SUBJECT: TEMPORARY USE PERMIT 2023-0004: TEMPORARY SALES OFFICE
MILES AVE AND WASHINGTON ST
Dear Ms. Williams:
The City of La Quinta Design and Development Department has reviewed and approved
Temporary Use Permit (TUP) 2023-0004, for a temporary sales office located at the southeast
corner of Miles Ave and Washington St, subject to the information on file and the following
findings and conditions of approval.
FINDINGS
The proposal is consistent with the general plan and provisions of the zoning code. The
temporary sales office would be a relocatable building which is a temporary use permitted
in the underlying Tourist Commercial zone.
The proposal would not create conditions materially detrimental to the public health,
safety and general welfare or injurious to or incompatible with other properties or land
uses in the vicinity.
CONDITIONS OF APPROVAL:
1. The applicant agrees to defend, indemnify and hold harmless the City of La Quinta
("City"), its agents, officers and employees from any claim, action or proceeding to attack,
set aside, void, or annul the approval of this Temporary Use Permit. The City shall have
sole discretion in selecting its defense counsel. The City shall promptly notify the applicant
of any claim, action or proceeding and shall cooperate fully in the defense.
2. This Temporary Use Permit shall be valid for a period of two years from the date of this
approval.
3. Applicant shall comply with the requirements for Fugitive Dust Control per Chapter
6.16.040 of the La Quinta Municipal Code.

4. Any damage to public hardscape caused by this use shall be repaired as directed by the
City Engineer. This includes but is not limited to sidewalks, curb and gutter,
landscaping, and pavement especially within the surrounding public streets.
5. A separate Temporary Trailer permit shall be obtained from the Building Division, please
contact the Permit Center at (760) 777-7125 or customerservice@laquintaca.gov for
submitting the following information:
a. Provide a complete Site Plan showing north arrow, property lines and lot
dimensions, location of existing curbs, all existing and proposed structures,
setback dimensions, and utility locations.
b. Provide electrical information on plan showing: Service panel, ampacity and
location; Grounding size, location and method; Conduit size and location from
service panel to trailer; Number of conductors, their size, material, and insulation
type. See CEC Articles 215, 220, 230, 240, 250 and 310.
c. Trailer information/specifications and anchorage design; A registered design
professional is required to stamp and sign each sheet of the anchorage design and
it is required to be specific to the site.
d. Commercial Modular Structures proposed for use require the verification of
insignia from the California Department of Housing and Community Development
(HCD), the state agency that regulates the construction and certification of factory
built housing and commercial structures.
e. Any building, structure, facility, complex or improved area, or portions thereof,
which are used by the general public shall be provided with a barrier free design,
to ensure that these improvements are accessible to and usable by persons with
disabilities, plans shall fully detail how the proposed construction complies with the
California Accessibility Standards defined in Title 24 Chapter 11 B and Federal
ADA Regulations.
6. Fire Department emergency vehicle apparatus access road locations and design shall be
in accordance with the California Fire Code, La Quinta Municipal Code and Riverside
County Fire Department Standards. Certain designed areas will be required to be
maintained as fire lanes and will require approved signs and/or stenciling in red with CVC
22500.1 conspicuously posted.
7. Vehicle access gates shall be provided with KNOX Box, Padlock or Key -switch access.
Automatic gates shall also have Opticom IR receivers.
8. Approved street signs shall be installed and visible.

9. No Traffic Calming Devices shall be installed.
10. The Fire Department approved plans and conditions letter must be at the job site.
11.Applicant/installer shall be responsible to contact the Fire Department to schedule
inspections. Requests for inspections are to be made at least 48 hours in advance and
may be arranged by calling (760)777-7131.
12. The following fire protection measures shall be provided in accordance with Riverside
County Ordinances, the 2022 California Fire Code (CFC) as adopted and amended by
the County of Riverside and/or recognized fire protection standards.
13.These conditions are preliminary and further review will be conducted upon receipt of
additional entitlement and/or construction submittals. Additional requirements may be
required based upon the adopted codes at the time of submittal.
14. Fire Department Access: Provide a site plan for fire apparatus access roads and signage.
Access roads shall be provided to within 150 feet to all portions of all buildings and shall
have an unobstructed width of not less than 24 -feet exclusive of curb -side parking, bike
lanes and other roadway features.
a. The construction of the access roads shall be all weather and capable of sustaining
40,000 lbs. over two axles for areas of residential development and 60,000 lbs.
over two axels for commercial developments. Ref. CFC 503.1.1 and 503.2.1 as
amended by the City of La Quinta.
b. Fire Lane marking: Identification and marking of fire lanes, including curb details
and signage shall be in compliance with Riverside County Fire Department
Standards.
15.All questions regarding the meaning of these conditions should be referred to the Office
of the Fire Marshal staff at (760)777-7074.
The City of La Quinta reserves the right to revoke, suspend, or void this permit at any time. The
City may add further conditions to this application request to mitigate any problems that arise
not previously addressed herein. This decision may be appealed to the Planning Commission
by any party who submits the necessary paperwork and filing fee of $1,526.00 to this office within
15 days of the date of approval of this permit.

TEMPORARY MODULAR SALES TRAILER
Location: Corner of Miles & Washington, La Quinta CA
The proposed use of the temporary modular sales trailer will be to procure presales of the
proposed short term / vacation rental units to be constructed on the property. The sales
trailer will have a temporary metal ADA accessible ramp for entry to the main door of the
modular trailer. There will be water, sewer and electric hook -ed up to the trailer from the
property. All items placed will be temporary and once all presales have been completed, the
temporary modular sales trailer and the temporary metal ADA ramp will be removed from the
site.
