Yes, the Commission can modify the condition if it wishes. However, until the site is graded, the
perimeter improvements cannot be installed. The base grades need to be set before walls can
be installed. It is our understanding that they intend to mass -grade the property. You might
consider modifying the condition to "prior to completion of mass grading" or "prior to pad
certification" as the trigger, and suggest it to your colleagues.

The first Certificate of Occupancy is I believe the completion of the wave basin. Is there a way we can
require the completion of the perimeter improvements before the wave basin or other improvements
begin?

We have already included it. Please see Condition #8 for the Specific Plan (Exhibit G, page 2380
of the 3/22 packet), and Condition #83 for the SDP (Exhibit I, page 2430 of the 3/22 packet).
The Specific Plan condition is (the SDP condition references the wave basin):
The perimeter improvements on Avenue 58, Madison Street, Avenue 60
and the western property line shall be completed prior to receipt of the
first certificate of occupancy for the first development project on the
site. These improvements will include curb, gutter, sidewalk, multi -use
trail, parkway landscaping and project perimeter wall.

As I have made clear in previous meetings my intention is to add a Condition to this project to complete
the perimeter walls, landscaping and other necessary improvement as early in the construction process
as possible.
My desire would be to require the perimeter improvements prior to any other construction or grading
begins.
What could we use as a trigger to complete this work? Before grading or ??
