A regular meeting of the La Quinta City Council was called to order at 3:00 p.m. by Mayor
Evans.

CONFIRMATION OF AGENDA
City Manager McMillen requested to add "Proclamation in Recognition of California Native
American Day — September 22, 2023" as Item No. 1-A under the Announcements,
Presentations, and Written Communications section of the Agenda.
City Manager McMillen requested to pull Consent Calendar Item No. 6 from consideration
on tonight's Agenda.
Councilmember Pena noted that he will recuse himself during discussion and vote on
Business Item No. 1 due to a potential conflict of interest stemming from the proximity of
his real property interest to the project location, Fritz Burns Park.
Mayor Evans stated that she will need to leave the meeting starting around 6:00 p.m. for
about an hour, and requested Mayor Pro Tem Sanchez to assume presiding officer duties
in her absence.
Council concurred.

PUBLIC COMMENT ON MATTERS NOT ON THE AGENDA
PUBLIC SPEAKER: Jeff Fishbein, Chair of the La Quinta Chamber of Commerce,
Coldwell Banker realtor and La Quinta resident — provided an update on Chamber events
and activities, including the upcoming State -of -the -City scheduled for September 28,
2023, at Embassy Suites, and announcements of new businesses.
PUBLIC SPEAKER: Richard Gray, La Quinta — said new apartment projects in the City
with multiple stories should not be built without elevators; and expressed concerns about
the construction delays with the Talus project, formerly known as SilverRock.
PUBLIC SPEAKER: Nicole Trigg and Sean Webb, Board Members with Leadership
Coachella Valley (LCV) — said the LCV program is designed to identify, motivate, and
develop future community leaders, explained the program's objectives and structure, and
thanked the Council for their support.
PUBLIC SPEAKER: Patricia Ryan, La Quinta — said she is a 31 -year resident on Via
Coronado, a cul -du -sac of 15 homes in the non -gated La Quinta Del Oro residential
neighborhood, across from the Indian Wells Tennis Gardens; in May, two homes nearby
were purchased and now operate a business offering behavioral and health rehabilitation;
the business runs three shifts per day with 12 to 36 cars coming and going daily; California
Megan's Law (Penal Code Section 290.46) which mandates the California Department of
Justice to notify the public about specified registered sex offenders, doesn't apply to this
business; she doesn't feel safe in her home; two neighbors have moved due to unsafe
conditions; invited Councilmembers to visit to experience for themselves; requested that
Council adopt regulations to protect residents; employees of the facility have been
threatening; expects this business to purchase many more houses around the City;
believes the City was unaware of this business because it is "supportive housing"
permitted by the State; and the operation began a month ago.

City Manager McMillen stated that staff will investigate this business and any plan to
expand to other areas of the City, including licensing requirements and complaint
procedures.
PUBLIC SPEAKER: Jimmy Steinfeldt, La Quinta — moved from Los Angeles to the Gem
of the Desert about a year ago; he is very pleased with the City and the community; and
presented Council with a book of his photography, and will be giving a signed copy to the
La Quinta library.
PUBLIC SPEAKER: Lynne Daniels, La Quinta — submitted a request to speak form but
was not present to speak when called upon by the Mayor.

Mayor Evans explained the history and purpose of Native American Day.
PUBLIC SPEAKERS VIA TELECONFERENCE: Juan Villa, California Native American
Day Project Lead, representing Assemblymember James Ramos in accepting the
proclamation, and Jack Lugo, a member of the Band of Morongo Mission Indian and Field
Representative for Assemblymember James Ramos — Mr. Villa said Assemblymember
Ramos is the first California native American in the State legislature; provided a brief
history of Native Americans in California; announced the upcoming free celebration; and
thanked the Council for the honor of receiving this proclamation.

DIVISION CHIEF RICHARD TOVAR
Riverside County Fire Division Chief Bryan White introduced La Quinta Division Chief
Richard Tovar who is filling the newly added position; Chief Tovar gave a brief
presentation about his training, qualifications, and 27 -year experience, and said he is
excited to serve La Quinta.
Mayor Evans provided Division Chief Tovar's professional background, and thanked him
for his participation in the City's 9/11 Candlelight Vigil.
3. HUNGER ACTION MONTH — SEPTEMBER 2023 — PRESENTATION BY FIND
FOOD BANK VICE PRESIDENT OF DEVELOPMENT KELLY MUI-
CHESTERTON AND DEVELOPMENT AND COMMUNITY RELATIONS
MANAGER MARIELA SALAZAR
Vice President of Development Kelly Mui -Chesterton with Find Food Bank spoke about
the importance of providing assistance for Hunger Action Month; the efforts and
objectives; encouraged the community to join the movement to help end hunger this
month by volunteering or donating; and the benefits of Senate Bill 1383, food recycling.
Councilmember McGarrey said she serves on the board of Find Food Bank, which is a
volunteer position for which she does not receive any compensation.
4. PROCLAMATION IN RECOGNITION OF CONSTITUTION WEEK —
SEPTEMBER 17-23,2023, COMMEMORATING THE SIGNING OF THE UNITED
STATES CONSTITUTION
Constitution Week Committee Chair Deanne Bronaugh and First Vice -Regent Wendy
Becker, representatives of the Cahuilla Chapter of the National Society Daughters of the
American Revolution (NSDAR) spoke about the organization's efforts and objectives.
NSDAR Member Rosemary Hallick introduced Cheryl Schuler, history teacher at La
Quinta High School; Ms. Schuler spoke about her approach to teaching high school
juniors about the U.S. Constitution.
Council presented the NSDAR with a proclamation in recognition of Constitution Week
celebrating the 236' anniversary of the signing the United States Constitution in
September 1787.
PUBLIC SPEAKER: Alena Callimanis, La Quinta — said the NSDAR granted her a
scholarship many years ago which allowed her to attend college.

encouraging travel to the park on foot or by bicycle; community comments regarding the

PRESIDING OFFICER DUTIES FOR THE COUNCIL MEETING AND LEFT THE
DIAS AT 6:03 P.M.
Council discussed technical versus financial feasibility; post -construction landscaping
repair estimates; estimate of time to complete such a project — two to three years per
phase once everything is in place; undergrounding along the street versus the public
parkway; issues with private property easements; disruption to residents' service during
construction; the benefits of undergrounding utilities; incentives for homeowners to
connect to the new underground system; using existing Carson boxes to reduce costs;
possible need for homeowners to upgrade electrical panels; overlapping upcoming street
pavement project with the undergrounding project to reduce costs; partnering with
Frontier and Spectrum to share costs; and getting the message out to residents regarding
the importance of undergrounding utilities.
PUBLIC SPEAKER: Daryl Buckley, Manager of Energy Resource Planning for Imperial
Irrigation District (IID) La Quinta Office — stated that all IID's backbone infrastructure is in
the public right of way; this is easily a 10 -15 -year project for all the phases; in his two
years with IID, no underground conversions have occurred, but he has had many years
of experience in undergrounding utilities elsewhere.

PUBLIC SPEAKER: Alena Callimanis, La Quinta — submitted a request to speak form,
but was not present when called upon by the Mayor — provided written comments in
support of the project, which were included in the public record of the meeting.
PUBLIC SPEAKER: Joe Hammer, La Quinta — supports the project; owns property
adjacent to this project; and La Quinta needs moderately priced homes.
APPLICANT: Kris Pinero, Project Manager with Rodeo Credit Enterprises, LLC —
introduced the project team, and provided a brief presentation of the proposed project.
Council discussed the ability to make left turn out of the project site; public outreach and
community meetings held; price point for homebuyers just a guess — maybe $700,000;
possible builders for the project; cost of IID substation and necessary upgrades; lot sizes;
setbacks; increased density concerns; parking requirements; safety reason for narrowing
streets; pros and cons of the proposed 44 guest parking spaces; no IID "will -serve" letter
has been issued; commitment from IID is a major issue; positive comments regarding the
architecture; homeowners association (HOA) and short-term vacation rentals (STVR);

project increases housing inventory, but not State -mandated affordable housing
inventory; Council's inability to decrease unit density for the site once the zoning/Master
Plan is approved for this project; number of previous projects where the Council increased
density; density requested is in a rural area, this area does not have the needed essential
services nearby; if approved, this density would be a precedent; may be good as a STVR
community; good project, but in the wrong location; changing zoning and the General
Plan is a major matter; residents in the Sphere of Influence are unlikely to support this
high density in this rural area; in time when the area develops more, perhaps this density
will be appropriate; results of market research regarding this type of project; process for
a Development Agreement; and approving the change removes Council's flexibility,
without having any guarantee of this project being built -out.
APPLICANT'S CONSULTANT: Henrik Nazarian, Civil Engineer with D & D Engineering,
Inc. — provided a brief presentation of the proposed project, and possible Conditions of
Approval that Council can impose; the project could be net zero energy -wise; and listed
similar projects in other California cities.
PUBLIC SPEAKER: Joe Hammer, La Quinta — supports the project; believes it will spur
surrounding residential and commercial development.
PUBLIC SPEAKER: Kim Hammer, La Quinta — supports the project; adjacent
homeowners are not objecting; and the free market should decide.

• The California Parks and Recreation Society (CPRS) Maintenance Management
School (MMS) is a five-year program that provides participants with a systematic
approach to resources management.
• Year three of MMS focuses on leadership and management.
FISCAL IMPACT
Estimated cost is $1,850, which includes registration, travel, lodging, parking, and meals.
Funds are available in the 2023/24 Parks Maintenance budget (Account No. 101-3005-
60320).
BACKGROUND/ANALYSIS
The CPRS Maintenance Management School is a five-year program focused on
resources management to maintain public facilities. Year three focuses on leadership,
critical thinking, delegation, and time management. The program consists of five days of
intense educational and group sessions, and networking opportunities.

Section 2.06.090 of the La Quinta Municipal Code states: "If any member of a board,
commission or committee absents him or herself from two consecutive regular meetings,
or absents him or herself from a total of three regular meetings within any fiscal year,
his/her office shall become vacant and shall be filled as any other vacancy. A board,
commission or committee member may request advance permission from the city council
to be absent at one or more regular meetings due to extenuating circumstances, and/or
may request the city council to excuse an absence after -the -fact where such extenuating
circumstances prevented the member from seeking advance permission to be absent. If
such permission or excuse is granted by the city council, the absence shall not be counted
toward the above -stated limitations on absences."

Eisenhower Drive between Avenida Fernando and Coachella Drive.

• The project will repair slopes that failed due to tropical storm Hilary. The

needs to be placed back to protect the liner from UV light.
• This project is not currently apart of the City's Capital Improvement Program (CIP).
Staff is currently only requesting authorization to advertise and will present bids
and request for funding at a separate meeting.

There is currently no fiscal impact to advertise the project. City Staff is working with the
other stakeholders for opportunities to cost share. The following is the anticipated project

BACKGROUND/ANALYSIS
The PMP funds improvements to maintain and upgrade City roadways. The PMP is divided
into phases and the City typically implements PMP projects during the summer, when traffic
congestion is less. This fiscal year's improvements will slurry over 1,800,000 square feet
of pavement and include minor pothole hole repair and minor striping improvements. The
striping improvements mostly include better delineation for bike lanes and adding green
paint backgrounds.

AGREEMENT FOR CONTRACT LEGAL SERVICES WITH RUTAN & TUCKER, LLP
RECOMMENDATION
Approve Amendment No. 1 to the Amended and Restated Agreement for Contract Legal
Services with Rutan & Tucker, LLP.
EXECUTIVE SUMMARY
• Current City Attorney, Bill Ihrke, was appointed by Council as City Attorney on July
1, 2014, and Rutan & Tucker LLP has served as the contract City Attorney's Office
since 2000.
Since the current City Attorney's appointment, there has not been a rate increase,
except for a modest adjustment to the retainer amount for attendance at City
Council meetings and office hours.
• Proposed Amendment No. 1 has modest increases, at very competitive rates, for
general municipal counsel services to account for inflation and other factors
impacting the costs to provide legal services.
FISCAL IMPACT
The proposed rates are set forth in Amendment No. 1 (Attachment 1) and would be
effective October 1, 2023. A summary of the proposed rates is below.
BACKGROUND/ANALYSIS
Because hourly rates (except for the retainer amount) for legal services have not been
increased since at least July 2014, increases are proposed to account for inflation and
changing industry standards for providing high-quality legal services for the City.
Changing industry standards include the increased expectations for expertise in a
multitude of legal practices. For example, the State Legislature over the last several years
enacted many laws affecting housing and land use planning, among other subject
matters. All of these new laws, and related court decisions and administrative directives,
impact the provision of legal services to the City Council, City Manager, and City Staff.

As with most contracted consulting services, the contract City Attorney's Office is paid
based on hourly rates that are set depending on a handful of factors, such as (i) seniority
of attorneys performing the work (e.g., partner or associate performing services), (ii)
specialized nature of the legal work (e.g., litigation involving challenges under the
California Environmental Quality Act (CEQA)), and (iii) other mutually agreed upon criteria
(e.g., bond counsel design rates). A summary of the proposed rates are as follows:

The proposed rates remain very competitive among contract city attorneys not only in the
Coachella Valley, but statewide. Moreover, the City Attorney's Office will continue to
provide services efficiently and effectively, recognizing that the City has limited funding
resources. Finally, based on the fact that the City Attorney's Office has come well within
budget at the conclusion of the most recent fiscal years, it is anticipated that there will not
need to be any budget adjustment for the current fiscal year (FY 2023-24) even if the
proposed rate increases are approved by the City Council.
L. TERNATIVES
Council may elect not to approve the proposed Amendment No. 1. However, because
the contract City Attorney's Office has not had a general rate increase for over nine years,
and because inflationary and other factors have impacted the provision of legal services,
it is recommended that Council approve this Amendment No. 1.

TO AMENDED AND RESTATED
AGREEMENT FOR CONTRACT LEGAL SERVICES
THIS AMENDMENT NO. 1 ("Amendment") to the current AMENDED AND
RESTATED AGREEMENT FOR CONTRACT SERVICES made and entered as of July 1,
2016 ("Current Agreement") by and between THE CITY OF LA QUINTA ("City"), a California
municipal corporation, the SUCCESSOR AGENCY TO THE FORMER LA QUINTA
REDEVELOPMENT AGENCY ("Agency"), a California public entity, the LA QUINTA
HOUSING AUTHORITY, a California public entity ("LQHA"), the LA QUINTA
FINANCING AUTHORITY, a California public entity ("LQFA"), and RUTAN & TUCKER,
LLP ("R&T") a Limited Liability Partnership, is effective as of October 1, 2023 ("Amendment
Effective Date"). The parties hereto agree as follows:

SCHEDULE OF COMPENSATION
I. CITY ATTORNEY AND AGENCY'S/AUTHORITIES' COUNSEL.
For services rendered by Rutan & Tucker, LLP, the City, Agency, LQHA and LQFA
hereby agree to pay the following fees:
A. Retainer Amount.
1. A flat retainer rate of $13,200 per month shall be paid:
(a) For Council Meeting Weeks: On Council meeting Tuesdays, the
hours at City Hall shall be 10:00 a.m. until the end of the meeting,
and 8:00 a.m. until noon, and then from 1:00 p.m. to 5:00 p.m. on
the following Wednesday. These hours will generally be handled
by the designated City Attorney unless ill or otherwise unavailable.
(b) For Planning Commission Weeks: On the Tuesday of the
Commission meeting, the hours at City Hall shall be one hour prior
to the start of the Planning Commission meeting until the end of that
Planning Commission meeting. These hours are optional and will
be handled by the designated Assistant City Attorney unless ill or
otherwise unavailable, and only if attorney attendance at these
meetings is requested.
(c) With the consent of the City Manager, the City Attorney may
occasionally adjust the City Hall hours to accommodate scheduling
needs.
(d) The retainer may be reduced by $5,000 for each bi-monthly City
Council meeting (and related Tuesday/Wednesday office hours) that
is cancelled and attendance of the City Attorney for those related
Tuesday/Wednesday office hours is not required.
B. Additional Amounts for General City Attorney Services.
1. All hours for general attorney services (in addition to the Retainer Time)
shall be billed at $265 per hour for attorney services, $150 per hour for all
paralegals, and $50 per hour for document clerks.

II. SPECIAL SERVICES RATES.
For special services rendered by R&T, the City, Agency, LQHA and LQFA agree to pay
the following fees:
A. For services rendered in connection with any litigation or threatened litigation
matter as described in Section ILA. of Exhibit "A," or for special transactional services the
following fees shall apply:
$300 per hour for all partners. On special matters, and with the advance
permission of the City Council, a "Special Partner Rate" of $365 per hour
may be imposed for litigation matters requiring a high degree of specialty
outside the normal.
2. $270 per hour for all associates.
3. $150 per hour for all paralegals and $50 per hour for all document clerks.
B. For services rendered in connection with other special legal services, such as labor,
telecommunications, post -redevelopment, hazardous and toxic materials, and other "non -general
matter" legal services, but not including bond services, the following fees shall apply:
$300 per hour for all partners.
2. $270 per hour for all associates.
3. $150 per hour for all paralegals.
C. Bond Counsel.
For services rendered by R&T acting as Bond Counsel, the City, Agency, LQHA and
LQFA hereby agree to pay the standard hourly design rates for R&T attorneys who perform bond
services, subject to any maximum amount of payment for bond services, agreed upon by R&T and
the City, Agency, LQHA and/or LQFA, as part of any bond issuance. In no event shall R&T be
paid based on a percentage of a bond issuance, nor shall R&T be paid additional contingent
compensation based on whether and under what terms the City, Agency, LQHA or LQFA enters
into a separate contract for a bond issuance. Notwithstanding any provisions in the Agreement,
this Section II.0 of Exhibit `B" is applicable starting January 1, 2016.
D. Costs.
All travel time shall be billed (except for in conjunction with Retainer Work or Bond
Counsel work) but no travel charges to the desert area (i.e., mileage or hotel) shall be charged.
Charges for travel outside the Riverside or Orange County area will be subject to approval by the
City Manager. No long distance telephone charges within the Orange and Riverside County areas
would be billed. All other out-of-pocket charges (i.e., copying at $.19 per page, Lexis or Westlaw
charges, telecopying, messenger charges) shall be charged at standard rates.

E. Reimbursement Rates.
For all matters for which the City, Agency, LQHA or LQFA is entitled to reimbursement
for R&T's services from third parties, R&T's rates shall be its standard applicable hourly design
rates. If the City is unable to obtain reimbursement for any reason, the City, Agency, LQHA or
LQFA shall be credited with the differential between the above scheduled rates and the standard
applicable hourly design rates, or shall be entitled to a refund of the differential, at its or their
option.

EXECUTIVE SUMMARY
• Council considers Community Services Grants and Economic
Development/Marketing & Sponsorship funding requests three times per fiscal
year.
• Thirteen grant applications were received and reviewed by the Community
Services Grant Ad Hoc Committee (Committee).
FISCAL IMPACT
The total 2023/24 grant budget is $100,000 allocated to Community Services Grants
(Account No. 101-3001-60510). Thirteen organizations submitted a total of $50,450 in
grant requests. The Committee recommends funding $24,950 of these requests. If
approved, the remaining balance would be $75,050.
BACKGROUND/ANALYSIS
Grants are awarded to 501(c)3 non-profit groups and organizations that benefit La Quinta
residents and strengthen the business community. Grants are limited to $5,000 per
request and consecutive fiscal year funding is not allowed (Attachment 1).
The Starter Grant category is for an organization applying for the first time. This allows
first-time applicants up to $500 of funding and eligibility to apply again the next fiscal year.
The Committee, comprised of Councilmembers Pena and McGarrey, reviewed all

Recommended Grant Reauests:
1. American Association of University Women Inc. (AAUW CA SPF) is requesting $5,000
in Community Services funding to support scholarships for 7t" grade girls to attend the
Tech Trek program, a week-long academic residential summer camp ($1,200 each
participant), on a college campus to participate in immersive STEM subjects.
Participants that are selected to attend the Tech Trek program can increase their
comprehension of math, technology, engineering, and science principles in this summer
camp program. Many students continue to higher education and find employment in
STEM career fields. College campuses that have participated include UCSB, UCSD,
Whittier, and UC Irvine. American Association of University Women Inc. is a first-time
applicant to the Community Services Grant Program. The Grant Review Committee
recommends funding $2,500.
2. Alzheimer's Coachella Valley (ACV) is requesting $5,000 in Community Services
funding to support the expansion of ACV's no -cost programs and services to East
Valley cities. Individuals with cognitive impairment and their caregivers/families will have
access to a variety of services that include support groups and health screenings.
Through ACV's partnership with College of the Desert's mental health nursing rotation
program, they have identified unmet needs for programs and services for those living
with cognitive impairment and their caregivers in the East Coachella Valley. Alzheimer's
Coachella Valley (ACV) is a first-time applicant to the Community Services Grant
Program. The Grant Review Committee recommends funding a $500 Starter Grant.
This organization will be eligible to apply again for the Community Services Grant
program for FY 2024-25. The committee also recommends that if this organization
applies again in FY 2024-25, they provide more detail on how their
programs/services operate and directly serve La Quinta residents.
3. Assistance League Coachella Valley is requesting $2,000 in Community Services
funding for their Operation School Bell program. This program provides new school
clothing and hygiene supplies for children in need in the Coachella Valley. Operation
School Bell will provide these items to approximately 750 students attending Desert
Sands Unified School District (DSUSD) schools during the year. Funds provided will
help cover the $200,000 needed for clothing (shirts, shoes, socks, undergarments) and
$20,000 for hygiene kits (brush, comb, toothbrush, toothpaste, dental floss, shampoo,
soap, deodorant). This organization was last funded $1,500 in 2021/22. The Grant
Review Committee recommends funding $2,000. The committee also
recommends that the organization provide data on the number of students in La
Quinta schools that received assistance through the Operation School Bell
program.
4. Autism Society Inland Empire is requesting $5,000 in Community Services funding to be
used for their annual Halloween Spooktacular Trunk -or -Treat community program taking
place on October 21, 2023, at La Quinta Community Park. This program is in
partnership with Desert Recreation District (DRD) and will serve the local Autism and

Intellectual/Developmental Disability community. This organization was last funded
$2,000 in 2020/21. The Grant Review Committee recommends funding $2,500.
5. La Quinta High School Blackhawk Boosters (Aquatics) is requesting $5,000 in
Community Services funding to purchase 3 weightlifting platforms for the weight room.
These platforms will provide a safe and level foundation for student athletes to work on
their muscle strength and conditioning. This organization was last funded $5,000 in
2018/19. The Grant Review Committee recommends funding $5,000.
6. La Quinta High School Boys & Girls Water Polo Team is requesting $5,000 in
Community Services funding to purchase uniforms (caps, suits, robes or parkas, hats, t -
shirts) and replace broken equipment (shade canopies). This organization was last
funded a Starter Grant in the amount of $500 in 2022/23. The Grant Review
Committee recommends funding $5,000.
7. LifeStream (Blood Bank of San Bernardino & Riverside Counties) is requesting $2,500
in Community Services funding to be used for the construction of 2 large walk-in
freezers (1,300 cu. ft. each) that will store life-saving blood products until they are
delivered to local hospitals to help patients in need. These new freezers will be a major
component of their San Bernardino lab renovation and expansion. This location is the
main lab that processes, tests, and stores the blood collected from La Quinta and
Rancho Mirage blood donor centers and eventually helps patients at all three Coachella
Valley hospitals. This organization was last funded $1,000 in 2012/13. The Grant
Review Committee recommends funding $2,500.
8. The Rotary Club of La Quinta Foundation is requesting $5,000 in Community Services
Funding to send 11 high school students to attend the annual Rotary Youth Leadership
Awards Camp (RYLA). This 3 -day leadership conference, held in Crestline, allows
outstanding high school Juniors the opportunity to further develop their leadership skills.
The fee for 2023 is $450 per camper. This organization was last funded $4,900 in
2018/19. The Grant Review Committee recommends funding $4,950.
Grant Requests not recommended for funding and/or did not meet the criteria in the Grant
Guidelines include:
9. Association of Funding Professionals (AFP) CA, Desert Communities Chapter is
requesting $3,000 in Marketing and Sponsorship funding to be used for National
Philanthropy Day® in the Desert on November 3, 2023, for their annual luncheon event.
The City of La Quinta will receive media coverage, a table for 8 guests, will be
spotlighted with a full-page ad in the Tribute Book, receive acknowledgement at the
podium on video screens, and a listing on the AFP Desert Communities website. AFP
CA, Desert Communities Chapter is a first-time applicant to the Community Services
Grant Program. The Grant Review Committee does not recommend funding for
this organization at this time.
10. Bighorn Institute is requesting $2,500 in Marketing and Sponsorship funding for their
Annual Party and Golf Classic 2 -day event being held on November 19 and 20. Gold

Sponsorship at this amount includes 1 playing spot in the Golf Classic and 2 tickets to
the Annual Party (valued at $1,000) as well as recognition in all event materials. Bighorn
Institute is a first-time applicant to the Community Services Grant Program. The Grant
Review Committee does not recommend funding for this organization at this time.
11. CA Care Force is requesting $5,000 in Community Services funding to be used to
provide seniors, veteran, and families with no cost oral health services and oral health
education along with connecting them to a future dental home. CA Care Force is a first-
time applicant to the Community Services Grant Program. The Grant Review
Committee does not recommend funding for this organization at this time.
12. Girls Rising is requesting a $500 Starter Grant for promotion and outreach for the Girls
Rising Mentorship Program. This program serves at -risk girls, ages 8-17, and
addresses the need for intervention, equips them with necessary tools/support to make
positive choices, engage in health behaviors, and live happy and healthy lives. Their
curriculum includes events and workshops about topics such as social media/bullying,
self-esteem, self-care, and hygiene. Their program is year-round with mentors and
mentees meeting 2-4 times per month. The Grant Review Committee does not
recommend funding for this organization at this time.
13. Nehemiah Charitable Fund is requesting $5,000 in Community Services funding to be
used for their Emergency Assistance Program to provide critical basic needs to
individuals and families. The program provides emergency food vouchers, motel
vouchers, utility assistance, and transportation (bus passes) for seniors and/lor the
disabled. This organization was last funded a Starter Grant in the amount of $500 in
2022/23. The Grant Review Committee does not recommend funding for this
organization at this time.

EXECUTIVE SUMMARY
• Residents submit nominations for the City's annual Veterans Recognition
Ceremony.
• Nominations are reviewed by staff and submitted to City Council for approval.
• Once approved, the veterans' names, ranks, and dates of service are engraved on
the Veterans Acknowledgement Monuments at the Civic Center Campus.
FISCAL IMPACT
The cost to engrave the veterans' information on the Acknowledgement Monuments is
approximately $1,100 and funds are available in the Special Events and Experiences
Account (101-3003-60149).
BACKGROUND/ANALYSIS
Every year residents submit nominations for the City's Veteran Recognition Program.
Staff review the nominations to ensure they meet the City's criteria and then submit the
nominations for Council consideration. If selected, the Veterans' names, ranks, and dates
of service are engraved on the Veterans Acknowledgement Monuments at the Civic
Center Campus. Program requirements include:
• Active military who served in 1954 and after must be a past or current resident for
a minimum of three years;
• Active military who served in 1953 and before must be a past or current resident;
no minimum years;
• Honorable discharge from service; and
• Proof of military service

All branches of the military identified by the Department of Veterans Affairs, including
reservists who served a minimum of six years, and merchant marines who served in
active duty, are considered.
As part of the Veteran's Recognition Ceremony, Council will recognize each veteran with

My husband has faced many of his demons over the last 3 years and I was hoping to acknowledge his achievements. He has PTSD and a TBI. And over the last 3 years he's
been sober, has volunteered his time and efforts with Mighty Oaks (a wounded warrior program) and with the Loma Linda VA program to help other veterans become sober.

Hello! My name is William K. Brogan, Sr., and I wish to apply for this great Program! I will commence
with a short history of who I am, and why I might qualify!
My wife and I purchased our home here in La Quinta in the Bella Vista community, at
and moved -in on January 20, 2003. Bella Vista is located on the north side of Fred Waring Drive just east
of its intersection with Washington Street. I shall always remember "moving -in day" as it was raining!
I have attached a copy of the LQ Veterans Information Form along with my DD -214 Form and copies of
my 2 Honorable Discharges.
I was drafted by the US Army during the first week of February 1957. Shortly afterwards, at the
completion of my pre -induction physical at the (since closed) Schuykill Arsenal in South Philadelphia, I
was escorted into the Captain's office where he asked me if I would like for a Recruiting Sergeant to visit
me at my home to see if I would like to go to one of the Army's schools (because I had done very well in
all of their tests). I agreed to this! So, when the Recruiting Sergeant arrived, and we covered all the
schools that a 2 -year draftee could attend, l wasn't impressed. Then I was shown schools that required
a 3 -year enlistment to attend — and "bingo" there was a 44 week school at Ft. Bliss in EI Paso, TX to
become a NIKE AJAX Fire Control & Maintenance Specialist -- so I agreed to a 3 -year enlistment. While I
waited for a letter from the Army's Commandant Office in Washington D.C. for placement in the next
class opening, I was placed temporarily in an Enlisted Reserve Group with inactive status.
When the letter from Washington D.C. came, I enlisted into the Reguiar Army and was "mustered" out
of the Enlisted Reserved Group (that's when I received my 1st Honorable Discharge). After S weeks of
Basic Training at Ft. Jackson in South Carolina (US 3RD Army), a short furlough home, and a train trip from
Philadelphia, PA to El Paso, TX, via St. Louis, MO, Texarkana, TX, and Dallas, TX, (this time in the US 4th
Army) and 40 weeks of NIKE AJAX School and 12 weeks of transition school on the NIKE HERCULES
Missile System, I was selected to be an Instructor at the school.
I was an instructor for 6 months until the school closed down for Christmas & New Year's holidays in
1958, and everyone went their separate ways home. When I returned to the base after the holidays, I
had orders to be transferred to West Germany to the biggest Dual NIDE AJAX/HERCULES site that the
Army had built! I left New York Harbor that January 1959 on an amazing 3 -week troopship voyage with
about 200-225 other GIs, to Bremerhaven, West Germany. On the way, we encountered freezing
weather, a North Atlantic hurricane that almost foundered the ship, sailed across the brown waters of
the Gulf Stream carrying with it Summer-like weather as it coursed towards Iceland, then back to
freezing weather for the remainder of the trip around the White Cliffs of Dover, England, up the English
Channel and the North Sea to Bremerhaven, West Germanyl An unforgettable 3 week sea journey!
After a train trip south to Frankfurt, and an Army truck pickup to my new base (McCully Barracks)
outside the town of Wackernheim in the Rhine Valley,! became a member of USAEUR Group as a radar
specialist for the biggest Dual Nike Ajax/Hercules Missile site the Army had built. In the Spring of 19601
extended my enlistment for an additional 6 months for a total of 3% years of active duty (as signified on
my 2"" Honorable Discharge). Shortly afterwards, all the Nike sites were transferred over to the US 7t"
Army. So, for the 4a' time, I had to change my uniform patches, this time to the "7 Stairsteps to Hell"
patch for the US 7h Army. I can truthfully say that I am very proud to have been able to serve in our
country's Armed Forces! Near the end of my tour of duty in late October 1960,1 made my way back to
Bremerhaven for my second sea voyage, this time on a larger, more pleasant ship home — via north in

the English Channel along the East coasts of England and Scotland, westward below Iceland, then on to
Greenland - where we docked to pick up a US Navy Construction Battalion (or "SEABEES").
I was given all-night armed guard duty on the deck of the ship during this voyage home — to keep the
returning GIs separated from the quarters of the returning Officers' family quarters! I was able to see
some amazing sights, such as the Aurora Borealis (or Northern Lights) streaking above in the Artic skies,
plus the "phosphorescence" of certain sea creatures that were disturbed by the ship's passing!
We then proceeded to the Seabees home base in Providence, R.I., dropped them off there, and then
continued on to New York harbor to conclude our trip! One of the most memorable things that ever
happened to me, while waiting to disembark the ship, was hearing music emanating from the dock
below. Upon glancing over the ship's railing, I saw that it was the Salvation Army Band welcoming us
homes What a wonderful and unforgettable experience that was! Once we disembarked the ship, the
Army had buses waiting to take us to Fort Dix, N.J. for separation from military service. The date was
November 3, 1964. My older brother Charlie (since deceased) drove from his Malvern, PA home in a
heavy rainstorm that evening to take me back to my Mother's home in Wayne, PAI The end of a
wonderful 3% years of active duty in the U.S. Army!

STAFF REPORT
AGENDA TITLE: APPROVE AN AMENDMENT TO COOPERATIVE AGREEMENT
WITH THE COUNTY OF RIVERSIDE, FOR FIRE PROTECTION, FIRE PREVENTION,
RESCUE, FIRE MARSHAL, AND MEDICAL EMERGENCY SERVICES, TO ADOPT
THE MUNICIPAL STAFFING MODEL AND MODIFY STAFFING LEVELS AT FIRE
STATION 93
RECOMMENDATION
Approve an Amendment to Cooperative Agreement with the County of Riverside, for fire
protection, fire prevention, rescue, fire marshal, and medical emergency services, to adopt
the Municipal Staffing Model and modify staffing levels at Fire Station 93 as detailed in
Attachment 1 to this staff report.
EXECUTIVE SUMMARY
• The City contracts fire services from Riverside County Fire Department (County
Fire) to provide fire suppression, emergency medical services, fire prevention,
hazardous materials response, and specialty technical rescue services.
• The contract includes fire staffing for all three City fire stations, 24 hours a day.
• Each City fire station/engine is staffed with three personnel daily, which includes
(1) driver and (2) firefighters. The driver can be a Captain or a Fire Apparatus
Engineer.
• The National Fire Protection Association (NFPA) and California Department of
Forestry and Fire Protection (CALFIRE) have adopted a "Municipal Staffing Model"
throughout most of the State of California, which staffs a Captain position to a fire
station 24 hours a day.
• County Fire recommends adopting the Municipal Staffing Model to increase the
safety and productivity of fire staff and align staffing levels with other cities in
California.
FISCAL IMPACT
The net annual increase is estimated to be approximately $40,000 (Attachment 1). Funds
are available in the General Fund — Fire Budget for fiscal year 2023/24.

BACKGROUND/ANALYSIS
The City contracts with County Fire, which contracts with CALFIRE to provide fire
services. The City's Fire contract provides three (3) fire personnel at each fire
station/engine per shift. County Fire uses the standard CALFIRE 72 -hour shift schedule
on a monthly rotation.
The City's fire stations/engine are currently either staffed with a Fire Apparatus Engineer
(driver operator) and two (2) firefighters or a Captain and two (2) firefighters. Under the
current model, a Captain is only available for one 72 -hour shift a week, thus leaving less
experienced staff without the support of a Captain for approximately 96 hours during a
seven-day period. For this reason, NFPA and CALFIRE have adopted the Municipal
Staffing Model throughout the State of California. This model provides a Fire Captain 24
hours a day, seven days a week, per station/engine, thus providing leadership, guidance,
and oversight on a continuous basis.
Per the NFPA, CALFIRE, and County Fire, the Municipal Staffing Model provides better
management at each fire station and engine. A Fire Captain is available during all shifts,
which improves coordination of work, performs managerial and administrative functions,
and can mentor fire station staff. In addition, in critical moments, a Captain's experience
can minimize risks, and increase fire staff effectiveness.
On June 1, 2021, Council approved the City's Cooperative Agreement (Agreement) for
fire services with County Fire for fiscal years 2021-2024. On October 19, 2021, Council
approved a first amendment to the Agreement to add a Fire Marshal Inspector position.
On June 6, 2023, Council approved a second amendment to the Agreement to add a Fire
Safety Supervisor position. If approved, this proposed third amendment will adopt the
Municipal Staffing Model and modify staffing levels at Fire Station 93 as detailed in
Attachment 1.

SUBJECT DUNE PALMS ROAD BRIDGE PROJECT NO. 2011-05 ROAD CLOSURE
UPDATE
As noted in the September 19, 2023, Dune Palms Bridge Project (Project) Storm Damage
Update department report, Tropical Storm Hilary and subsequent September 1, 2023
storm significantly impacted the Dune Palms Road Bridge Project. The temporary bypass
road constructed on Dune Palms Road and the bridge falsework being erected for the
northbound Stage 1 Bridge were severely damaged by the storm events. The temporary
bypass road was destroyed and has caused an extended closure of Dune Palms Road.
The contractor, Ortiz Construction Enterprises, Inc. (Ortiz) has removed the east side of
the damaged temporary bypass road and has removed water and mud from the project
site. The remediation of the Project site is anticipated to continue through mid-October.
Once the soil is stable and the Project site has been remediated, the bridge falsework will
be reconstructed. Ortiz has placed construction fencing to keep residents, specifically
pedestrians, safely out of the Project area and harm's way.
Extensive assessment of the storm damage and impacts on the project show that Dune
Palms Road must remain closed. Given the current subsurface conditions in the
channel and construction logistics, the earliest a bypass road could be completed would
be mid-December.
Safety of our residents, combined with additional work that could cost in excess of $1
million and anticipated heavier than normal rainfall this winter creating the potential for
more damage, are primary considerations in deciding to extend the road closure until
further notice. The Project team is working to accelerate construction of both east and
west traffic lanes in an effort to have the east half of the bridge open to traffic in March
2024. This effort will greatly improve the overall Project schedule and help keep costs
within budget.
Staff has been communicating and coordinating with community stakeholders such as
Sunline, La Quinta High School, Desert Sands Unified School District, and nearby
residents and businesses to explore options to minimize impacts and ensure awareness
of this closure. A pedestrian plan is under development and business outreach is
underway.

Commissioners' schedules. The Commission concurred.
Management Analyst Kinley noted the City Council and Housing Authority will hold the
City's annual Boards and Commissions interviews on June 30, 2023, starting at 9:00 a.m.;
applicants must be present for consideration.

Professionals earn California state -approved Continuing

Meaningful Conversations
This two-part series helps families, friends and
caregivers prepare for a positive visit experience and
alleviate stress for both the patient and visitor.
Breathing Space is our scholarship program for
family caregivers to hire a temporary licensed
caregiver for their loved one with dementia so that
the family caregiver can take much-needed respite
time for him / herself.
Community Outreach/Speakers Series
ACV's professional volunteers are available to speak
on a variety of topics related to Alzheimer's /
dementia, in-home and other care options, as well as
community resources.

B3 — Approve an Amendment to Riverside
County Fire Services Agreement

Background
• City contracts with the County of Riverside for fire services; the current agreement
includes fire staffing for all three City fire stations, 24 hours a day.
• Each fire station/engine is staffed with three personnel daily, which includes (1)
driver and (2) firefighters. The driver can be a Captain or a Fire Apparatus
Engineer.
• The National Fire Protection Association (NFPA) and California Department of
Forestry and Fire Protection (CALFIRE) have adopted a "Municipal Staffing
Model" throughout most of the State of California, which staffs a Captain position
to a fire station 24 hours a day.
Recommendation
• County Fire recommends adopting the Municipal Staffing Model to increase the
safety and productivity of fire staff and align staffing levels with other cities in
California.
— Under the current model, a Captain is only available for one 72 -hour shift a
week, thus leaving less experienced staff without the support of a Captain for
approximately 96 hours during a seven-day period.
— Municipal Staffing provides a Fire Captain 24 hours a day, seven days a
week, per station/engine, thus providing leadership, guidance, and oversight
on a continuous basis.
Fiscal Impact
The net annual increase is estimated to be approximately $40,000 Funds are
available in the General Fund — Fire Budget for fiscal year 2023/24.
