Hi Nicole,
I am writing to you as you know better than anyone, what is in the EIR, and how to find it in
the EIR.
My questions:
#1. After (trying) to read the EIR, what is the height in feet of the viewing tower? EIR
says 3 stories- no more Infor. What does that measure out to in height in feet? Are you
referring to the lifeguard tower?We do not have plans. Its height will have to conform to the
height limit in that planning area, and will be part of a future SDP for that area.

Is the square footage of viewing tower calculated in the Commercial footage count? Yes.
What is the total square footage of the viewing tower? I read 1,000 sq. feet ."footprint".
That could mean 3,000 square feet total. Which is it?
Is that per floor or the entire structure? See #1 above. We have no plans, so the footprint
is not defined. If it were three stories, with a 1000 SF footprint and solid floors on three
stories, it could contain 3000 SF. Assuming that it is one single -story structure above
ground as is typical for a lifeguard station, it would be a single story structure of 1000 SF
The hotel is 2 stories high reaching 45'. Can it then be assumed the viewing tower will be
67' tall or more? (each "story" being 22.5 ') If not, what is allowed height measured in feet,
(not by stories). ? Again, I am unclear whether you are referencing the lifeguard tower.
Regardless, no structure can exceed the maximum building height in each planning area.
The hotel can be up to 40 feet high. That is the maximum height of all components, except
elevator shafts and stairwells, and minor projections.
#2- Noise monitoring- who will Monitor (not including the Developer) noise levels? Will it be
up to the neighbors? Will the City take part in monitoring noise? Or just the Sound tech
hired by the Wave Business? The City's noise ordinance will control. That includes during
and decibel levels based on time of day. Please see the Municipal Code for details.
"Wave Basin " water safety laws are getting a review in Sacramento. I read that if there is
an accident, breakdown, etc. in the Wave, an audible alarm must sound off at once for a
minimum of 15 seconds so all Wavers can hear it (for safety's sake.) over the Wave, Train
, music, and spectator noise. Once the trouble is over, the audible alarm must sound off
again for another 15 seconds, so all Wavers & lifeguards know its ok to resume
operations. And most importantly, to be ready for the next Wave.
. What is the suggested sound /noise decibel of an emergency alarm?
Does emergency alarm noise need to be in the noise parameters of City Code? Or is that
a Variance ?
How will noise be mitigated by developer if emergency alarm exceeds the Zoning noise
decibel regs? I could find no answers in the EIR. The project will be subject to the laws in
place at the time it operates. If Mr. Mayes' bill is signed into law, it will be subject to those
requirements. A short -duration alarm would be covered in the City's noise ordinance.
No technique was suggested except for the 6' high perimeter privacy wall. It will take many
years for desert type vegetation to be considered a sound buffer.
#3. New Wave Basin safety law also states ratio of 1 Lifeguard mounted on a jet ski for
every 10 Wavers.- for safety's sake. Wave Park states 30 surfers at one time on the
Wave. Is it correct to assume there will be 3 jet skis running in the Basin during hours of
operation of 7 am to 10pm? Fhe project will be subject to the laws in place at the time it
operates. If Mr. Mayes' bill is signed into law, it will be subject to those requirements.
#4. How often is Wave Tub emptied out- For health reasons? Once a week? Once a
month? One a year? I could find no data on that in the EIR. Complete draining is not
scheduled.
Will ladies that are in "estrus" be allowed to surf and/ or wavers w/ diarrhea? Water safety
law states once there is a speck of blood or human feces- everyone must get out of the
pool- until water is safe for humans to occupy. How will the water be fixed for humans to
occupy? Chemicals or filtration, or both? If chemicals, where & how exactly, will
chemicals be stored on the property? I couldn't find anything in the EIR that explains the
process. The description of the chemical stabilization methods is contained in the Hazards
and Hazardous Materials section of the EIR.
To make your response easier- I've included the new Water Basin legislation being
