To complete this inspection we will require that all feeder conductors supplying the trailers be removed and any loads that will be landed in the new pedestal (i.e. gate motor, etc) be completed and ready for inspection. The scope of work of the existing permit (BELC2018-0113) must also be updated to reflect the permanent pedestal installation to serve the gate, landscaping, or whatever is proposed to be served. Regarding the trailers – we are working multiple angles to get figure out whether or not the certification was received by the party we purchased the trailers from and the process to get the trailers certified in the event they were not obtained with the original build. The trailers were purchased from Paula Ziegler who will review documents when she gets back to her home in Utah after the holiday. We’ve also contracted a local trailer company to help us walk through the process the get the trailers certified in the event Paula cannot find the information. Based on a conversation we had with them yesterday we understand this process to certify could take some time. We will take the necessary steps to certify/permit prior to any use. However, since this is holding up the completion of the block wall and final on the pool is there anything we can do for to allow the City to release the pedestal so IID can energize and we can complete the relocation? Even if we have to remove breakers or wire from the pedestal to the trailer we will do whatever is needed so we can energize and complete these projects. Permit Architectural Plans – I also want to mention the architect drafting the plans for the existing structures (house and barn) is near completion and I’ve been told will be submitting to the City by the end of the week. As I understand it, the jobsite trailers were built on site, or nearby, and placed at their current location. In California, commercial modular structures like those you have there are typically factory built and bear the insignia of the CA Department of Housing and Community Development (HCD), the state agency that regulates the construction and certification of factory built housing and commercial structures. Your modular structures, have no such HCD insignia nor were they built with a City of La Quinta building permit to Title 24 standards. Before we consider moving forward with any electric service, you must first provide the proper, recognized HCD compliant modular buildings or submit plans and obtain permits, inspections and approvals for the structures that are currently constructed. As it stands now, you have unpermitted structures and no use or occupancy will be allowed. This information should have been posted on the trailers in the last week by our Code Enforcement team. He mentioned the City is requesting a “state certification” on the trailers. We do not know what that is and hoping you could help provide some direction. A quick internet search makes it think it’s a DMV issued Permanent Trailer Identification certification (https://www.dmv.ca.gov/portal/dmv/? 1dmy&urile=wcm:path:/dmv_content_en/dmv/forms/reg/reg4017) but I’m not sure if this is correct or if there is more to it. We’ve also reached out to who we purchased the trailers from to see if they have this information. If we have to apply through the DMV I’m not sure how long this could take. He has asked for our collaboration in dealing with the issue. At this point lets issue a Notice of Public Nuisance and have the correction include language that advises the trailer/building will have to be removed from the site if it cannot be permitted. The options for permitting the structure will be 1. Submit plans as a site built building that will be like any other structure built in the City. Or, 2. Obtain the proper permits from the State certifying the modular structure and then obtain the proper permit from the City to have it at the location. As an FYI, neither of these options are likely to be obtainable due to cost and complexity. We want to offer the options but compliance will most likely be gained by requiring the structure to be removed. When you post the NOPN please post an Unsafe to Occupy notice as well. When the owner contacts you, suggest either a site meeting that will include Code, Fire and Building or a sit down with the same parties here at City Hall. The conversation will be to lay out a plan and timeline to address all of the issues including the modular structure, the barn and unpermitted construction on the original dwelling. Below are pictures that were taken on Sunday, January 27th at about 9 or 9:30 pm. On Monday, January 28th, I called the City to file a complaint regarding the light that was shining directly into our great room. The light source appears to be coming from the horse stable directly south, across Brown Deer Park, the Norman #5 tee box and across the 16th lake and fairway, directly into our great room. On January 30th I sent the pictures to Ms. K. Pierce, I was assured she would follow up respecting this matter. On January 31st, I received a call from you, at which time, I went over all of the above details with you. You confirmed the light was definitely in violation of code. You commented that the owner of the Morrow Ranch property had just met with you and you brought this complaint to her attention. She stated the light did not come from her property but from a golf tournament being held at PGA West. I clarified that first of all, there was no tournament going on at the Norman Golf Course and secondly, certainly, not after 9:00 p.m. when it’s pitch dark and you CANNOT see the golf ball. Furthermore, our first call when the light came into our home was to PGA West Security. Two security guards came to our home to see what the complaint was about. I explained our complaint and asked them to come in and see what the problem was. The guards left our home to investigate the source of the light. Shortly after, they returned and informed us it was not coming from anywhere on the Norman Course. During our conversation I offered to have you come to our home and get an idea where the source of the light might be. You asked me to check at night and see if the light was on again and to call you the next morning and let you know. I mentioned that since this property is being used for special events, it probably would not happen again until another event was held there. I advised Mr. Perez that he will have to obtain permits, inspection and approvals from the State (HCD) for the modular structures and, once he has obtained those approvals, he can then submit to the City of La Quinta for the site work, set-up, utility connections and the accessory structures such as stairs/ramps/decks that will be necessary there. He further stated that he is working with a designer (Juan) to prepared plans for all of these outstanding issues. I received an email from Mr. Morrow on 6/20/19 and another follow-up email on 6/21/19 and he stated they he has made contact with HCD for the modular structures but I have had no follow- up and no specifics on the permit/plans status since then. Given that he has investigated the trailer and modular building issues with HCD, I would suggest that we give him until after the July 4th holiday to provide specifics on the status of the plans and of the HCD permit process before we move on with any further code actions or citations. If we haven’t gotten anything substantive by 7/10/19, let discuss at our following Code meeting on 7/11/19. The only real change at this time is that we will revoke occupancy on the main dwelling (not the garage) until they submit plans and we issue a permit and perform inspections there. According to their attorney, the Morrow’s are suing the former owners, the selling broker and filing a claim against the title insurance company. To make matters worse, they apparently found out recently that the house sits atop a Bureau of Reclamation easement and there is likely a situation where the house cannot be where it is currently located unless the easement is vacated, if that is even possible. As they work with the CVWD on the easement problem and sort out the other legal issues, the attorney has asked that we not issue any further citations as they are working in good faith to correct the many permit and approval deficiencies. I stated that we would have no objection to halting the citations as long as they provided us with regular status reports on the project and demonstrated that they are diligently moving forward with the permitting process. Do you have any objections to my agreement on this? In another matter, given that the main residence has apparently had several additions and conversions and is a compilation of manufactured and site-built construction for which there are no permits and approvals, I have decided that it is in the best interest of the owners and any occupants to revoke our approval to occupy until they submit plans, obtain inspections and receive approvals. We simply do not know to what extent the structure and MEP’s may be deficient, and perhaps hazardous, and we need be confident that this dwelling meets the minimum health and safety codes before we continue to allow people to live there. I will draft a letter regarding this occupancy revocation and copy you and the City Clerk in the next few days. As for other activities on the site, I reiterated that they aren’t allowed to have other activities on the site. He didn’t seem to know of any type of recreational loud acitivity happening outside but I just made sure he understood what he is and isn’t allowed to do on the site.
