Case opened on July 9, 2020 - In response to a complaint for a pool remodel
without a permit. The inspection showed a permit was not required for the pool work, but
a couple other structures were observed to require permits under the
Building Code. Attached is the Notice of Public Nuisance that was issued October
20, 2022, to the homeowners.

A recent inspection by a representative of the City of La Quinta Code Compliance Staff was conducted on October 20, 2022 at the
above referenced property address and revealed conditions that constitute a public nuisance.
You are required to correct these violations within Thirty (30) DAYS, or be subject to City abatement, under LQMC 11.72.050

repair, remove, convert or replace any electrical, gas, mechanical or
plumbing system, the installation of which is regulated by this code, or
to cause any such work to be done, shall first make application to the
building official and obtain the required permit.
CORRECTIVE ACTION: Cease and Desist any and all work that
requires a Building Permit from the City of La Quinta. Immediately
contact the Design and Development Department and submit the
required plans to obtain a Building Permit. (Unpermitted patio,
unpermitted window change outs and unpermitted flagpole)
9.60.040 (B) LQMC - PATIO
VIOLATION:

COVERS/PLAY EQUIPMENT
B. Standards. Patio covers, decks, gazebos, play
equipment or other yard structures, attached to or
detached from the main building shall comply with front
and side yard setbacks for the main building and the
following requirements:
1. The location of decks shall be governed by the
standards for wall projections in Section 9.50.060.
2. No yard structure shall be more than twelve
feet in height.
3. Yard structures shall not be constructed or
established in the panhandle portion of a panhandle
or flag lot.
4. No yard structure shall be located less than five
feet from any adjacent residential lot or from any
rear property line adjacent to a public or private
right-of-way.
5. No yard structure shall be located less than
three feet from any rear property line adjacent to
any common use easement or open space or
recreational area which is at least ten feet deep.
6. Eaves or roofs may overhang into the required
setback a maximum of eighteen inches. Setbacks
shall be measured from the nearest supporting
member of the structure to the property line or, if
the property line is at the toe of a slope, from the
top of the slope.
7. Structures shall be constructed in a manner so
as to prevent rooftop water from draining onto any
adjacent parcel.
8. Wood lattice cross -members in patio covers or
trellises shall be of minimum nominal two inches
by two inches material.
9. No patio cover, trellis, gazebo, arbor, similar
structure, or combination thereof shall cover more
than fifty percent of the rear area required setback.

CORRECTIVE ACTION: Comply with the standard requirements or
remove the structure. No yard structure, which includes patio covers,
decks, and play equipment shall be located less than five feet from any
adiacent residential lot or from anv rear property line.
9.50.030 LQMC - SETBACK VIOLATION: Minimum setback standards for front yard, rear yard, November 20, 2022
STANDARDS interior and exterior side yard are established, defined, and illustrated
for all residential districts in Sections 9.50.040 and in Table 9-2 of
Sections 9.50.030 of the Municipal Code. RL Districts: Minimum front
yard setbact 20 feet, Minimum garage setback 25 feet, Minimum
interior setback 5 feet, Minimum exterior setback 10 feet, Minimum
rear yard setback 20 feet for new lots and 10 feet for existing recorede
lots. RC Districts: Minimum front yard setbact 20 feet, Minimum
garage setback 25 feet, Minimum interior setback 5 feet, Minimum
exterior setback 10 feet, Minimum rear yard setback 10 feet.
CORRECTIVE ACTION: Remove all items and/or structures that are
in violation of the Residential Development Standards for minimum
setback requirements. (Rear patio within rear setback)
As a property owner in La Quinta, you undoubtedly share the pride which your community takes in its appearance. If you plan to do
the work yourself, please do so with extreme caution as to prevent blow sand during wind storms. Cleared land requiring soil
disturbance, shall be watered down or treated to aid compaction and prevention of blow sand.
Failure to correct the above listed violation(s) within the time frame indicated will result in the City initiating abatement proceedings
and/or criminal prosecution to correct the violation(s), All contractor abatement costs and a 25 % administrative fee shall be charged to
the property owner(s) as a lien upon the property and shall become a personal obligation of the owner(s) of record.
By acting immediately to correct the violation (s), referenced, you may avoid the administrative fees noted above and any future costs
associated with this violation (s). You may appeal this notice by requesting an appeal. The Appeal Procedure is, Within ten (10) days
from the date of service the property owner may appeal the determination that a public nuisance exist to the city manager pursuant to
Chapter 2.08 of this code. The appeal shall be in writing and filed with the city clerk.
