such as the City of Palm Springs, City of Fontana, City of Victorville, City of Anaheim, City of Santa Monica, and

• Accredited Laboratory. All required materials testing for the City of La Quinta would be conducted at our
10,000 square foot laboratory in Rancho Cucamonga, California. Fenagh's state-of-the-art testing laboratories
are fully -accredited, and are in compliance with ASTM E329, the Standard Specification for Agencies Engaged
in Construction Inspection, Testing, or Special Inspection.
• Fenagh-s Field Team. We will provide certified, and experienced professional staff and field technicians.

• Project Management. Fenagh's core Project Management Team includes Martin Lowenthal, Project Executive;

Some of their responsibilities on this contract will include the following:
• Maintaining consistent communication directly with the City of La Quinta to ensure that all tasks are

Fenagh Engineering and Testing firmly believes that one of the most important aspects of providing professional
services in support of any on-call contract is to operate as a direct extension of our client and their team.
Project Controls
Budget Development. We are committed to working collaboratively with the City to identify all items that are
required to be within our scope, and we will prioritize identifying any potential for value engineering savings. This
will include direct conversations with all project stakeholders to accurately determine project scheduling needs.
Fenagh prides itself on leaving no stone unturned in respect to your project budget.
Project Meetings. Our core Project Management team and Lead Inspector will participate in all preconstruction,
project progress, and any additional project -related meetings as determined by the City.
Project Management. We will work alongside the City and their designated teams over the duration of the
contract. Project Management, Project Engineers, and Field Services Supervisors will remain actively involved in
the day-to-day operations of each project.
Budget Management. Your designated Senior Project Manager will continuously track each project budget. A
Budget Update Report will be provided with each invoice, for the purpose of identifying each scope and the status
of the overall project budget. We will communicate directly with the City should we encounter any issues that may
potentially impact a project budget.
Communication Plan
Fenagh's guaranteed response time is 24 hours. However, our team is flexible and can meet short notice service
requests in most situations. We will maintain communication with City representatives on a daily basis, or as
needed. Communication will vary depending on the workload of the project.

• Review and interpret all pertinent construction documents, including specifications and drawings.
• Attend all required preconstruction and on-going construction meetings.
• Provide recommendations or undesirable soil condition mitigation, when needed.
• Oversee scheduling of construction materials testing and other on-site services.
• Review and distribute daily field reports (DFR's) and accompanying laboratory results or reports
• Preparation of project close-out documentation of all on-site services and construction materials testing
that was performed throughout the duration of the project(s). All close-out documentation will be provided
electronically to the City of Fullerton and the designated project team(s).
Field Staff
Our primary focus will be to provide geotechnical engineering and construction materials testing on various
projects for the City of La Quinta. Fenagh's field team consists of experienced professional staff, field technicians
and special inspectors who are capable of providing all construction materials testing services that are required
on any type of construction project.
Multi -disciplined field staff can support several job sites in one day— maintaining consistency on projects, reducing
the learning curve and the decreasing the response time.
Fenagh's field team members are certified by nationally recognized agencies such as American Concrete Institute
(ACI) and International Code Council (ICC), among others.
Geotechnical Engineering
All requested geotechnical investigations will be conducted by in-house personnel. Typical lead time from notice to
proceed is 6-8 weeks. Investigations consist of CGS review, site classification, field exploration, boring, percolation
testing, laboratory testing, and site recommendations for design purposes.
Soil Sampling
Soil samples will be taken in accordance with the following approved test method:
• ASTM D75 - Standard Practice for Sampling Aggregates. Samples will be tagged and transported to the
laboratory in moisture tight containers. Tag information included is to include the following: project number,
project name, date sampled, sampled by, and requested tests.
Soil samples will be collected and tested whenever there is a new type of material as determined by ASTM D2488,
or when it is suspected that the Maximum Density on file is different from what is observed in the field.
Field Testing — Soil
Soil compaction shall be tested in accordance with one of the following approved test methods:
• ASTM D6938- Standard Test Methods for In -Place Density and Water Content of Soil and Soil -Aggregate by
Nuclear Methods (Shallow Depth)
• ASTM D1556- Standard Test Method for Density and Unit Weight of Soil in Place by Sand -Cone Method

Batch Plant —Asphalt
An Asphalt Batch Plant Inspector will verify that asphalt received at the project site meets the tolerances listed on
the approved mix design. The following are general requirements of an Asphalt Batch Plant Inspector:
• Sample materials used in Hot -Mix Asphalt such as: Aggregate, oil, lime/anti-strip
• Sample Hot -Mix Asphalt at the plant.

Samples will be taken at random by using ASTM D3665 or by another non-objective way to select a random
sample. Samples will be transported in a way that prevents the introduction of moisture, loss of moisture, loss
of sample and prevents the sample from becoming degraded or contaminated. Plastic bags with a thickness of
at least 4 mil will be used as the preferred sampling container whenever possible. Samples will be identified on a
sample tag.
Laboratory Testing — Aggregate
Following the collection of an aggregate sample, it will be transported to the laboratory for further testing. The

Concrete Sampling
SECTION 1
WORK PLAN
Fresh concrete samples will be taken in accordance with the following approved test methods:
• ASTM C172 - Standard Practice for Sampling Freshly Mixed Concrete
Samples will be initially cured at the project site for a period up to 48 hours at a temperature between 60°F to
80°F, and shielded from direct sunlight. During initial curing, the minimum and maximum temperature will be
recorded with a calibrated min -max thermometer. Transportation will not occur until 8 hours after the final set of
concrete samples is obtained. Samples will be transported in an upright position, be cushioned, free of moisture
loss and should reach the laboratory within four (4) hours. Samples will be positively identified on the side of the
mold (not the cap), information included on the cylinder should include the following:
• Date Cast
• Set Number
• Project Information
• Slump/Air/Temperature
• Additional Remarks
A data sheet will be firmly affixed to the side of one cylinder per set, in a packing slip. Concrete Technicians are
required to keep copies, in the event of lost data sheets during transportation.

Batch Plant — Concrete

WORK PLAN
Concrete Batch Plant Inspections will be in accordance with the following approved test method:
• ASTM C94 - Standard Specification for Ready -Mixed Concrete
Concrete batch plant inspection includes the review the mix design for the project, the project plans and
specifications. Concrete Batch Plant Inspectors will verify that Concrete leaving the plants meets the tolerances
listed in ASTM C94. The following are general requirements of a Concrete Batch Plant Inspector:
• Verify the correct mix design is being utilized.
• Verify the mix design is approved for specified usage.
• Verify the plants scales are calibrated at proper intervals.
• Verify the concrete is batched and mixed in accordance with the applicable section of ACI 301 and ASTM C94
• Report results to contractor and/or client.
Unless project plans or specifications state otherwise, every load of concrete should be inspected priorto shipment
to the project site.
Reinforcing Steel
Reinforcing Steel will be taken in accordance with the following approved test methods:
• ASTM A370 - Standard Test Methods and Definitions for Mechanical Testing of Steel Products
• ASTM A615 - Standard Specification for Deformed and Plain Carbon -Steel Bars for Concrete Reinforcement
• ASTM A706 - Standard Specification for Deformed and Plain Low -Alloy Steel Bars for Concrete Reinforcement
Each sample shall consist of two like bars, one for tension testing and one for bend testing. Each pair of sampled
bars shall be wire tied together at the time of sampling, and accompanied by a copy of the applicable Mill Test
Report (MTR). Samples will be transported in a manner that prevents damage and that does not compromise the
identification of the samples. Samples will be positively identified on the waterproof sampling tag.
Unless project plans, specifications or a waiver state otherwise, reinforcing steel shall be sampled at the following
interval:
• Identifiable Rebar — Sample two (2) bars from every 20,000 pounds, or fraction thereof, for each size of rebar
• Unidentifiable Rebar—Sample two (2) bars from every 5,000 pounds, or fraction thereof, for each size of rebar
To be considered identified, the inspector must verify that reinforcing bars meet all of the following criteria:
• Reinforcing bars originate from whole, unbroken bundles or coils, wire wrapped by the manufacturer's mill.
• The manufacturer's ID tag is attached by wire to each bundle or coil. Tags shall be legible and complete, with
the mill name, heat number, bar size, material grade, ASTM designation, and bundle or coil weight.
• The markings on a coil of each bar in a bundle shall match the affixed ID tags for mill, bar size,ASTM designation,
and grade.
• Each bundle or coil is to be accompanied by the manufacturer's mill certification/material test report (MTR),
which states that the material conforms to the appropriate ASTM designation, as described in the project
specifications.

Distribution of Materials Testing Laboratory Results
SECTION 1
WORK PLAN
Following the completion of construction materials testing, all test results will be reviewed and approved by
Bruce Tie, PE. All reports will be made available through the EOLAS Client Portal; and DFR's, along with approved
laboratory results will be subsequently transmitted to Port Houston and the designated project team.
City of Fullerton will receive a Weekly Summary Report. This report outlines the services that are provided each
day, along with all associated construction materials testing results. The Weekly Summary Reports are prepared
at the conclusion of each work week, and will be distributed electronically.
All project documents will be maintained on our traditional server and in our cloud -based EOLAS portal, under the
direct supervision of Bruce Tie, PE.
Non -Conformance
Failing material test results and construction deficiencies will result in the initiation of a Non-conformance Report
(NCR).
Material test failures and/or non -conformances will be documented and promptly reported to all appropriate
personnel by Ung Sing (Bruce) Tie, PE.
Corrective actions are to be initiated by the organization responsible for the non-conformance, and the results are
to be reported to both the Contractor and the Quality Control Manager. Additional observation or testing may be

LADWP City Trunk Line South - Unit 3 - Los Angeles, CA
The City Trunk Line South — Unit 3 (CTLS-3) Project consists of the installation of approximately 10,250 linear feet
of 60 -inch diameter welded steel pipeline and appurtenances. The project route is along Whitsett Avenue from
Vanowen Street to Magnolia Boulevard in the North Hollywood area of Los Angeles.

Description of Services: A geotechnical investigation was performed to assess the extent and condition of the
chemical grouting performed at the site. The purpose of the Chemical Grouting program was to stabilize the
soils between Work Area 12 -STA 85+96.91 and Work Area 13 -STA 97+10.56 prior to tunneling for the new trunk
sewer line. Fenagh observed and logged the advancement of soil borings at the site, collected soil samples, and
performed laboratory testing on select samples.
San Gabriel Reservoir Post -Fire Restoration Project - San Gabriel, CA
Los Angeles County Public Works took action to repair and restore facilities affected by the Bobcat Fire. This
includes the removal of sediment from major dams and reservoirs, such as San Gabriel Reservoir.

Duration: September 2021- January 2022
Dollar Value of Services: $39,030
Description of Services: Performed and prepared a Geotechnical Analysis and Data Report related to the sediments
detained behind the San Gabriel Reservoir in Los Angeles. The purpose of our investigation was to assess if the
material was suitable for dewatering, evaluate for organics and if the specimens tested are hydrophobic, and
to assess if the material was suitable for reuse as engineered fill. Fenagh's scope of services included review of
existing data, plan, and submittal, logging of soil samples for Sonic Borings 1 through 5, field logging of Sonic
Boring 6, laboratory testing, and geotechnical analysis of the referenced data.

Fees and Billing Practices
Our standard scope of services is billed on a time and materials basis.
Invoices are prepared and distributed by the 15th of each month. Services rendered in any given month will be
billed out the following month (i.e. work performed in January will be invoiced in February, and so on.)
Invoice line items will detail the following:
• Date of Service
• Description of Services
• Hours/Units Billed
• Hourly/Unit Rate
• Total Invoice Amount Due
All invoices submitted are followed with corresponding backup information, which may include test results, DFR's,
project images, and personnel time sheets. Beyond the contracted project budget(s), no additional costs are
incurred.
Billing Coordinators will work closely with the assigned Project Manager(s) review all invoicing prior to submittal
to the District.
Services that are scheduled outside of our contracted scope will be communicated to the District prior to
scheduling, should the project budget(s) be affected.
Overtime Requests will be submitted to the District's Project Team prior to incurring any overtime hours.
Fenagh will not charge any "hidden fees", such as equipment and truck charges, administrative billings, etc.
Additional Costs
Fenagh will not be seeking compensation for additional fees, costs, expenses or reimbursable fees. Hourly rates
will include all necessary resources including labor, equipment, materials, reports, transportation, etc.
Rate Increases
The provided Schedule of Fees will remain fixed for each City fiscal year of the Agreement, unless formally
amended by the City Council. Fenagh acknowledges that adjustment of the Schedule of Fees can be negotiated at
the beginning of each fiscal year, but that the maximum increase shall be based on the applicable consumer price
index (CPI) rate, and that any rate increase must be approved in writing by the City.
Prevailing Wage
Fenagh, LLC is a registered contractor with the Department of Industrial Relations (DIR). We are compliant with
all prevailing wage laws and wage determinations.
Fenagh invoicing will be accompanied with copies of applicable certified payroll, as required by the City.

Fees for tests and inspection include cost of technician, normal equipment and regular reports. Engineering services other than supervisory will be charged at applicable rates. For engineers,
consultants, supervisors, and laboratory technicians traveling to a jobsite, standard federal rate per mile will be charged portal-to-portal for all projects. Fees for special projects, services
overseas, or elsewhere in the United States, will be quoted on request. With prior notification to Client; charges are subject to change at any time. Fenagh reserves the right to adjust the rates
quoted in this contract based upon any CPI/state mandated increases and/or changes in any industry requirements.

TESTS
Testing fees shown include normal time for performing test. Samples requiring special preparation will be charged at the laboratory technician rate. Fees for tests not listed will be quoted upon
request. There will be a minimum charge of $100.00 for any engineering report. Please note some tests maybe tested by sub consultants. Samples delivered to the laboratory after 3:00pm or
samples needing results within 24 hours will incur a 50% mark-up.
LIMIT OF LIABILITY
The total liability of Fenagh, LLC is limited to the contract dollar value.
INSURANCE
For the waiver of subrogation if required by client, a 3% Fenagh administrative fee will be added to all gross billings/revenue in addition to the 3% Project Management fee.
PAYMENT
Invoices will be submitted monthly for services performed during the preceding month and are payable on receipt. Interest of 1.5% per month (but not exceeding the maximum rate allowable
by law) will be payable on any amounts not paid within 30 days, payment thereafter to be applied first to accrued interest and then to the principle unpaid amount. Attorney's fees or other costs
incurred in collecting any delinquent amount shall be paid by client. Visa, MasterCard and American Express payments are accepted however fees will apply. Visa and MasterCard payments
require an additional 3% on top of the amount of the invoice being paid. American Express payments require an additional 4% on top of the amount of the invoice being paid.

Fenagh maintains a 10,000 square foot laboratory located in Rancho
Cucamonga, California. We have additional resources in our San Diego,
Northern California, and Phoenix facilities for any specialty testing that may
