SUBJECT: TEMPORARY USE PERMIT 2023-0003: SOLTERRA RECREATION AND POOL
BUILDINGS TEMPORARY GENERATOR
Dear Mr. Kinnett:
The City of La Quinta Design and Development Department has reviewed and approved
Temporary Use Permit (TUP) 2023-0003, for (1) temporary generator located within the Solterra
development, subject to the information on file and attached and the following findings and
conditions of approval.

• The proposal is consistent with the general plan and provisions of the zoning code. The
proposal is in compliance with the requirements of the California Environmental Quality
Act (CEQA) and would be exempt from CEQA pursuant to Section 15304, Minor
Alterations to Land.
• The proposal would not create conditions materially detrimental to the public health,
safety and general welfare or injurious to or incompatible with other properties or land
uses in the vicinity.
• The proposed use of the generator is temporary in nature and would be placed in an
area consistent with ground mounted equipment in residential areas. The generator
is located approximately 300 ft away from the nearest residence and is estimated to
generate noise levels under the exterior noise level limits in the Noise section of the
zoning code.
CONDITIONS OF APPROVAL:
1. The applicant agrees to defend, indemnify and hold harmless the City of La Quinta
("City"), its agents, officers and employees from any claim, action or proceeding to attack,
set aside, void, or annul the approval of this Temporary Use Permit. The City shall have
sole discretion in selecting its defense counsel.

The City shall promptly notify the applicant of any claim, action or procee mg a -
cooperate fully in the defense.
2. The generator shall be operated for primary building power 24 -hours a day or at intervals
that the building is occupied. At no point should the generator power be turned off or
disconnected for more than 24 -hours at which point the building fire alarm system's
batteries would be depleted and fail to adequately monitor the fire sprinkler system.
3. The temporary generator may be used until Imperial Irrigation District provides power to
the recreation and pool buildings or up to 6 months, whichever comes first. The generator
shall be removed within 7 days of either occurrence.
4. A separate building permit shall be required.
The City may elect to add Conditions to this application request to mitigate any problems that
arise not previously addressed herein. This decision may be appealed to the Planning
Commission by any party who submits the necessary paperwork and filing fee of $1,526.00 to
this office within 15 days of the date of approval of this permit.

TEMPORARY USE PERMIT—APPLICATION INFORMATION
DESCRIPTION OF ACTIVITY:
Request for Temporary Certificate of Occupancy on the Recreation and Pool Buildings and related
amenities. This request is due to having power for these facilities provided by a generator for a
temporary period of time. This was necessitated by extraordinary supply chain / lead time issues
associated with the electrical switch gear and internal components (that need to be installed prior to
I.I.D. pulling in permanent power to the building). The 400a main panel that the generator power will be
tied into is the equipment specified on the approved plans for the buildings.
The Rec and Pool Buildings, pool area, etc. will be complete at the time we request the TCO (target
7/7/23). All other conditions of occupancy will be met for Building, Fire, Planning, and Public Works. The
building occupancies and hours of operation will be as permitted. We will likely run the generator 24
hours a day to maintain the security and fire systems, however we are exploring battery backup for
overnight use.
Since we do not have solid dates for the permanent power, we request 180 days (we believe it will be a
much shorter time frame however).
SITF PI AN -
The generator will be placed in the location shown on the attached Site Plan. It will be located
approximately 1501f from the Rec Building.
SUPPLEMENTAL INFORMATION:
• Please see attached complete specifications for the generator. The model we have selected is
designed to be quiet at 69 dB(A). We discussed an operational site visit, which will hopefully
result in not having to prepare a Noise Control Plan or provide any further mitigation.
• Please see attached the requested Single Line diagram.
• The generator will not be located in the Public Right of Way. Therefore, no traffic control plan
has been provided.
• The generator will be surrounded by fencing.
• Power cords will be in conduit.
• Insurance certificates are already on file with the City of La Quinta.
