in State Regulations and Title 9 [Zoning] and Title 13 [Subdivision Regulations] of the La Quinta Municipal Code (among other provisions). Because the law entitles all interested persons, including property owners and members of the public, to participate in the land use review processes, the City of La Quinta and its Council are committed to ensuring these processes are followed and respected. 2 Your email and comments are appreciated. They will be added to the record of communications received for consideration by the City Council. As explained above, the land use processes must be followed, which means that the Coral Mountain project applications will first be reviewed by the City’s Planning Commission for a recommendation to be provided to the City Council. Upon the completion of the Planning Commission’s review and recommendation, a duly noticed public hearing and consideration of the project may then be brought before the City Council. I am not only concerned about the proposed Wave Park development here, I am outraged that it is even under consideration. Do any of you have any appreciation for the unspoiled beauty - and current controlled and thoughtful approach to development here - or have profits and promises of greedy developers won you over? If the latter, why is that? Have you actually listened to your constituents who live here and will have to live with the consequences of this proposed monstrosity for years to come? 3 I am not sure where logic and thoughtful residential planning got lost in this conversation, but clearly commerce, profit and greed are trumping the wishes of those of us who live here. Our tranquil southeast La Quinta community will forever be changed and replaced with a year-round cycle of sporting events, traffic, noise, light pollution, a party-like atmosphere and disruption. This project DOES NOT BELONG IN A PEACEFUL RESIDENTIAL AREA. We chose our home here as a welcome refuge from things just like this - noise, traffic, crime. We have spent our entire adult lives working hard to earn the ability to live in a place like this - and developers and their money seem to be winning out over what is best for those of us who live here. What is the benefit to us? None. You have all read the environmental impact reports - at least I hope you have. - Using the figures from the developers themselves, this project will pull 856,000 gallons per day (or 958.6 AF/Y) from the CVWD, a figure that would have been unsustainable even in the best of years. That is drinking water that is already scarce - how is this even under consideration? - The ongoing stop and start CONSTRUCTION NOISE AND TRAFFIC will be a long-term issue for the surrounding residential communities. Say no to construction trucks, dust, noise, wear on the roads. (And don't use the "more jobs" argument - there are multiple other ways to create jobs here. - Have you thought about the effects on those of us who live here from the SEVENTEEN 80-FOOT TALL LIGHT TOWERS around the wave basin that will be ILLUMINATED UNTIL 10 PM AT NIGHT? - This tower lighting, combined with the glare from the project's commercial buildings and parking lots means we will say "goodbye” to our beautiful dark night desert skies that La Quinta is known for. I would like a response to this email. Do your job. Actually listen to the citizens who have elected you to office. Elizabeth Penniman
