With a full-service engineering office located in nearby Bermuda Dunes, we are available
to provide rapid response to requests for services, which can be essential for on-call
contracts where projects may have short design and construction timeframes. Our
materials testing laboratory is certified and accepted by numerous accreditation agencies,
including Caltrans, AMRL, AASHTO, CCRL, and the Division of the State Architect (DSA).
COST CONTROL
With increasing budget constraints affecting public agencies, value engineering has
$1become an integral part of the geoprofessional industry. We often work with public
agencies during the site acquisition process, performing geotechnical engineering/
geology feasibility studies to assess potential site constraints that could add project costs,

or identify issues that could increase the difficulty of development or result in construction
delays. With our local knowledge of geotechnical and geologic conditions, coupled with our involvement
during the construction of many projects, we can quickly identify issues that may affect project costs, and
utilize knowledge gained from past projects to assist in achieving a successful and cost-effective outcome.
During construction, we track materials testing and inspection progress and notify the client of any issues
or circumstances that may impact anticipated materials testing and inspection costs.
EXPERIENCE, STAFFING, PROJECT APPROACH, REFERENCES AND PRICING
Information pertaining to Earth Systems' qualifications, experience, project understanding
and approach, and references are presented on the following pages. A Fee Schedule is also
presented.
Following review of the City's Standard Professional Agreement by Earth Systems' legal
counsel, Earth Systems respectfully requests incorporation of a contract amendment (see Appendix). The
proposed changes are made with our shared interests in mind, with the objective of providing services
to the City under a contract for operations whereby provisions are insurable by the applicable insurance
policies. We maintain insurance as required by the Agreement; a sample insurance certificate evidencing
appropriate coverage can also be found in Section 8: Acknowledgement of Insurance Requirements.
The undersigned confirms that the information and pricing contained in this proposal will remain valid for
a period of at least ninety days, and that individuals who will perform work for the City in relationship to
this contract are free from conflicts of interest.
The Respondent submitting this RFQ response acknowledges receipt of Addenda No. 1 dated May 17tH
2023, and confirms that the requirements noted in the foregoing addendum are incorporated into the RFQ
response.

EARTH SYSTEMS 1. BACKGROUND AND QUALIFICATIONS
Earth Systems Pacific (Earth Systems) is a
professional consulting firm with services that
encompass geotechnical engineering, engineering
geology, environmental assessment, construction
monitoring, and materials testing and special
inspection. Earth Systems, Inc. was founded as
a California corporation in 1969, with its original
offices in Palo Alto and Ventura, California. Earth
Systems Pacific, a subsidiary of Earth Systems, Inc.,
was established as a California corporation in 1999.
Earth Systems' staff of approximately 135 consists
of registered geotechnical engineers, certified
engineering geologists, soil technicians, special
inspectors, and laboratory technicians, augmented
by drilling, drafting, and support personnel.
Approximately 30 employees are employed locally. Office locations in California include Fremont, Hollister,
Salinas, San Luis Obispo, Santa Maria, Santa Barbara, Ventura, Pasadena, Palmdale, Bermuda Dunes, and
Perris. The projects undertaken under this contract would be managed from our Bermuda Dunes office,
which is located at 79-811B Country Club Drive in Bermuda Dunes, California.
With many decades of experience in Riverside County, Earth Systems brings detailed knowledge of soil,
groundwater, and geologic conditions to projects planned for this region. Earth Systems offers expertise
in development of geotechnical criteria for public works projects, including buildings, water and sewer
infrastructure, bridges and roadways, and public parks, as well as materials testing and special inspection
during the construction process. We have extensive experience with pavement construction and
rehabilitation, including new construction, overlays, recycled materials, permeable pavers, and stabilization
of poor subgrade conditions. We have worked with many jurisdictions throughout southern California,
providing services such as subsurface exploration, pavement coring, laboratory testing of soils, aggregate,
HMA, and other pavement materials, pavement deflection studies, development of materials sampling,
acceptance, and independent assurance plans, and infiltration testing for low impact development (LID)
improvements. In addition to providing detailed studies, Earth Systems can assist in specific identification
of any adverse geotechnical or geologic properties of sites that may adversely impact proposed projects.

OUR ROLE
Earth Systems' role during the design phase of projects will be to provide geotechnical consultation,
geotechnical investigations, geologic hazard studies, pavement studies, core sampling and other services
of a geotechnical nature that may be necessary to support design of proposed capital improvement
projects. For an on-call contract such as this, our involvement may range from a single site visit to
address a specific site issue to a full geotechnical/geologic engineering investigation. We are available to
respond to any type of service request, large or small, and recognize that staff availability and the ability
to respond quickly are key for an on-call consultant to be effective in this role. In addition to providing
detailed studies, Earth Systems can assist in specific identification of any adverse geotechnical or geologic
properties of the site that may adversely impact the project. We pride ourselves on our ability to develop
high quality, constructible solutions that minimally impact project costs and schedules. We are available
to attend meetings and consult with the City or members of the design team to review site conditions
and discuss potential solutions. During construction, Earth Systems can provide materials testing, special
inspection, material identification, and other services to document that the work performed meets the
requirements of the project plans, specifications and the requirements of the CBC, Greenbook, and/or
Caltrans as appropriate.
FULL-SERVICE MATERIALS TESTING LABORATORIES
The Earth Systems laboratories have the capacity to perform hundreds of tests upon soils, concrete,
asphalt, steel, masonry, and other building materials. Earth Systems laboratories have been certified or
inspected by the U.S. Army Corps of Engineers, the Division of the State Architect (DSA), the Cement and
Concrete Reference Laboratory (CCRL), and the AASHTO re:Source (formerly AMRL). We also maintain
several Caltrans -approved laboratories. Having multiple laboratories allows us to control sample handling,
chain of custody, and quality of tests so accurate results can be assured. Earth Systems participates in the
Caltrans Reference Sample Program, the Cement and Concrete Reference Laboratory (CCRL) and AASHTO
resource Proficiency Sample Programs for Concrete, Soil, Aggregate and Rebar. The laboratory equipment
is calibrated annually, and the calibrations are traceable to the National Bureau of Standards. We maintain
our own CBR and R -value (resistance to deformation under repeated loading) test equipment, allowing
us to provide timely test results without shipping samples to an out-of-town facility. We have mobile
laboratory equipment for soil, concrete, and asphalt concrete testing. Tests are conducted by trained
technicians/inspectors in accordance with ASTM, Caltrans, AASHTO, and other appropriate laboratory
standards.

With decades of experience in the local area, Earth Systems offers extensive experience and detailed
knowledge and detailed knowledge of soil, groundwater, and geologic conditions in this region. We have
conducted numerous geotechnical investigations and geologic studies for projects ranging from minor
infrastructure to large-scale new construction of public works projects. With a local office and full-service
materials testing laboratory in Bermuda Dunes, we are available to provide rapid response to requests
for services, which can be essential for on-call contracts where projects may have short design and
construction timeframes.
As this is an on-call contract, scopes and project approaches will vary depending upon the needs of the
City and the project. The following are brief descriptions of the types of services that we envision under
this contract, and Earth Systems' general approach to each.
GEOTECHNICAL FEASIBILITY STUDIES
When a property is under consideration for a project, a geotechnical study can be invaluable to assess
conditions that may affect the desired use of the site. Studies may include geologic research, review of
aerial photographs and possibly limited subsurface exploration to identify potential geologic constraints,
infiltrometer testing to determine suitability for on-site storm water retention or detention, or percolation
tests to determine suitability for on-site effluent disposal. Such studies allow for informed decision making
before investing further in a particular site.
GEOTECHNICAL ENGINEERING INVESTIGATIONS
Geotechnical engineering investigations are design -level studies intended to provide sufficient data
and criteria to allow design of the project and meet jurisdictional requirements. To evaluate subsurface
conditions, typically a series of borings are drilled to depths of interest, which will vary based upon the
type of project, the grading concept, and the anticipated subsurface profile. Borings may be drilled using
hollow -stem auger techniques or using Cone Penetrometer methods. For hollow stem borings, standard
penetration tests are typically performed (ASTM D 1586) and soil samples are obtained using a ring -lined
barrel sampler (ASTM D 3550). Bulk soil samples are also obtained from the auger cuttings.

Prior to initiating any subsurface exploration, Earth Systems coordinates with Underground Service Alert
(USA) for underground utility coordination and determination of the locations of other subsurface features
that could potentially be impacted by drilling operations. Soil samples are tested in the laboratory to
determine a variety of soil properties, depending upon the type of project, the proposed development
concept, and the materials encountered. Such tests as unit weight and moisture, plasticity index, grain
size determination, maximum density versus optimum moisture, expansion index, one-dimensional
consolidation, angle of shearing resistance, R -value, and unconfined compressive strength may be
performed. All laboratory testing is performed in our accredited laboratories by trained technicians
and according to ASTM or other applicable standards. The field and laboratory data are reviewed by a
Registered Geotechnical Engineer and/or a Certified Engineering Geologist and evaluated with respect to
development of geotechnical criteria for the proposed project.
Geotechnical engineering investigations and reports comply with the requirements of Sections 1803.1
through 1803.6 and J104.3 of the applicable edition of California Building Code (CBC). Geotechnical
engineering investigations are supervised by qualified and experience geotechnical professionals who
develop programs for subsurface exploration, laboratory analysis, and data evaluation.
GEOLOGIC HAZARD STUDIES
Projects involving a geologic scope are supervised by a Certified Engineering Geologist. These may be
stand-alone reports or may be incorporated into the geotechnical investigation. Depending upon the
type of project, the work may include a review of geologic literature and maps, air photo interpretation,
seismic refraction surveys, fault investigation, excavation of exploratory trenches, borings and down -hole
logging, and various types of software analysis. Typical projects include geologic hazard studies, landslide
evaluations, ocean bluff retreat studies, wave run-up analyses, and geophysical explorations. Geologic
hazards reports comply with Section 1803.6 of the CBC, California Geological Survey Note 48, and Special
Publications 42 and 117, as applicable.
INFILTRATION/PERCOLATION TESTING
Infiltration and/or percolation testing may be performed for projects where low -impact developments
such as on-site stormwater retention or infiltration is planned, or where on-site wastewater disposal may
be necessary. Services may include excavation of witness pits or borings to identify the soil profile; drilling,
presaturation and testing of percolation test holes, double -ring infiltration testing, along with interpretation
of test data and preparation of a written report. Typically, testing includes an initial background evaluation
based upon review of existing data and the proposed development plan, excavation of multiple test pit
test locations, and infiltration/permeability or percolation testing (for on-site wastewater disposal). The
specific methods used will depend upon the purpose of the testing, the specific site conditions and type
of development planned. Test results form the basis of determination of whether the site conditions are
suitable for infiltration or percolation, and establishes rates to be used in design calculations.

GEOTECHNICAL CONSULTATION
For some on-call contracts, geotechnical engineering/geologic investigation may not be necessary, but
there may be concerns of a geotechnical nature for which the City would like expert advice, such as a
high groundwater condition or unstable soils. Earth Systems has a full staff of experienced geotechnical
engineers and geologists available to provide such consultation on an as -needed basis. We can also
provide consultation regarding issues such as pavement deterioration, unstable slopes, or forensic studies
for buildings or other structures. Plans and specifications can also be reviewed for Standard of Care,
adherence to City Standards, or for conformance to applicable reports.
FORENSIC STUDIES
Occasionally, issues with an existing structure occur in the form of cracks, settlement, or other forms of
distress. Causes can range from deficiencies in construction materials, improper construction techniques,
settlement of artificial fill soils, or other factors. Identification of the cause of distress is key to developing
an appropriate mitigation strategy. Earth Systems has a wide array of forensic services and tools available
to assist in forensic evaluation, include floor level surveys, unreinforced masonry testing, concrete
evaluation, structure load testing, tendon/reinforcing steel location, pulse velocity testing, and sounding/
echo impact testing.
CONSTRUCTION OBSERVATION, SPECIAL INSPECTION AND MATERIALS TESTING SERVICES
During construction of projects, Earth Systems can provide geotechnical consultation and sampling,
testing and/or special inspection of construction materials including soil, concrete, asphalt concrete,
masonry, steel, bolting, and spray -applied fireproofing. This may involve site visits by a qualified engineer
or geologist, sampling, testing and/or special inspection of materials by a qualified field technician or
special inspector, and laboratory testing of soil materials as necessary to support the project. As part of
these tasks, resolution of issues associated with the geotechnical properties of the site and construction
materials may be necessary; we are available to attend meetings and consult with the City to discuss any
such issues.
Scheduling of services is conducted through our dispatcher, who is available (in person, not a message
machine) from 7:00 a.m. to 5:00 p.m. Monday through Friday. Sampling and testing will typically be
conducted at the direction of the City. Daily reports detailing the progress of the work and the services
provided will be left at the site. The results of the tests/inspections will be provided in periodic summary
reports, not to exceed 14 days from the date of the last test/inspection when needed. Materials test
reports will be provided upon completion of the tests. Results of materials tests are generally available
within 48 hours of the material's submittal. All test reports will be prepared or reviewed by Earth Systems'
project manager Kevin Paul, or qualified reviewer.
Test reports will be sent to the City; the reports will include all of the test results, regardless of the
satisfactory or unsatisfactory outcome of the tests. The reports will indicate the location of samples, any
special sampling procedures used (as applicable) and will clearly indicate what materials were sampled

QUALITY ASSURANCE/QUALITY CONTROL
All geotechnical and materials testing services will be performed in accordance with the California Building
Code (CBC) requirements and standards for public improvement projects, project plans and specifications,
and the City's Quality Assurance Program (QAP) as applicable. Geotechnical engineering reports comply
with the requirements of Sections 1803.1 through 1803.6, and J104.3 and J104.4 of the applicable edition
of California Building Code (CBC) and California Geological Survey (CGS) Special Publication 117, as
applicable; geologic hazards reports comply with Section 1803.7 and J104.4 of the CBC, CGS Note 48, and
CGS Special Publications 42 and 117, as applicable. Geotechnical engineering investigations are supervised
by Registered Geotechnical Engineers who develop programs for subsurface exploration, laboratory
analysis, and data evaluation. Projects involving a geologic scope are supervised by a Certified Engineering
Geologist. All reports are peer-reviewed by another staff professional experienced with similar projects
and certified or licensed in the appropriate discipline.
For materials testing and special inspection projects, all work is overseen by the project manager, who
visits the sites and reviews the inspection/testing program with field and laboratory personnel. All reports
are reviewed by the project manager, and peer-reviewed by another professional staff member to assure
report accuracy and quality.
MONITORING OF BUDGETS AND SCOPES
Earth Systems recognizes the need for budget control on publicly funded projects and works collaboratively
with our public agency clients to control costs associated with geotechnical and materials testing/
inspection services, and we understand the need to adhere to the project's allocated budget. Geotechnical
and geologic investigations are typically provided on a fixed fee basis, while materials testing, special
inspection and core sampling services are provided on a time -and -materials basis. Prior to the start of
the work, budget estimates are developed based upon reviews of project plans and contractor schedules
for various aspects of the sampling and testing program. Placement of materials, the schedule of the
contractor and the progress of the work are critical factors that can affect fees. Other variables include
the location of material fabrication, identification of construction materials, and the need for retests. To
avoid unanticipated budget overruns, we implement a budget tracking system. Hours for observation or
sampling/testing are estimated based upon the contractor's construction schedule, and are tracked by
category, i.e. soil, concrete, asphalt concrete, etc. If the progress of the work begins to deviate significantly
from that shown in the project schedule for any category, thus potentially affecting fees, the client is
notified. Similarly, if other situations such as unidentified materials, nonconforming materials, or excessive
retesting occur, he or she is informed and apprised as to the effect upon the project budget. This affords
the City the opportunity to convene with the contractor to discuss the project schedule or other factors
that may affect testing or observation fees, and measures that can be taken to better control the progress
of the work.

goal is to always work collaboratively with clients, the design team, and contractors while meeting tight
schedules and deadlines. We accomplish this by clear communication, always keeping our clients and
other stakeholders apprised of project milestones and being respectful of the project schedule and budget.
Should issues arise on a project, we immediately notify the client and work with all involved parties to
come to a resolution that is practical, constructible, cost-effective, and minimizes project delays. We are

The schedule for services will vary depending upon the type of service requested under the on-call contract.
Requests for consultation are responded to immediately, with site visits typically scheduled for the same
or the following week. For geotechnical engineering or engineering geology investigations, the time -frame
will generally be four to six weeks following the Notice -to -Proceed, and may be influenced by such factors
as weather and site accessibility. Materials testing and special inspection timeframes are governed by the
contractor's construction schedule; a minimum of 24 -hours' notice is requested for inspection services,
however, we endeavor to have testing and inspection personnel available as necessary to serve the needs
and timeframes of projects. Below is an example project timeline for a typical geotechnical engineering

of care, and to update geotechnical criteria to conform to current jcorella@cathedralcity.gov
California Building Code requirements. Supplemental geotechnical
recommendations were also developed. The project was a stage
structure for a proposed amphitheater, which was to be constructed at the intersection of Cathedral
Canyon Drive and Avenida Lalo Guerrero in Cathedral City. Challenges at the site included the potential for
seismically induced settlement and the presence of shallow electrical lines that crossed within the stage
foundation area. Supplemental recommendations presented options for site grading in foundation areas
to allow flexibility for the client to select the most cost-effective approach based upon available budget
and project objectives. Geotechnical criteria were also developed for excavation, utility trenches, and
foundations. During construction, Earth Systems provided geotechnical observation and materials testing.

BASIS OF CHARGES
1. Charges for non -Prevailing Wage services are calculated in one-hour increments and accumulate
on a portal-to-portal basis. A 2 -hour cancellation charge applies if scheduled inspection or testing is
cancelled after 3 p.m. the day prior to the scheduled work.
2. Field technician services for regular workdays for Prevailing Wage projects are subject to a 4 -hour
minimum charge, then billed in 2 -hour increments portal to portal. Special inspection is billed in
4 -hour increments.
3. Work performed on Saturdays, night work, and for premium hours (before 7 a.m., after 5 p.m. or more
than 8 hours in one day) for personnel are at time and one-half; Sundays and holidays are at double
time. Work performed on weekends, holidays, and when work starts outside of regular business hours
is subject to a 4 -hour minimum charge.
4. Mileage is invoiced at a rate of $1.05 per mile (portal-to-portal, includes basic equipment transport
e.g., Nuclear Density Gauge).
5. Minimum report charge: $160.00. Report copies: $50.00 each (minimum).
6. State regulations require electronic submittal of Certified Payroll to DIR. A fee of $80.00/week will be
assessed. Additional time required to address specific requests related to DIR/Labor Compliance will
be charged at the clerical/administrative services rates.
7. Subcontracted services, materials, rental equipment, out of town travel, and expenses are charged at
cost plus 20 percent. Fixed per diem rates for specific projects can be provided upon request.
8. Invoices are payable upon presentation. Invoices thirty days past due are subject to a service charge of
one and a one-half percent per month. Payments using a credit card will be assigned a 3% surcharge.
9. Rates are effective through December 31, 2023. An annual escalation rate of 3 percent will be applied
to hourly rates for professional staff and non -prevailing wage services; rate increases for prevailing
wage services will be based upon determinations by the State of California Department of Industrial
Relations.

Geotechnical engineering and engineering geology are core services provided by Earth Systems; associated
complementary services would include percolation testing, infiltration testing, forensic analysis, slab

Principal Geotechnical Engineer, Project Manager
With over 20 years of experience in the geotechnical engineering, materials engineering,
materials testing and inspection, and environmental services field, Mr. Kevin Paul
specializes in public works, essential services, educational and renewable energy
projects. He has been the geotechnical engineer for numerous public works projects
for jurisdictions throughout southern California, including bridges, roadways, water and sewer supply and
infrastructure, and buildings. His role for this contract will be principal geotechnical engineer and project
manager, providing direct geotechnical engineering oversight. Mr. Paul is an experienced project manager,
with the responsibility of assuring high quality subsurface study, data analysis, and budget management.
He is directly involved in development of project scopes and proposals, coordination and preparation
of project teams, direction of fieldwork, personnel and equipment, laboratory testing and analysis, and
report preparation. He serves as the Engineer -of -Record for Earth Systems' Perris and Bermuda Dunes
materials testing laboratories for the AASHTO Materials References Laboratory (AMRL) and Cement and
Concrete Reference Laboratory (CCRL) accreditation, California Department of Transportation (Caltrans)
certified laboratory, and Division of State Architect (DSA) Laboratory Evaluation and Acceptance (LEA)
programs.
Mr. Paul has developed a reputation of working collaboratively with clients, the design team, and
contractors while meeting tight schedules and deadlines. He is a registered geotechnical engineer in the
State of California, and a registered professional engineer in the States of California, Nevada, and Arizona.
He obtained a bachelor's degree in civil engineering from Ryerson Polytechnic University in Toronto,

dEdM Principal Engineering Geologist
As a principal engineering geologist with Earth Systems, Mark Spykerman is responsible
for evaluation of the impact of geologic and hydrologic conditions upon proposed
developments. Certified bytheState of California as a professional geologist, engineering
geologist, and hydrogeologist, Mr. Spykerman has over 40 years of experience on public
works projects, authoring hundreds of reports that have been reviewed and approved by the California
Geologic Survey (CGS). He has been responsible for oversight and management of large-scale field
operations, including managing, training, and mentoring staff.
Mr. Spykerman's areas of expertise include geologic hazards assessments, seismic analysis, fault
investigation, analysis of liquefaction and lateral spreading, rockfall and slope stability evaluation. He is
thoroughly familiar with the requirements of California Code of Regulations (CCR) Title 24, the California
Building Code (CBC) and the California Geological Survey's (CGS) Note 48 Checklist. Geologic analyses are
performed in accordance with the CGS guidance document Special Publication 117A for earthquake and

ANTHONY COLAROSSI, PE# 60302
Senior Engineer
Anthony (Tony) Colarossi is a registered professional engineer with over 30 years of
experience in the geotechnical and materials testing field. His expertise includes
development of geotechnical criteria for shallow and deep foundations, mass grading
operations, and analysis of sites with respect to settlement, slope stability, seismic
factors, and rockfall potential. As a senior engineer, his day-to-day responsibilities include oversight of
field investigations for geotechnical engineering and geologic investigations. During project construction,
he supervises field activities related to materials testing and special inspection, such as field density testing
for mass -grading operations and observation of shallow and deep foundation construction.
Mr. Colarossi received a Bachelor of Science Degree in Civil Engineering from California Polytechnic
University at Pomona, California. He has been with Earth Systems since 2014. Prior to his employment
with Earth Systems, he spent ten years as a Building and Safety Plan reviewer working for the cities of La
Quinta and Coronado, California.

Project Engineer
A registered civil engineer with 13 years of experience in the geotechnical field, Ms.
Carrillo supervises subsurface exploration programs, provides analysis of field and
laboratory test data, prepares geotechnical engineering reports, and oversees the
geotechnical/materials testing aspects of projects during construction. Her extensive
field experience and variety of projects that she has been involved in has allowed her to develop familiarity
with the often complex geologic and geotechnical conditions that characterize the various regions of
southern California. She has been involved in numerous geotechnical engineering investigations for public
works projects, ranging from parking lots to large-scale infrastructure. Ms. Carrillo obtained a Bachelor of
Science degree in Civil Engineering and a Master of Science degree in Geotechnical Engineering from the
University of California Los Angeles (UCLA). She has been employed with Earth Systems since 2018.
MARK HOUGHTON, ACI, NICET, ICC
Construction Testing Services Manager
Mr. Houghton has over 38 years providing materials testing, geotechnical observation
and special inspection. Mr. Houghton manages our staff of soil technicians and certified
special inspectors with appropriate ICC, DSA, NICET, AWS, and other credentials. Mr.
Houghton will provide daily technical oversight and quality control of the technicians
and inspectors assigned to projects undertaken as part of this contract. Mr. Houghton manages the
special inspection team of technicians in strict adherence to CBC code requirements, project plans and
specifications. He provides materials testing oversight and assists with signatory review of laboratory tests,
as well as any forensic evaluation that may be needed. Mr. Houghton will be responsible for observing
construction procedures, managing documentation, verifying materials comply with specifications,
scheduling field operations, and coordinating with the City.

For construction materials testing, we will utilize highly qualified and experienced field and laboratory staff
that have provided excellent service for past public works projects. They can provide geotechnical and

ROCIO CARRILLO, PE
Project Engineer
A registered civil engineer with 13 years of experience in the geotechnical
field, Rocio Carrillo supervises subsurface exploration programs, provides
analysis of field and laboratory test data, prepares geotechnical engineering
reports, and oversees the geotechnical/materials testing aspects of projects
during construction. Her extensive field experience and variety of projects
that she has been involved in has allowed her to develop familiarity with
the often complex geologic and geotechnical conditions that characterize the
various regions of southern California. She has been involved in numerous
geotechnical engineering investigations under DSA oversight, including
projects for Beaumont Unified School District, Corona -Norco Unified School
District, Southern Kern Unified School District, Palm Springs Unified School
District, and Banning Unified School District. Ms. Carrillo obtained a Bachelor
of Science degree in Civil Engineering and a Master of Science degree in
Geotechnical Engineering from the University of California Los Angeles
(UCLA). She has been employed with Earth Systems since 2018.

MARK HOUGHTON
Construction Testing Services Manager
Mr. Mark Houghton will serve as the construction testing services manager
for this contract. In this role, he is responsible for oversight and assurance
of technical quality, as well as client relations and supervision of field and
laboratory staff. Mr. Houghton started his career in the field, performing
laboratory and field testing and special inspection for many major
construction projects, including hospitals, educational facilities and projects
under the jurisdiction of the Division of Dam Safety. As a result of this
extensive background, Mr. Houghton has developed a deep knowledge of
local soil conditions and has established excellent relationships within the
local construction industry. He currently manages contracts for construction
testing and observation services for numerous local government, state, and
educational sector projects. He provides analysis and studies on stressed
structures and materials, including forensic testing, rehabilitation programs,
and seismic damage studies. He is intimately familiar with the special
inspection process and inspection/materials testing protocols. He ensures
that deadlines for inspections and report submissions are consistently met
while maintaining the high quality of inspection and testing that Earth
Systems is known for.

Scope of Services. In compliance with all terms and conditions of this Agreement, Contracting
Party shall provide On -Call Survey Services, as specified in the "Scope of Services' attached hereto
as "Exhibit A" and incorporated herein by this reference (the "Services"). Contracting Party
represents wants that Contracting Party is a provider of first class work and/e.r
professional services and Contracting Party is experienced in performing the Services
contemplated herein and, in light of such status and experience, Contracting Party covenants that
it shall follow industry standards in performing the Services required hereunder, ^^^' that ^m','
material ;f any, .,,II be of good quality, fit for the purpose inteR For purposes of this
Agreement, the phrase "industry standards" shall mean those professional standards of practice
recognized by one or more fiFSt cross firms performing similar services under similar

Familiarity with Work. By executing this Agreement, Contracting Party vests represents that
(a) it has thoroughly investigated and considered the Services to be performed based on the

on the day of the site visit, (c) it has carefully considered how the Services should be performed,
and (d) it fully understands the facilities, difficulties, and restrictions attending performance of

conditions materially differing from those inherent in the Services or as represented by City,
Contracting Party shall immediately inform City of such fact and shall not proceed except at
Contracting Party's risk until written instructions are received from the Contract Officer, or
assigned designee (as defined in Section 4.2 hereof).

Agreement require specialized skills and abilities and that, consistent with this understanding,
Contracting Party's work will be held to an industry standard of professionals performing similar

hereinabove, Contracting Party represents to City that it holds the necessary skills and abilities to
satisfy the industry standard of quality as set forth in this Agreement. Contracting Party shall
adopt reasonable methods during the life of this Agreement to furnish continuous protection to
the SeFviees peFfeFmed by Contracting Party's, and the equipment, materials, papers, and other
components thereof to prevent losses or damages, and shall be responsible for all such damages,
to peFsens er its property, until acceptance of the Services by City, except such losses or damages
as may be caused by City's own negligence. The performance of Services by Contracting Party
shall not relieve Contracting Party from any obligation to correct any incomplete, inaccurate, or
defective work at no further cost to City, when such inaccuracies are due to the negligence of
Contracting Party.
